Supreme Court judgement will not affect the domicile based reservations in Sikkim

The judgement of the Supreme Court dated 29 January, 2025 in Dr. Tanvi Behl vs. Shrey Goel & Ors. concerns a limited question of whether State Medical Colleges are permitted to grant residence based reservation for PG courses. The court held that while domicile based reservation is permitted for MBBS, it is not permitted for PG courses as they are specialist courses.

The effect of this judgement is only limited to medical PG courses in other states. The court has interpreted the general principle of Article 14. Sikkim is an exception to the general principle in the light of the non-obstante clause in Article 371F. This exception is protected by the Supreme Court itself in the case of State of Sikkim vs. Surendra Prasad Sharma and in RC Poudyal vs. Union of India. Therefore, this judgement will not affect the domicile based reservations in Sikkim.

If this is what the Hon’ble Supreme Court thinks .. what happens to Our 371 f ? With all due respect , I beg to differ. Our Chogyal signed an agreement with Government of India when our kingdom was handed over .. so no one can interfere with what’s inshrined in the constitution of India . Not even SC.
