*Advocate Mohsin Dar Demands Disciplinary Action Against GMC Doda Doctors for Suspending OPD Services in Violation of Supreme Court Judgments and Public Duty*

Prominent legal practitioner Advocate Mohsin Dar has written to the Jammu & Kashmir Health and Medical Education Department, urging immediate departmental action against government doctors at Government Medical College (GMC) Doda who suspended Outpatient Department (OPD) services as part of a protest against Hon’ble MLA Mehraj Malik.
In a letter addressed to the Commissioner/Secretary of the Health Department, Advocate Dar cited Supreme Court rulings and government conduct rules, emphasizing that the suspension of essential services amounts to gross misconduct and a violation of public duty.
Citing the landmark judgment in T.K. Rangarajan v. Government of Tamil Nadu (2003), he reminded the authorities that government employees—especially those engaged in essential services like healthcare—have no legal or constitutional right to strike or disrupt public services. “This disruption of OPD services has jeopardized the lives and dignity of common citizens, particularly the poor, elderly, and chronically ill, who rely solely on government hospitals,” the letter stated.
Advocate Dar also referenced the J&K Government Employees Conduct Rules and the Medical Council of India’s Code of Ethics, both of which prohibit the arbitrary withdrawal of services by government medical personnel.
In his representation, he urged the department to initiate disciplinary proceedings against the concerned doctors; ensure non-disruption of essential services in future protests; and issue a circular reaffirming the binding nature of Supreme Court rulings on public servant strikes.
The letter was formally submitted to the Health & Medical Education Department via official emails.
