No 65B Certificate, Yet Divorce Stands

In an important legal development, the Madhya Pradesh High Court has dismissed a wife’s appeal and upheld a decree of divorce granted to the husband on the ground of adultery—even though the photographs relied upon did not carry a Section 65B certificate.

The wife contended that the photographs amounted to electronic secondary evidence and were inadmissible without a mandatory Section 65B certificate, relying on the Supreme Court’s ruling in Arjun Panditrao.

However, the High Court took a different view. It clarified that matrimonial disputes are governed by a distinct evidentiary approach.

Under Section 14 of the Family Courts Act, Family Courts are empowered with broader discretion to admit material that may not strictly comply with the Evidence Act, as long as it helps uncover the truth.

A crucial factor was that the wife did not specifically deny that she appeared in the photographs. She merely alleged that the images were “manipulated,” without explaining how, when, or by whom. The Court also noted her admission that the photographs were originally stored on her own mobile phone and later accessed by the husband.

Regarding the husband breaking the phone, the Court observed that, given the circumstances, such conduct appeared “natural” and aimed at preventing further communication.

In matrimonial proceedings, substance prevails over technical formality. The absence of a Section 65B certificate does not automatically render electronic evidence invalid when Family Courts exercise their statutory discretion to assess credibility and context.
