🔻In a high-profile joint operation between Jakarta Police and Sri Lanka’s CID, five alleged underworld figures were extradited and detained for 90 days under the Prevention of Terrorism Act (PTA) - a move that has reignited debate over the law’s continued use.
🔻 The court granted permission to the Criminal Investigation Department (CID) to detain the 5 individuals for 90 days under the PTA. However, questions loom over whether the PTA, long criticized for enabling arbitrary detention, is being stretched beyond its intended scope.
🔻Back in April 2025, Minister of Justice and National Integration Harshana Nanayakkara clarified that the PTA would not be repealed until the new law was introduced. He also dismissed claims that the PTA had been used to arrest individuals for drug-related or organized crime offences, stating that the law had not been applied in such cases. “For non-terrorism related activities, I have not seen the PTA being used,” he said, clarifying that such offences fall under the Penal Code and would be prosecuted through standard legal procedures.
🔻However in contradiction in July 2025, Minister of Public Security and Parliamentary Affairs Ananda Wijepala acknowledged the PTA’s use in organized crime cases, but emphasized the urgency of reform: “New legal provisions will be necessary to continue addressing such cases effectively.” He confirmed that the Ministry of Justice is drafting new laws to give police the legal authority to detain and question organized crime suspects under a modern framework.
🔻 In August 2025, Foreign Affairs Minister Vijitha Herath assured that, “There is no debate. The PTA will be repealed.” He confirmed that a legal committee led by President’s Counsel Rienzie Arsekularatne had nearly finalized the amendments, with a Gazette Notification expected in early September 2025.
Now, as September unfolds and with more arrests under PTA, the questions remain:
↪ Why was the PTA used for recent organized crime arrests?
↪ Were there established links to terrorism at the time of the arrests?
↪ Will the government deliver on its overall pledge to repeal the PTA this month?
