County Government of Kajiado AND KAJIADO COUNTY ASSEMBLY WIN FIRST ROUND
*STATEMENT ON THE SHERIA MTAANI RULING ON INCREASE IN RATES ON ALLOTMENTS*
Dear People of Kajiado,
As you may now be aware,after so many instances where Judge D.Mugo postponed the delivery of the ruling citing various reasons,the court today 23rd July 2025 has delivered its ruling.*The court has refused to stop the county government from collecting the rates till the case is decided.
Even while we respect the court,we must be *BOLD TO CALL OUT SOME APPARENT MISTAKES*-whether made deliberately by the court or by error.From the reading of the decision,the court notes that its major concern is that the issue has been brought to court *2 years after it was passed*.For that reason the court finds that we have not demonstrated the need to have a suspension on the issue.I note that constitutional issues dont have a timeline as to when they can be presented to court.That reasoning is flawed.
Moreover,it is a wrong move of the court to allow the undeterred collection of the unconstitutional rates on allotments while the judge knows to well that the county *does not have a valuation role*.The judge has otherwise shut his eyes on a continuous violation of the constitution.
Judges are human beings.Sometimes they make erros-The error could either be unknowingly or at other times fall in the temptation of engaging in corrupt practises.Either way,our resolve remains to keep pushing until our voices are heard.
The fight is still on.*We return to court on 6th October 2025 to argue the main case*.
In the meantime,*i ask all of you NOT TO PAY THE ILLEGAL COUNTY TAXES*.We have a moral duty not to obey unjust laws.Ask yourself, why would the county be engaging us on the preparation of its valuation role yet on the other hand seek to get rates or revenue from us without any legal justification?*UTILIZE THOSE MONIES FOR SOMETHING ELSE.DONT ENRICH THOSE OFFICIALS UNJUSTLY*.
