SC refuses to stay entire waqf law, stalls certain provisions

The Supreme Court on Monday refused to stay the Waqf law, saying there was a “presumption” of constitutionality in its favour, but stalled the operation of certain provisions, including the one which said only those who are practising Islam for the last five years can create a waqf. (PTI)

Fruit mandis shut across Kashmir valley over highway havoc
Growers warn of valley-wide strike; ask elected government to resign if it cannot save fruit industry, emotional scenes at Sopore Mandi

=> Fruit mandis across Kashmir observed a complete shutdown on Monday in protest against the government’s failure to ensure the smooth movement of fruit-laden trucks. Growers warned of a valley-wide strike if the Srinagar–Jammu National Highway is not fully restored within two days.

Emotional scenes unfolded at Asia’s second-largest Fruit Mandi in Sopore, where growers with tearful eyes pleaded for the survival of the industry.

Many orchardists broke down during the protest, lamenting that their year’s hard work was rotting in stranded trucks while the government “watched silently.”

Speaking at the protest, President Fayaz Ahmed Malik, as per news agency—Kashmir News Observer (KNO), accused Chief Minister Omar Abdullah of failing the people. “If the CM can’t ensure the passage of fruit trucks, he has no right to sit in office. Resign if you can’t do anything,” he thundered, adding that no MLA had spoken up for the growers.

Growers alleged that while trucks carrying iron and other commodities were being allowed to move, fruit-laden vehicles were deliberately held back.

Warning of an escalation, Malik stated that if the highway is not restored within 48 hours, growers will announce a valley-wide strike that could paralyze economic activity across the region.

It is worth mentioning that mandis across the Valley—including Sopore, Handwara, Shopian, Kulgam, Anantnag, and others—remained shut as part of a two-day shutdown call on September 14 and 15.

Earlier, the fruit growers’ association reported that hundreds of trucks carrying perishable fruit consignments remain stranded on the highway and have not been allowed to proceed to their destinations, resulting in “massive damages and heavy losses” for growers—(KNO)

Terrorists constructing underground bunkers deep inside thick forests
Secret trench found in Kulgam’s higher reaches

=> In a change of tactics, terror outfits in Jammu and Kashmir are now constructing elaborately-designed underground bunkers deep inside thick forests and elevated ridges instead of taking shelter in local houses, officials said on Sunday.

This tactical shift, fuelled by eroding local support, presents a new challenge to the Army and other security forces.

This came to fore last week during an encounter in the higher reaches of Kulgam district, where two terrorists were killed. As the operation progressed, security forces found a secret trench with rations, miniature gas stoves, and pressure cookers, as well as weapons and ammunition.

One senior security officer, requesting anonymity, said the trend has become widespread in the Kulgam and Shopian districts, as well as south of Pir Panjal in Jammu region where thick forests provide a perfect camouflage for terrorists.

Though security personnel have managed to trace a few of these new hideouts, officials are becoming increasingly worried, especially after getting intelligence inputs that terrorists have been asked to stay in higher and middle of ridges and carry out attacks when directed from across the border.

"It's not the number of kills," said one official, "It's a troubling trend that indicates terrorists are now well-established inside these underground bunkers."

According to retired Lt Gen D S Hooda, who led the successful 2016 surgical strikes, these high-altitude trenches and bunkers are reminiscent of tactics used by terrorists in the 1990s and early 2000s.

Lt Gen Hooda, who commanded the strategic Northern Command, also flagged a major issue of absence of human intelligence now, which was one of the main assets in previous counter-terrorism operations.

Still, he is convinced that the Army will "re-evaluate its strategy" to address the new challenge.

Retired Director General of Puducherry Police, B Srinivas, who spent three decades with the Jammu and Kashmir Police, echoed this assessment and said terrorists are being forced to build these bunkers because they can no longer rely on shelters in towns and villages.

With the local people increasingly turning their back on their separatist ideology, infiltrating terrorists are now utilising these secret trenches to evade detection by locals, who they now presume to be informers.

This would be a repetition of what was witnessed in 'Operation Sarp Vinash' back in 2003, when forces were able to target concealed terror camps in the Poonch area.

