Man Faces Legal Charges For St. Peters Lutheran Massacre.

Four victims of the 1990 Lutheran Church Massacre have filed a lawsuit in the Eastern District of Pennsylvania against Moses Thomas, a Liberian restauranteur living in South West Philadelphia.

The case alleges that Thomas, then Colonel and commander of the elite Special Anti-Terrorist Unit (SATU) within the Armed Forces of Liberia under President Samuel Doe, directed an attack on the St. Peter’s Lutheran Church compound in Monrovia.

The church compound was being used as a Red Cross aid shelter for 2,000 unarmed men, women, and children seeking refuge from fighting in Monrovia.

“Over the course of several hours, 600 people, primarily from the Mano and Gio tribes, were shot and hacked to death,” according to the suit filed by the four victims – all Liberian citizens, living in Liberia.

News and pictures from the massacre shocked the world and brought international pressure onto all parties to the conflict.

Then United Nations Secretary General, Javier Perez de Cuellar, described the carnage with ''horror and dismay'' and appealed for protection of civilians caught up in Liberia's civil war. Twenty seven years later no one has faced charges for the bloodshed.

The victims’ lawyer served the summons to a surprised Thomas working at his restaurant shortly after 2:pm Monday. Stopped by a Newsdesk reporter at his restaurant later that day Thomas was calm and receptive.

“This is absolute nonsense. I don’t who did it and was never around there when it happened. I saved people from the Lutheran compound, including Bishop Diggs son, and I have a written letter from him from years ago,” he said.

“I was so angry after reading the first few lines [of the complaint], I was unable to finish the whole document. So I’ll read the full document tonight and I will issue a full rebuttal tomorrow.”

Victims and justice advocates in Liberia and the US celebrated the lawsuit.

“Today, I am very happy that, at least, to some extent, the survivors of the Lutheran Church massacre—the most widely publicized massacre in the history of the Liberian civil war - are finally taking someone to court,” said Hassan Bility, head of the Monrovia- based NGO, the Global Justice and Research Project.

GJRP has been gathering evidence of war crimes committed during Liberia’s civil war since the failure of the Sirleaf administration to establish a war crimes court as recommended by Liberia’s Truth and Reconciliation Commission.

“On behalf of the victims I want to say thanks to U.S. authorities, and most especially the survivors themselves who stood up, on whose accounts he is being taken to court.”

In Monrovia Peterson Sonyah, Executive Director of the Liberia Massacre Survivors Association (LIMASA) and a survivor of the Lutheran Church massacre was pleased.

“I want to be very thankful today that one of the persons who committed heinous crimes today has been indicted in the U.S. for what he did to the Liberian people, most especially the Lutheran Church massacre. I think victims and survivors of the St. Peter Lutheran Church massacre will be at peace this evening. That is the first step.”

The identities of the four victims are being with being withheld because of fear of retaliation. They are being named only as Jane W, John X, John Y and John Z. It is expected that many more victims will testify when the case is brought to trial.

The victims are being represented by The Center for Justice and Accountability, a San Francisco based US-based human rights group which represented one of the victims in the prosecution of former Liberian President Charles Taylor’s son “Chucky” Taylor, for torture committed while he was head of the Anti-Terrorist Unit of Liberia from 1999 to 2003. (He is currently serving a 97-year sentence in a Florida prison.)

"Our clients managed to survive the Lutheran Church Massacre by hiding under the bodies of friends and family executed by the government forces. What they endured is beyond comprehension and this suit presents their first opportunity to see some form of justice carried out,” said Nushin Sarkarati, Senior Attorney for CJA.

Survivors of the massacre said government troops broke into the Church, in the city's Sinkor district, and opened fire on the crowded sea of men, women, children and babies. Survivors told aid workers that troops used knives, guns and cutlasses. Witnesses said at least 600 refugees were killed.

The survivors told foreign correspondents that a group of 30 soldiers surrounded the compound in the middle of the night, as rebel forces threatening to overthrow the Samuel Doe government stepped up their attacks on government positions on the outskirts of the capital.

They said soldiers then went to the upper floor and fired at hundreds of refugees. Soldiers ordered some women who tried to flee with their children to stand aside, according to the account, and other soldiers then fired on them.

