The Arbitration and Conciliation Act, 1996 constitutes the principal statutory framework governing arbitration and conciliation in India. It establishes the legal framework governing arbitration agreements, the constitution of arbitral tribunals, the conduct of proceedings, the rendering of arbitral awards, and subsequent challenge and enforcement. Its interpretation through judicial precedent has progressively defined the limits of party autonomy and judicial intervention, while strengthening the principles of arbitral independence, territorial jurisdiction and finality of awards. The Act therefore remains fundamental to the study and practice of commercial dispute resolution and contemporary arbitration jurisprudence in India.
