Article 37 of the Constitution of Kenya, 2010 guarantees every citizen the freedom to assemble, demonstrate, picket, and present petitions to public authorities—peacefully and unarmed. ✊🏾🇰🇪

While this right is fundamental, it can only be limited by law—and only when such a limitation is reasonable, justifiable, and in line with a democratic society. 🏛️

Under Kenyan contract law, verbal (oral) contracts are legally binding — provided they meet the essential elements of a valid contract:

✅ Offer and acceptance

✅ Intention to create legal relations

✅ Consideration (something of value exchanged)

✅ Capacity of parties

✅ Legality of purpose

👉 The Law of Contract Act (Cap 23) does not require all contracts to be in writing — except for specific types like contracts for the sale of land, which must be written.

📌 Challenge: Verbal contracts are harder to prove in court, especially without witnesses or supporting evidence.