Foreign correspondents who rushed to the scene of the massacre reported a nightmare:

The entire floor of the church was thick with bloodstains and bodies were huddled under pews where the victims tried to hide. Bodies of boys 7 or 8 years old were dr**ed on the altar and a pile of bodies was half-hidden in a dark corner.

Dead women lay on the floor with children wrapped in shawls on their backs. A crucifix had been thrown to the floor. Bullet holes riddled the ceiling.

The compound was filled with the bodies of women and children brought out after the massacre. People passing by were speechless as they looked at the rows of bodies.

The Red Cross and the Liberian Council of Churches had set up shelters at several churches in Monrovia, including St. Peter’s Lutheran Church, to house the nearly 9,000 internally displaced people.

Many of the displaced were seeking safety from government forces loyal to President Doe and his majority Krahn tribe, who at the time were committing retaliatory attacks against Manos and Gios, two ethno-linguistic groups perceived as loyal to Charles Taylor’s rebel movement.

Moses Thomas belongs to the Krahn tribe. He fled to the U.S. after Doe was captured and mutilated by a rival militia led by Prince Johnson.

Victims and Witnesses in the US Celebrate Justice

Charles Sunwabe was a teenager hiding with his family in the church. His mother and younger brother were executed. Charles and several of his relatives survived. Charles is now an attorney, working in Pennsylvania. He is not a client in this case.

“Although I am a victim of the Liberian civil war, I am not remotely interested in retribution. But neither am I interested in a reconciliation process that does not embrace justice. Without justice, it is impossible to speak of a democratic free society in Liberia. Liberian warlords and their lieutenants must be held account. Otherwise, we will be heading for another conflict.“

Andrew Voros, an American working in Wildlife Conservation in Liberia for many years, lived a few streets up from the Lutheran compound. When the sounds of gunfire ceased, Andrew was one of the first to get to the scene of the massacre. "Women and children were slaughtered like animals," he recalled in an emotional phone interview from his home in the U.S. Ten days after the Lutheran Church massacre, Andrew was arrested for hiding tribal minorities and imprisoned at then President Samuel Doe’s Executive Mansion compound where he witnessed multiple atrocities. He was turned over to US Embassy personnel nine days later.

Voros celebrated news of the lawsuit. "If those responsible for that are in the U.S. pretending to be the victims of that war, we have a responsibility to bring them to justice."

Sister Bette McCrandall served the Lutheran Church as Executive Secretary to Bishop Roland Diggs. She lived in the Church’s compound on the night of the attack. She also became emotional at the memories.

“That very night soldiers came in the compound looking for rebels. They carried several people away, some were released, some we never saw again,” she remembered by phone her home Flint, Michigan. “After the massacre, I went into the church looking for survivors. It was a horrible experience looking at all those babies dead on top of each other.”

She also applauded the suit. “They can run away from men but God got everything recorded,” McCrandall said. “It’s one thing to follow orders as a soldier or a rebel and it’s another thing for those who have the orders.”

Thomas Faces Damages not Jail

Thomas will now have time to hire a lawyer and respond to the allegations. Because this is a civil and not criminal case Thomas will be required to pay “damages” or monetary compensation to the victims if he is found guilty. He will not face criminal charges or deportation because of this case. Only the US government can pursue criminal charges.

That does not mean that he won’t ever face criminal charges. US prosecutors may still choose to pursue Thomas on immigration fraud charges as they did with Mohammed Jabbateh.

The former ULIMO leader known as “Jungle Jabbah” was convicted of lying about his war crimes when he applied for asylum and then a greencard. He could receive 30 years in a US prison when sentenced, likely next month.

Thomas has been living in the U.S. since 2001 and is currently legally resident under Temporary Protected Status according to Sarkarati.

He runs popular Liberian restaurant Klades in South West Philadelphia with his girlfriend.

Members of the Liberian diaspora identified Thomas and notified CJA. Since Thomas is now residing in the US, he is subject to U.S. law, and the survivors in Liberia can use the US court system to seek justice.

The victims are bringing the case under the Alien Tort Statute and Torture Victim Protection Act - two federal laws enacted to help ensure that human rights abusers cannot seek safe haven in the U.S. and that the laws are available to victims, regardless of their nationality.

