The University of Bologna Law Review is a legal journal run by University of Bologna School of Law students, and published by the Department of Legal Studies. Its main purpose concerns being a qualified research tool for practitioners, scholars, students, legislators, and others interested in legal studies. The journal is published twice a year, and each issue is focused on specific subjects, anal

yzed with an interdisciplinary approach. All the contributions are subjected to a rigorous editorial process, which involves a double-blind peer review, carried out by our Advisory Editors. Financial support is kindly provided by Cleary Gottlieb Steen & Hamilton LLP.

📣The University of Bologna Law Review is proud to announce the 7th edition of its Colloquium 📣

“Oltre il 7 ottobre: l’occupazione Palestinese tra guerra e diritto”
May 21st from 3.00 p.m. to 5.00 p.m., Sala delle feste, Palazzo Malvezzi (Via Zamboni, 22)

👤We are honored to announce that the guest speaker of the important event will be Professor Gian Maria Farnelli.

📚Gian Maria Farnelli is an Associate Professor of International Law at the Department of Legal Studies, University of Bologna (Italy) and Visiting Lecturer at the Universities of Antwerp and Olomouc.

🌍 He has been a member of the Italian Legal team in the M/V Norstar (ITLOS Case No. 25), the Questions of jurisdictional immunities of the State and measures of constraint against State-owned property (Germany v. Italy) (ICJ) and the Allegations of Genocide under the Convention on the Prevention and Punishment of the Crime of Genocide (Ukraine v. Russian Federation) (ICJ) cases, as well as research assistant in inter-state and investor-state disputes.
He has been a member of the Italian delegation during the Fifth Intergovernmental Conference on the negotiation of an Agreement under the United Nations Convention on the Law of the Sea on the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction.
His publications, in Italian and English, address issues of law of the sea, environmental law, State immunity, investment law and the law of international adjudication.

🎤In his keynote speech, Professor Farnelli will address the historical context of the conflict, the origin and development of the Palestinian issue, with a focus on the occupation of the Palestinian Territories. He will also discuss the most relevant principles and norms of international law related to the topic and the juridical implications of the events that followed October 7th, 2023.
After the introduction, there will be plenty of time for those in attendance to ask questions and engage in a constructive debate.

The University of Bologna Law Review welcomes applications for its for Associate Editors from students enrolled at the University of Bologna.🎓

👩🏻‍💻The admission process is composed of an interview with two Editors from the Human Resources and Welfare team, to get to know the candidate better both from a motivational and a linguistic point of view.
The purpose of this interview is to evaluate the candidate’s compatibility with the University of Bologna Law Review.

We are looking for 20 new Associate Editors!

📄[New article] “Migrant Smuggling: The Legitimacy of Our Choices” by Raquel Cardoso

📚Raquel Cardoso is an Assistant Professor of Criminal Law and Criminal Procedure at the Faculty of Law of the University of Lusíada - Porto (Portugal) and an integrated researcher at CEJEIA. She completed her PhD in Law in 2022, at the University of Coimbra (Portugal). Her research primarily focuses on European criminal law and judicial cooperation in criminal matters.

🇪🇺The article critically examines the legitimacy of European criminal law through the perspective of migrant smuggling incrimination. By analysing the complex intersection of legal principles and migration policies, the research investigates whether applying a principled criminalisation approach can resolve existing systemic legitimacy challenges in European criminal law.

✍🏻 Manuel Lazaro Pulido is a Professor at the International University of La Rioja (Spain) and an Associate Researcher at Universidad Bernardo O’Higgins (Chile).
