The Independent Electoral and Boundaries Commission (IEBC) has confirmed that Kenyans currently lack a practical mechanism to recall their Members of Parliament, due to a significant legal gap that renders the constitutional provision unenforceable.

In a statement issued on Wednesday, IEBC Chairperson Erastus Edung Ethekon addressed growing public pressure to remove underperforming legislators. He acknowledged that although the Constitution grants citizens the right to recall their MPs, there is no legal framework in place to implement it.

The Commission drew a clear distinction between the recall process for Members of County Assemblies (MCAs) and that of Members of Parliament.

For MCAs, the IEBC noted that a proper statutory framework exists and that it is actively processing recall petitions where they meet legal requirements.

In contrast, no such legislation exists for recalling MPs. "There is currently no enabling legislation defining the grounds and procedures for recall," Ethekon stated.

This legal shortfall stems from a 2017 High Court ruling in the case of Katiba Institute & Transform Empowerment for Action Initiative (TEAM) v Attorney General & Another, in which the court found the recall provisions in the Elections Act 2011 unconstitutional due to discriminatory elements.

Although Parliament later amended the law to allow for the recall of MCAs, it failed to introduce a corresponding mechanism for its own members—effectively insulating MPs from recall efforts.

Valentine Wanjiru Githae, representing the youth-led 625 Movement, directly criticized Gachagua for promoting divisive rhetoric that appeared to elevate the Kikuyu community.
"When we position ourselves solely as Kikuyus, other communities will follow suit, and we risk repeating the same mistakes. We can’t keep suggesting that people from other tribes aren't hardworking. This sense of entitlement among Kikuyus needs to end," she said.
"If Gen Z doesn’t relate to the 'Mountain' narrative, how do you plan to engage us and shift the political discourse beyond the 'Wantam' slogan? What we’re seeing now is politics stuck in the past, and that’s alarming to us."

In response, Gachagua defended his views, claiming there is ongoing “persecution and discrimination” against the Mt. Kenya community and urged for immediate corrective measures.

He acknowledged the strength of Gen Z, describing them as "tribeless and fearless" and vital in challenging the status quo. However, his tribal-leaning remarks have drawn criticism from various political figures, including allies of President Ruto.

Despite the backlash, Gachagua’s engagement with the diaspora appears to be giving him a clearer view of public sentiment, as many continue to question the relevance of his ethnically charged political rhetoric.

Former Chief Justice David Maraga has announced plans to finance his 2027 presidential campaign through small public donations, emphasizing a grassroots, people-driven approach to politics.

In an interview on July 15, Maraga revealed he would contribute a modest personal amount—between Sh1 million and Sh2 million—while appealing to Kenyans to support his bid with contributions as low as Sh10.

“I will ask Kenyans to contribute to the campaign. I do not have significant resources, but I believe with the hardships people have endured, we can raise Sh50 or Sh100 from individuals. If we exceed our target, any surplus will be directed to a public cause,” Maraga stated.

The former Chief Justice expressed confidence in garnering support from Kenyans, particularly the youth and marginalized groups, citing growing frustration with the current administration.

Maraga pledged to form a government led by professionals and technocrats, where every public servant would be held accountable. “In my administration, everyone will be required to respect the law, starting with me,” he affirmed.

Commenting on recent Gen Z-led protests, Maraga criticised the government’s heavy-handed response and condemned the labelling of young protesters as “terrorists.” He called for respect for constitutional rights and a return to the rule of law.

Health Cabinet Secretary Aden Duale has confirmed that President William Ruto has approved a request to construct a mosque within the State House grounds in Nairobi. This development follows recent public debate sparked by the president’s announcement of plans to build a modern church at State House.

Duale explained that he personally appealed to the president to allow the renovation and expansion of the existing Muslim prayer space, a request which the president accepted.

“There is currently a small room where Muslim staff pray at State House. I requested the president to allow us to renovate and expand it, using our own resources, as he renovates the church,” said Duale.

The CS highlighted the challenges Muslim staff face when performing daily prayers, often resorting to praying on the grass or in corridors due to inadequate space.

“We pray five times a day. When we are at State House all day, we are forced to pray in open spaces and hallways. The president has graciously agreed to our request, and we have support from several well-wishers,” he added.

Duale also addressed criticism surrounding the religious developments at State House, defending the president’s actions as inclusive and respectful of all faiths. He further noted that concerns raised were disproportionate compared to previous administrations.

“During President Uhuru Kenyatta’s term, there was a large bar at State House and no one raised an issue. Yet now, people are questioning the building of places of worship. It’s unfair to criticize President Ruto for supporting religious spaces,” Duale said.

Former Deputy President Rigathi Gachagua has accused President William Ruto of profiling the Kikuyu community through what he describes as targeted criminalization and economic sabotage.

Gachagua alleged that President Ruto, whom he claims played a role in the 2007 post-election violence against the Kikuyu community, is now continuing that agenda during his presidency.

"History is repeating itself, and its architect—William Ruto—is back at the helm. He appears determined to complete what he started with the people of Mt. Kenya: to destroy their businesses and cast them as Kenya’s scapegoats," Gachagua said on Wednesday.

According to the former deputy president, members of the Kikuyu community are being economically undermined through deliberate destruction of their enterprises. He further claimed that terrorism-related charges are being selectively applied to citizens from the Mt. Kenya region as a form of profiling.