The US criminal law on torture committed on foreign soil used to convict Chucky Taylor was enacted in 1994 after the 1990 Lutheran Church Massacre and therefore cannot be used in this case.

The lawsuit represents the latest in a global push by a coalition of human rights lawyers led by Monrovia- based NGO, the Global Justice and Research Project, and Civitas Maxima in Geneva along with CJA to give victims of Liberia’s civil wars a chance to seek justice.

In the wake of Mohammed Jabbateh’s conviction cases expected to go ahead in 2018 include the trial of former National Patriotic Front (NPFL) Defense Minister Tom Woewiyu in the U.S. for immigration fraud related to human rights abuses in Liberia; NPFL Commander Martina Johnsonin Belgium for atrocity crimes in Liberia; United Liberation Movement (ULIMO) Commander Alieu Kosiah in Switzerland for crimes against humanity and torture; and Agnes Reeves Taylor in the United Kingdom for her alleged role in NPFL abuses in Liberia.

Bility said this was just the beginning. “This victory must be applauded by the Liberian people, the victims and all peace-loving people.

It is also important for us to underscore this: since these killings occurred in 1990, the people, the victims and the survivors should understand that they have not been forgotten.

There are some people… who have been working to make sure that cases are brought against individuals who have been [alleged] to be responsible for those crimes.

It possible that in the future we can bring cases against other people who are responsible for massacres in Liberia. This small victory we take pride in for now.”

Several suspected criminals declared wanted by the Liberia National Police(LNP) in B**g County. Police in the county has asked residence to report wanted criminals if found.
The LNP is also urging neighboring counties or countries to assist in apprehending the suspects. The notorious criminal and murderous suspects are wanted by the police for alleged involvement in the commission of various crimes across the county.
According to information gather by this paper, the wanted individuals went into hiding when Police attempt to arrest them for crimes ranging from murder, theft of property, burglary among others.
Those wanted by the B**g county police detachment include Alieu Sannoh, Sackie Kollie, Awalayah Tokpah and Abraham Cassell.

Police in the county has asked community dwellers to join the search and report the alleged murderous suspects, Police also warning the public against providing hideout for these suspected criminals and murderous stressing that if anyone is caught in such act he or she will face the full weight of the law.
Speaking to our Reporter in Gbarnga, Police said these suspected criminals and murderous are dangerous, they move in various communities with harmful objects in pursuit of valuables items.
Moreover, on November 29 of this year residents of Lelekpayeh community woke up to the gruesome killing of 25 year-old Emmanuel Saye who was murder by Alieu, Awalayah Tokpah allegedly murdered his wife Korto Mulbah resident of Barwoequelleh Town in Suakoko district #5, Sackie Kollie allegedly murdered his 21 year –old wife Bandu Yah in Fenlah, Fumah district #7 while Abraham Cassell who allegedly stole US $1, 275, 00 from Atty. Charles M. Matalay assigned at the 9th judicial circuit court in Gbarnga, the incident occur when Atty Matalay sent Cassell to cash his check at the local Bank in Kakata, Margibi County, these suspects whereabouts remain unknown, Police said.

Police in Gbarnga, B**g County and Motorcyclist has launched massive search for alleged murderous who is only identify as Alieu for killing his friend Emmanuel Saye, age 25 years with a knife.
The incident took place near Ma-Nowah Face Book entertainment Center in the Lelekpayeh Community, Gbarnga, B**g County.
According to eyewitnesses who were at the entertainment center, told this paper that the incident occurred on November 29, 2017 at night hour. Speaking to Reporters from the entertainment Center, Bar tenders said that they heard the late Emmanuel Saye and suspect Alieu arguing from outside of the Club, they didn’t know what the argument was about, but later they heard the late Saye crying entering the Club that Alieu has strike him with knife on his Neck.
When Bar tenders rush out to arrest the suspect he couldn't be found, they said. The Liberia National Police was called by Bar tenders, when the Police arrived they sent for ambulance. According to the commander of the Crime Service Division of the Liberian National Police, B**g county detachment inspector, John Kellenso Flomo said that when they received the calls that night, they immediately dispatch team of investigators on the scene and it was observed that it was Emmanuel Saye that was victimized and upon the arrival of the ambulance the victim was pronounce dead. He further narrated that the management of the Face Book entertainment told investigators that they only heard the later Saye and Suspect Alieu arguing but didn’t know what the augment was about.
Moreover, Inspector Flomo said, eyewitnesses told the team of investigators that it was Alieu who committed the act. Police is in search for the suspect and calling on the public to inform the Police if found.
The commander told Reporters that 15 Man Curious Jury was establish to conduct a physical examination on the victim. The 15 Man Curious Jury report indicates that the victim was deeply cut in his throat which lead to his death. The Commander said that Police has contacted the victim parents from Nimba County and they are on their way to Gbarnga upon hearing the news.

