Former DCI officer Philemon Kiplangat Chepkwony has been arrested by police in Kilimani, Nairobi.

According to the report, officers allegedly recovered one pistol, 100 rounds of ammunition, police documents and other police-related items during the operation. Authorities are expected to conduct further investigations into the recovered items and the circumstances surrounding the arrest.

BREAKING NEWS: Migori Governor Okoth Obado and his former personal assistant, Michael Oyamo, and Former Communications Director Caspal Obiero are found guilty of murder.

The Judgement:

1. The evidence demonstrated and left no doubt that the Accused persons acted in concert, jointly with others not before court, pursuant to a common design in furtherance of a criminal enterprise that resulted in the death of the deceased:

(a) The first accused provided motive.

(b) The second accused provided facilitation.

(c) The third accused provided assistance.

2. The fact that the first accused was not physically present at the place of death does not shield him from criminal responsibility. Criminal responsibility does not depend on the location of the persons with common intention.

3. The first, second and third accused persons were principal offenders by dint of section 20 of the Penal Code.

4. On the basis of the circumstantual evidence, the accused persons with malice afore thought directly caused the death of the deceased.

5. The prosecution proved its case against each of the 1st, 2nd and 3rd accused persons.

6. Each accused persons is accordingly convicted of the offence as charged.

The growing focus on junior officers in the Albert Ojwang case should not stop Kenyans from asking why Eliud Lagat appears to be drifting away from the centre of the story.

Albert was arrested over a complaint linked to Lagat, transported from Homa Bay to Nairobi and later died in police custody, yet responsibility now appears to be narrowing around those lower in the chain.

That should worry everyone.

The State may present arrests, CCTV footage and selected details as proof that justice is being done, but accountability cannot end with the people who carried out the operation while the senior officer whose complaint triggered it is treated like a distant observer.

Kenyans must not be carried in a stupid way.

If junior officers must answer, then the country must also be told what role Eliud Lagat played, what instructions were issued, who approved Albert’s movement and who expected reports from those handling him.

There were reports that Albert was removed from the cell at Central Police Station and taken to meet a senior National Police Service official at Karura forest torture chambers and it was at this point he was tortured in the presence of this senior official till he collapsed and died, they returned a body to Central Police station to stage a crime scene......

A command structure cannot be visible when orders are being followed and suddenly disappear when a citizen dies.

No one is asking that Lagat be convicted without evidence, but neither should he quietly walk free while those below him carry the entire burden.

The real test of this investigation is whether the full chain of command will be exposed, including Eliud Lagat’s role, without fear, favour or selective protection.

Witnesses of the Mbagathi Way crash that claimed the lives of three people have shared details of the final moments after a vehicle veered off the road near the Riara University turn-off in Nairobi during the early hours of Saturday and ended up on a pedestrian footbridge before bursting into flames.

One witness, speaking to a local media house, said occupants of the vehicle were heard screaming for help as flames quickly engulfed the car, with people who rushed to assist unable to rescue them after the intense heat forced them to retreat.

The vehicle reportedly came to a stop on the footbridge stairs before being consumed by fire, with videos from the scene showing the wreckage engulfed in flames as motorists and residents watched from a distance.

The wreckage remained at the scene for several hours before it was removed, with the bodies transferred to the Nairobi Funeral Home as authorities began efforts to identify the victims and trace their families.

Police have since launched investigations to establish how the vehicle left the road, mounted the pedestrian footbridge and caught fire, while detectives continue working to determine the identities of the three people who died.