“When a police station in Mawego (Homa Bay) was torched, suspects were charged with arson. But when a similar incident occurred in Kiambu, suspects from the Kikuyu community were charged with terrorism,” Gachagua said.

He cited the case of Manyatta MP Gitonga Mukunji and his associates, who face accusations of financing terrorism and orchestrating violence.

Gachagua also alleged that a state-sponsored militia was deployed during the recent Saba Saba protests to inflict harm, destroy property, and frame the violence on the Kikuyu community.

Senate Speaker Amason Kingi has announced a special sitting to address the charges against Meru County Governor Kawira Mwangaza following her impeachment. In the notice, Kingi stated that senators will convene on Wednesday, August 14, for the special session.

The Senate will gather at 2:30 p.m. to deliberate on the charges against the embattled Governor of Meru.

"The purpose of the sitting will be the hearing of the charges against Ms. Kawira Mwangaza, the Governor of Meru County," the notice read.

As per Standing Order 33 (5) of the Senate Standing Orders, the only business during this special sitting will be the discussion of these charges. Afterward, the Senate will adjourn until Tuesday, September 3, 2024, at 2:30 p.m., as scheduled in the Senate calendar.

Governor Mwangaza's fate now lies in the hands of the Senators, who have previously intervened to prevent her removal in earlier impeachment proceedings.

Kapseret MP Oscar Sudi has announced that he has forgiven the protesters who stormed and looted his nightclub during the Gen Z demonstrations on June 25, which led to the closure of the establishment. The protesters, in their anger, made off with liquor worth millions as the situation escalated into violence.

Earlier this year, Sudi had opened the Timba XO Club, located off the busy Eldoret-Nakuru highway. Despite the significant losses he suffered, Sudi, a close ally of President William Ruto, stated that he harbors no ill will toward those who damaged his property and business. He attributed the actions of the protesters to being misled by political rivals.

Sudi, who described his rise from humble beginnings as a matatu tout to becoming an MP, emphasized that he would not use his position in government to retaliate against those who supported him.

"I come from a poor family, I came from far away, having worked as a matatu tout and now serving the people of Kapseret as a Member of Parliament. It’s a miracle and for that reason, I cannot take advantage of my position in government to frustrate people who voted for me," Sudi said.

He added, "As a Christian, the Bible teaches me to forgive those who have wronged me. We must forgive one another, and I urge all Kenyans who lost their properties to do the same for the sake of peace in our country."

The United Democratic Alliance (UDA) MP mentioned that he has put the losses from the protests behind him and is focused on starting over. JIMI WANJIGI'S BODYGUARDS REMAIN IN CUSTODY
Duncan Odhiambo and Calvin Ochieng, bodyguards of businessman Jimi Wanjigi will remain in police custody after a Magistrate Court rejected a request for their release. Milimani Chief Magistrate Bernard Ochoi ruled that there are sufficient grounds to detain them pending further investigations.

The two individuals, Duncan Odhiambo and Calvin Ochieng, represented by lawyer Willis Otieno, had petitioned the court to reconsider its decision, arguing that the state had no justification for their continued detention.

The lawyer also urged for their release, alleging that they had evidence showing that security officers planted explosives at Wanjigi's home.

Earlier on Monday, Wanjigi secured court orders preventing police from entering his homes or business premises.

Moses Kuria, the former Public Service, Performance, and Delivery Management Cabinet Secretary, claimed that the concept of a broad-based government implemented by President William Ruto was originally his idea. During a Monday night interview on Citizen TV, Kuria stated that he had proposed the idea of including the opposition in the government long before the recent Gen-Z protests.

"I can largely say that the notion of inviting the opposition to join the government was my idea. I anticipated potential issues and advised the president on the need to reform our politics," Kuria remarked.

Having served as a Cabinet Secretary, Kuria was among those not re-appointed after President Ruto dismissed his entire Cabinet following the Gen-Z protests. Kuria disclosed that he had engaged with various opposition leaders to encourage them to join the government.

He also stressed the importance of revisiting the 2010 constitution to establish a more inclusive government structure, expressing concerns that the current system might exclude certain groups after elections, which he believes should be avoided.

A NEW INITIATIVE TO DECONGEST PRISONS
On Monday, August 12, 2024, Chief Justice Martha Koome launched the Rapid Results Initiative (RRI) aimed at reducing overcrowding in the country’s prisons to maintain a sustainable prison population.

During the launch at the Industrial Area Remand and Maximum Prison, Koome emphasized that a large portion of those in prison have not yet been convicted, reminding that every accused individual is presumed innocent until proven guilty by a court of law.

“The Judiciary is dedicated to reviewing sentences and, where appropriate, releasing convicts to perform community service instead of serving time in prison,” Koome stated.

The Chief Justice highlighted that community service orders not only ease the strain on the prison system but also act as innovative tools to support the government’s environmental conservation efforts through 'green sentencing.' This approach requires released individuals to engage in public duties like tree planting and environmental restoration.

Koome disclosed that in the last financial year, 2023/2024, the courts reviewed 6,555 sentences, of which 2,918 individuals were found eligible for release under community service orders.

She also pointed out that as part of the broader plan to encourage plea bargaining and diversionary strategies, petty offenders should not be imprisoned but instead directed towards community service or alternative sentencing options that allow them to make positive contributions to society.