The Liberia Anti-Corruption Commission (LACC) has investigated and sent to Court newly elected Representative for District # 5, B**g County, “ Mr. Edward W. Karfia owner of local Scholarship firm, Nay- Youngor Wulakalen Scholarship foundation for illegitimately directing U.S$100,000.00 from Cuttington University subsidy.

According to complained file to LACC by former Representative Samuel Bondo against newly elected representative Karfia owner of Nay- Youngor Wulakalen Scholarship foundation operates using the Cuttington University name to receive Government subsidy for his own selfish benefit.
Communication from LACC written to Hon. Samuel Bondo former representative of the district dated August 22, 2017 indicates that the matter was investigated and resolved. The communication from the office of the vice chair, Cllr. J. Augustine Toe of the commission which copy is in the possession of this paper is quoted as “Please be informed that our investigation establish that the USD100,000,00 allotted to Cuttington University in the FY 2014/2015 and FY 2015/2016 National Budget for local Scholarship in B**g County as mentioned in your complaint, was not managed or expanded by the administration of the Cuttington University; rather was managed and/or expanded by the intended end-user, Madam Suakoko Land Grant Scholarship Foundation as budgeted for and authorized by the Ministry of Finance and Development Planning (MFDP).
Also the recruitment and/ or vetting of the scholarship beneficiaries were carried out by the administrators of the Scholarship Foundation and not the administration of the Cuttington University. Please also be informed that the USD100, 000, 00 used by the Ministry of Finance and Development Planning (MOFDP) to pay off the tuition of beneficiaries to the Nay-youngor Wulukalen Scholarship was source from the Cuttington University subsidy budget and not the same USD100, 000, 00 which was budgeted in favor of the Madam Suakoko Land Grant Scholarship Foundation. In view of the above, I wish to have you informed that final report of the investigation, detailing all established violations of the Public Financial Management Law and the Penal Law of Liberia into the case mentioned above has been completed and submitted to the Ministry of Justice (MOJ) for legal action”.
Nevertheless, Hon. Bondo on a local radio talk show in the county was questioned on the matter Via Mobile phone, he confirm and termed the information as true and called on the administration of the University and citizens of the district to join the fight in order to mitigate corrupt practices in the District. Narrated further, Hon. Bondo said that the money was advocated for during the 52nd National Legislature to benefit desiring students of the district despite their political dispensation. He believes that the act was criminally carried out by the operator of the Scholarship Foundation to gain political glory in the district.
In order to ascertain the fact, the newly elected Representative was contacted through text messages and several phone calls, but refuse to response to the allegations up to press time.

As the game of life continue to prevail, frustration take over, this time Korto Mulbah has loose her life to her husband who has accuse her several times for having affairs outside the relationship. The incident took place on Sunday, October 22, 2017 in Suakok District # 5 B**g County.
Police in Gbarnga, B**g County and citizens has launched a vigorous search for Abalayah Tokpah who allegedly killed his wife, Korto Mulbah who is 26 years old. Tokpah shot his wife with single barrel gun on Sunday, October 22, 2017 in Barwoequelleh Town, Kpatawee clan, Suakoko District # 5, B**g County.

