ADVISORY TO RESIDENTS OF MILIMANI AREA (KENDU BAY)
RE: ILLEGAL ROAD OBSTRUCTIONS ON THE MAGUTI PRIMARY SCHOOL ROUTE
This is a friendly but serious advice to those currently erecting or maintaining "man-made" bumps on Milimani Road. While we understand the need for order, please be aware of the following risks you are taking:
• Personal Liability for Accidents: Because these bumps are not official or marked, any rider or driver who crashes there has the legal right to sue the individuals who built them for damages and medical bills. You are making yourself a target for expensive lawsuits.
• Criminal Offence: Under Section 91 of the Traffic Act (CAP 403), erecting obstacles on a public road without written authority from the County or KeRRA is a crime. The police have been notified that these structures are causing harm, and they have the mandate to arrest anyone seen maintaining them.
• Damage to Public Property: Intentional sabotage of a public road carries heavy penalties. The government can charge you for the full cost of repairing the road surface once the illegal bumps are demolished.
• Harm to Residents: We all want the residents to be safe. However, unmarked obstacles cause chaotic braking and falls, which actually makes the road more dangerous for pedestrians and students.
MY ADVICE:
Please remove these illegal structures voluntarily before the County Enforcement and Police arrive for forceful demolition. If we need speed control, let us petition the MCA (Hon. Tom Adinda) or the Municipality Manager to install standardized, safe, and painted bumps.
Let’s build Karachuonyo with order, not with traps.
