ЁЯЪи BIG BREAKTHROUGH IN DR DEBEN DUTTA MURDER CASE
тЪЦя╕П SUPREME COURT CONDONES DELAY, ADMITS ASSAMтАЩS SLP & ISSUES NOTICE
The Dr Deben Dutta murder case has reached the Supreme Court of India, with the apex court condoning the delay in filing the Special Leave Petition and issuing notice to the respondents. The notice is returnable within four weeks.
The SLP has been filed by the State of Assam against the Gauhati High Court judgment of July 30, 2025, which had converted the conviction from Section 302 IPC to Section 304 Part II IPC and commuted the death sentence awarded by the trial court to life imprisonment.
Assam, represented before the Supreme Court by Sr. A.A.G. Chinmoy Sharma, assisted by Advocate Aditya Agarwal and Advocate-on-Record Ankit Roy, has challenged the High Court verdict.
In its SLP, the State has argued that the killing of 73-year-old Dr Deben Dutta, a senior medical professional, was not a sudden or isolated incident but a brutal and prolonged mob assault.
The petition alleges that the attackers repeatedly assaulted Dr Dutta and that a sharp, broken-glass object caused a penetrating injury leading to massive bleeding. It further alleges that the accused obstructed medical assistance and efforts to take the victim to hospital.
The State has also challenged the High CourtтАЩs characterization of the incident as an тАЬemotional outburstтАЭ, arguing that the circumstances pointed to a deliberate and organized attack and warranted consideration under the тАЬrarest of rareтАЭ doctrine.
ЁЯУМ With the delay now condoned and notice issued, the legal battle over the conviction and sentence has entered a crucial new phase before the Supreme Court.
тЪЦя╕П The respondents have four weeks to respond.