Speaking to our correspondence in B**g County, residence of Barwoelleh Town said that there has been series of misunderstanding between the late Korto and Tokpah for having affairs outside their relationship. As a result of the constant confusion between the two couples, Korto complained to her parents that she was not interested in the relationship because Tokpah was not catering to her rather harassing her for having extended relationship to another man which is not true.
According to people interviewed, when Tokpah committed the act he escapes with the gun including gun shots into the bush, his present in the bush is causing fear for residence especially farmers to farm, hunger has took over the town due to fear.
Police and traditional hunters are currently carry on thorough search in the forest to find the perpetrator, the search is being carry out by the Police detachment in B**g County under the supervision of Col. Frederick Nappy and the Regional Commander of the Liberia National Police, Col. Morris Teamah.

In an effort to improve lives of hundreds and thousands of citizens in B**g, Lofa and Nimba Counties, the Insurance Company of Africa (ICA) has contributed immensely to the human development in various sectors of the country by providing loan to its clients in Liberia, as twenty six (26) clients received loan over the weekend.
Speaking in an interview with this paper in Gbarnga after the launched of the company regional policy, the chief executive officer of ICA, Mr.Sam O. Mintah said that he love his clients and promise that he will strive to put smiles on their faces when they are in dire need.
According to the Chief Executive officer of ICA, since the establishment of the company in 1969; ICA has being contributing to the life of many Liberian through its micro loans program to clients for the duration of three years to pay back the loan.
Moreover, ICA executive Boss further indicated that on a yearly basic they provided assistance to communities’ dwellers and orphanages across the country, he said it was the company way of paying back to the society of what they received from them. Mr. Mintah reiterates that they has provide loan and financial assistance to clients since its inception, being the first Insurance Company in Liberia, this year they have giving out 20 million Liberian Dollars to clients as loans’.
Nevertheless, the ICA chief executive is calling on citizens of the three counties to do business with the company, especially Government employee.
For their part, beneficiary of the loan praise the Insurance Company of Africa for helping and bettering their lives as clients of the company.
Most of the beneficiaries are mostly business women, they thanks the company for empowering them that they able to sent their children to schools and put food on the table. They use the occasion to call on the company to extend the program to other parts of the country that ordinary citizen in the 15 counties will benefit.

The Liberia 2017 Presidential and Legislative elections is characterized by three groups of people, namely; 1) People who want the Unity Party led Government to be change, 2) People who want the Unity Party led Government to be change and replace with a qualify leader that can represent the country both Locally and Internationally, and 3) Liberian in the Diaspora blaming voters of voting wrongly. To ascertain the view of Liberian, Morning News Reporters conducted interview with voters around the country. Many of the voters said that did are not stupid rather prepare to bear any consequent that come out of the elections in the near future but a change will be made while the other blame politician of being greedy and self center placing them between a Cesar. They said that people who considering themselves to be wise are the most stupid people therefore they should shout out their mouths and watch for the result.

According to Voters interviewed, Many indicates that Politician in Liberia are self centers seeking after what they can get to enrich themselves and family but are not in the interest of Liberian, their actions in the 2017 elections by dividing themselves into so many political parties demonstrate the facts, they also said that Liberian in the Diaspora are lover of good times, they don’t have anything to offer to their nation as other countries national do in their country nation building process, therefore they should stay aside as they deal with the nation problem, they added.

Speaking to Reporters around the country, Group one said that they want Unity Party Government led by President Ellen Johnson Sirleaf to be replace because the Ellen led Government is characterized by corruption and depression supported by its leader President Ellen Johnson Sirleaf by putting her neck on chopping board for corrupt officials.

Nevertheless, Group two told Reporters that they are cut between the Cesar but prepare to swallow the bitter pills, they will not sit and entrust the country to unqualified leader that will bring disgrace and Economy hardship to the country. Although we want a change of the Unity Party led Government but we also want a qualify leader, they added. Several Rivers and Creeks were contaminated by MNG Gold Company in Liberia; MNG is a Turkish company that signed Concession Agreement in 2014 with the Liberia Government to Mine Gold in B**g County.

The Environmental Protection Agency (EPA) has confirmed that uncontrollable amount of slurry containing cyanide from MNG Gold’s Tailing Storage Facility (TSF) was discharged in the Sig Creek and surrounding Rivers with several residents victimized in Kokoya, B**g County, and Sig Creek is a tributary of the St. John River.

According to information gather by this paper indicates that, Cyanide is a chemical compound that contains the group C=N. This group is known as the cyano group which consists of a carbon atom that is triple bonded to a nitrogen atom; the accident took place in Kokoyah district.