To counter this new challenge, security agencies are planning to employ technology to counter the threat and are seeking to deploy ground-penetrating radar (GPR)-equipped drones and seismic sensors for deployment during anti-terror operations.

Drones can reach the hard-to-access areas, whereas GPR and seismic sensors can identify underground voids and structural changes in the earth, thus making it possible to identify the location of such underground bunkers.

The immediate objective of the security grid becomes obvious, which is to improve intelligence in these forest belts and employ these fresh instruments to neutralise the remaining terrorists.

In the past, the Army faced the menace of underground bunkers and man-made cavities but that was in the residential areas, mainly in Pulwama, Kulgam and Shopian, in 2020-22.

Giving examples, the officials said there was a hideout in the middle of Rambi Ara, known for its fluctuating water levels and often affected by flash floods. The terrorists were hiding inside an iron bunker made in the middle of it. The troops saw an opening of an empty oil barrel which was subsequently used by the terrorists to enter the bunker.

During that period, reports of more cavities in the traditional Kashmiri households and underground bunkers started surfacing.

Covered by dense apple trees and situated at a height, the Army found another underground bunker in Bandpoh where terrorists managed to create an underground room.

The bunker finally lay exposed after troops noticed a polythene sheet covering nothing and the earth nearby filled recently.

Another interesting hide and seek strategy was witnessed at Labipora in Shopian where terrorists covered an iron box on the banks of a river and kept a small pipe for breathing while hiding underground.–(PTI)

Haircut to persons with mental health condition: HC issues notice to ‘Team KYC’, H&ME

=>The High Court of Jammu and Kashmir and Ladakh has sought Department of Health and Medical Education (H&ME) as well as “Team KYC’s” response on a Public Interest Litigation (PIL) that seeks court’s intervention for stopping “forcible” trimming of beards and hair of persons with mental health condition and “distressing” practice of bathing them on camera.

Four Law students from University of Kashmir Khateeb Ali Buch, Sheeraz Ahmad Najar Tehseen Zahoor Badoo and Mehvish Manzoor have petitioned court to seek various directions.

In response to the PIL, a division bench of Chief Justice Arun Palli and Justice Rajnesh Oswal issued notice to the Secretary to Government H&ME and Team KYC through its Founder, Musadiq Bashir.

As ‘Team KYC’ was not served the earlier notice, the Court asked Principal District Judge, Pulwama to ensure that necessary measures are taken to ensure service of respondent No. 03 (Musadiq Bashir) before October 7, 2025.

As the matter came up, the two law students Sheeraz Ahmad Najar and Mehvish Manzoor raised the concern that the videos depicting forcible trimming of hair and beard of “vulnerable individuals have not been removed from social media platforms. “We are conscious and sensitive to the issue. Whatever requires to be done will be done, “the bench said, orally.

The court impleaded Department of H&ME as additional party respondent to the PIL filed last year by the law students.

According to the petitioners, ‘horrific videos” showing forcible trimming of hair and beard of “vulnerable individuals” are being uploaded on Facebook and other social media platforms by an organisation called team ‘KYC’.

According to the PIL, in these videos it can be clearly seen that the members of the organisation are forcibly trimming the hair and beards of (such) individuals, bathing them on camera which infringes their right to privacy and dignity.

The individuals being targeted can be seen protesting and screaming but are rendered helpless and are being overpowered by the members of the organisation,” says the PIL.

In the PIL, the students said that they wrote an application to State Commissioner Persons with Disabilities in August 2024 to protect the rights of these individuals and to take cognisance of the incidents and direct the relevant authorities to take action.

However, they said no action was taken as the videos still continue to surface on the social media and thus they had to approach the court to seek its intervention to stop the blatant abuse of the vulnerable individuals and the subsequent video recording of the incidents and uploading them on various social media platforms.

In December last year, the court had directed the State Commissioner, Rights of Persons with Disabilities, to file a better affidavit for the purpose of disclosing the activities carried out by it in terms of the Rights of Persons with Disabilities Act, 2016 and Mental Healthcare Act, 2017. The affidavit has been filed and the same was taken on record by the court.
