Supreme Court Hearing Petition Challenging Provisions of Money-Laundering Act

After a three-judge bench upheld the Prevention of Money Laundering Act (PMLA) and the powers of the Enforcement Directorate (ED) under its provisions in 2022, a petition was filed challenging the judgment and seeking a review of some of the PMLA provisions.
The Supreme Court is hearing an important review petition that has challenged certain provisions of the Prevention of Money Laundering Act (PMLA) and the Enforcement Directorate’s powers to arrest. The petitioner has basically challenged the 2022 Vijay Madanlal Chaudhary judgment by a three-judge bench of the Supreme Court that upheld the powers of the ED and the PMLA provisions. During the hearing on October 18, an interesting exchange took place between the Solicitor General, the lawyer for the petitioner and the three-judge bench of Justices Sanjay Kishan Kaul, Sanjiv Khanna and Bela M Trivedi. Below is a graphic representation of the edited excerpts from the day’s proceedings:

The Supreme Court of India has observed that while there may be numerous issues requiring attention across the country, it is impossible and impractical for the Supreme Court to address all of them, lest it becomes dysfunctional. This observation was made by Chief Justice of India (CJI) DY Chandrachud during a discussion of an intervention application related to the issue of deaths of captive elephants in Kerala.

CJI Chandrachud expressed concern over the increasing number of IAs being presented to the court in ongoing cases, reflecting an expectation for the Supreme Court to intervene in an ever-broadening range of matters. He emphasized the need to comprehend the exact role and function of the nation’s apex court. Below is graphic representation of the edited excerpts of the exchange in the top court between the CJI and the lawyers present.

The Supreme Court has lashed out at the Centre for indefinitely sitting over files for appointment of judges to various High Courts and the Supreme Court. Resuming its hearing on a plea seeking initiation of contempt action against the Central Government for delaying appointments, a bench of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia expressed its anguish over the Centre not taking any action for the past 10 months. The court then gave Attorney General R Venkataramani a week’s time to give a status report on the pending appointments. Below is a graphic representation of the edited excerpts from the hearing on Tuesday:
