The Kericho High Court has once again postponed the delivery of judgment in Constitutional Petition E006 of 2024, a case against John Chebochok, Independent Electoral and Boundaries Commission(IEBC), Kenya Tea Development Agency Holdings (KTDA), Tea Board of Kenya and Tegat/Toror Tea Factory.

The ruling, which was expected today (25th September 20250 has now been rescheduled to 6th November 2025.

For survivors in the tea sector, each postponement is more than a procedural delay, it is a painful reminder of how long justice takes to arrive. Institutions failed to protect them in the past; the judiciary now carries the responsibility to ensure their voices are not silenced again.

As a Coalition Against S*xual Violence Kenya, we continue to stand in solidarity with survivors, demanding accountability, dignity and justice.

1 DAY TO JUDGMENT

Tomorrow, the Kericho High Court will deliver its ruling on Constitutional Petition E006 of 2024, a case born out of the BBC Africa exposé that exposed the sexual exploitation of women in the tea sector.

Now, the Judiciary carries the final responsibility. Will it continue the cycle of silence or break it by standing with survivors?

Following the BBC News Africa exposé on sexual exploitation in tea estates, the Coalition Against S*xual Violence Kenya filed a Constitutional Petition to block John Chebochok’s candidacy at Toror Tegat Tea Factory and to hold accountable the institutions that cleared him.

On 25th September 2025, the Kericho High Court will deliver its judgment. This moment is bigger than one individual, it will test whether Kenya protects survivors or protects abusers in power.

On 25th September 2025, the Kericho High Court will deliver JUDGEMENT in Constitutional Petition No. 006 of 2024 against John Chebochok, IEBC, KTDA and Tegat Tea Factory.

This case is not just about individuals or institutions, it is about accountability, justice and the protection of survivors’ rights. The outcome will set a critical precedent on how Kenya confronts impunity and protects communities from exploitation.

A certificate of good conduct is not a moral shield. It only confirms the absence of criminal convictions—not integrity, not ethical leadership, and certainly not respect for survivors. By equating a paper document with “good standing,” Independent Electoral and Boundaries Commission(IEBC) reduces Chapter Six of the Constitution to a checklist, ignoring its spirit and intent.

IEBC failed to consider or investigate the serious allegations raised against John Chebochok during its vetting process. An institution cannot claim to protect democracy while turning a blind eye to integrity.

Survivors deserve leaders of integrity, not those hiding behind certificates that fail to reveal patterns of abuse, exploitation or ongoing investigations.

The Kenya Judiciary must hold IEBC accountable for clearing John Chebochok's candidacy.

Under KTDA Holdings Limited’s watch, tea factories tied to John Chebochok became hotspots of systemic sexual exploitation. Instead of acting decisively to protect women, KTDA allowed abusers to remain in power. This negligence not only betrayed survivors but also fueled a cycle of abuse that continues to shame Kenya’s tea industry. The lack of coordination by Tea Board Of Kenya, IEBC, KTDA and even law enforcement has reduced justice to mere paperwork. This failure undermines their core mandate of “ensuring compliance with standards,” including moral and ethical ones.

This is why the courts must now step in, not to rubber-stamp impunity but to hold these institutions accountable for betraying survivors and violating the spirit of our Constitution. The whole Tea Board of Kenya and tea sector need reforms.

Survivors of sexual violence in the tea sector were not just ignored, they were betrayed. The Tea Board of Kenya saw the red flags, knew the abuses but chose to look away. By failing to act, they gave impunity a license to thrive.

The Corporate Governance Guidelines and Code of Conduct for the Tea Sector in Kenya clearly state: no person shall be appointed or elected as a Director of a Smallholder Tea Factory unless they comply with Chapter Six. Tea Board Of Kenya failed tea workers.

Earlier today, members of the coalition convened for our monthly meeting, where we reflected on the progress made so far, assessed ongoing initiatives and strategized on key priorities for the coming quarter.

A significant focus of the discussion was preparing for the upcoming judgment on Constitutional Petition E0024, which carries important implications for our collective advocacy and the protection of survivors and rights in Kenya.

As a coalition, we remain committed to strengthening our coordination and ensuring that survivors’ voices and community concerns remain at the center of our work.

S*xual and Gender-Based Violence (SGBV) is not about number, it is about human lives. Each case represents a survivor, who has endured deep violations and whose dignity and future demand urgent protection.

The reality that the majority of these cases involve children should shake us into collective action. We cannot afford to normalize these violations as statistics.

The government must prioritize and invest in comprehensive strategies to combat SGBV with the urgency it requires, from prevention, survivor-centered support services to strengthening access to justice.

Civil society, private sector, and communities must also play their part in building safer environments where survivors are heard, protected, and empowered.

Because every survivor deserves more than sympathy.

We welcome the court’s decision to uphold the dismissal of Robert Cheruiyot, the former Ekaterra Tea manager exposed in the BBC investigation on sexual abuse in tea estates. We are now waiting for justice in the case of John Chebochok, Tegat Tea Factory, IEBC, KTDA and TBK.

The court has upheld the dismissal of Robert Cheruiyot, a former Ekaterra Tea manager exposed in the harrowing BBC investigation that uncovered widespread sexual exploitation on Kenyan tea estates.

This ruling is an important step toward accountability but it cannot end here. The women who were exploited and abused must not be forgotten. They deserve justice, compensation, and support to rebuild their lives.

Survivors bore the true cost of this violence. Their pain must be acknowledged, and their dignity restored.

We now await the outcome of the case against John Chebochok, IEBC, KTDA, TBK and Tegat Tea Factory.
