National Emblem of India (Prohibition of Improper Use) Act, 2005 ke hisaab se, emblem ka use sirf government ke official kaam ke liye allowed hai.
Religious place par usko lagana misuse hai, chahe officer ho ya koi aur.
Agar koi officer aisa karta hai, toh wo law ka violation karega aur uske khilaf disciplinary aur legal action ho sakta hai.

2. Aam Public ne usko tod diya
Yahaan do cheezein hoti hain:
(a) Property Destruction ka angle
Chahe emblem wahan galat jagah par lagaya gaya ho, lekin usko todna Indian Penal Code (IPC) ke under “mischief” aur “destruction of public property” (IPC Section 425, 427 + Prevention of Damage to Public Property Act, 1984) kehta hai.
Matlab public ko khud se hathiyaar utha kar tod-fod karne ka adhikar nahi hai.
(b) Right to Protest
Public apna objection peaceful protest, complaint ya PIL (Public Interest Litigation) ke through utha sakti hai.
Constitution (Article 51A) har citizen ko national symbols ka respect karne ki duty deta hai.

3. Indian Constitution kya kehta hai?
Secularism (Article 25-28): State ke symbols aur religion ko alag rakhna zaroori hai.
Fundamental Duties (Article 51A): Har citizen ka farz hai ki National Emblem jaise rashtriya prateek ka samman kare.