In January 16, 2017, Environmental and Social Impact Assessment (ESIA) conducted inspection of the tailing Storage Facility of the company before issuing a “Class A” Mining License to the company to operate in Liberia. The Deputy Executive Director of EPA, Urias Goll told a News conference on Monday, October 2, 2017 that uncontrolled amount of slurry containing cyanide from the company’s TSF was discharged in the creek and other nearby wetlands on Wednesday, September 27, 2017 when a rupture of section of the geo-membrane layer of the tailing storage dam exploded.

The EPA Director said that, the contamination of ground waters including creeks and rivers has disrupted normal farming activities and unlawful gold mining in some parts of Sigwata Town along the bank of Sig Creek. A Team representing EPA and the Ministry of Lands, Mines, and Energy were dispatched to the scene to ascertain the fact and fined remedy to the situation.

Upon arrival of the teams, two hand pumps in the area were barricaded temporarily to prevent people in the community being affected by the chemical. 26 residents have allegedly developed health problems, these people have been transferred to Phebe Hospital for further checkup. EPA Executive Deputy Director also disclosed that the company has begun supplying food items including 30 bags of rice and chicken products and water to community members as a temporary measure due to the disruption in agriculture activities.

Director Goll disclosed that, a crisis management team comprising of EPA, Ministry of Lands, Mines, and Energy, Ministry of Internal Affairs and the National Public Health were instituted to manage the situation. The team will work with MNG Gold’s management to ensure that the situation is immediately brought under control. He also disclosed that there has been a high level meeting between the government, the CEO and his senior management team to find final solution to the situation.

Children Parliament in B**g County Condemn the death of 12 year Old Guinean National

The unwanted killing of children in Liberia has drawn the attention of the children parliament in B**g county, as 12 years old Kadijatu Jalloh was mysteriously murder by her parents in Gbartala, Yellequelleh District.
Speaking to Press in B**g county, Children Parliament Speaker, Jutomue Doetein, Jr. alarm that in 2016 Alvin Ruben and Moses Paye were allegedly killed by a Nigerian national in Monrovia while alleged r**e case lavish against Grand Gedeh county district #2 Representative Hon. Willie for abusing teenage girl. he said that this time around it is a Guinean national whose has being mysteriously murder by her parents. Mr. Doetein indicated that the killing and immense treatment on children has the propensity of taking the country backward, he believe that children are the future leaders of a country as he viewed the corps of Kadijatu body in Gbartala, B**g County. The newly elected Speaker of the Children Parliament in B**g County condemn the act and describe it as barbarian and erroneous.
According to eye witness, 12 years Kadijatu Jalloh was allegedly flogged and killed by Adama Jalloh and his wife Asatu Jalloh, mother of the deceased on June 27, 2017 during the night hour. The two perpetrators after committing the act, both conspired to conceive information until they can secretly bury the victim, but close neighbor in the community hinted the police that Adama and his wife Asatu while planning secretly to bury the victim body, they were spotted by resident of the community. Children Parliament in B**g county has condemn the act and describe it as barbarian and erroneous and violation on the Rights of children to live.
Moreover, Investigation conducted by the commander of the Crime Services Division of the Liberia National Police(CSD), B**g County detachment inspector, John Flomo said that the two parents told police preliminary investigation that the victim hands got broken and die at the result of sickness, they didn’t flog the victim as being claimed. When question the type of sickness that broke the two hands of the deceased ? they refused to state the kind of illness that the late Kadijatu has suffer from. Inspector Flomo told Reporters that upon arrival, ten men coroner jury was appointed by the police and community leaders to examine the co**se of the victim to establish the cause of death. He said after the inspection of the body, the ten men coroner jury found out that, the victim two hands were notice broken with stains of blood on her body which indicating that the Victim (Kadijatu Jalloh) was allegedly flogged. Investigation revealed that Adama Jalloh is not the biological father of the Late Kadijatu, but got married to the late Kadijatu mother Asatu Jalloh who earlier divorces the biological father. Police in B**g County has charge the two suspects for murder and sent to Gbartala magisterial court for prosecution.
Nevertheless, the Speaker of the Children Parliament, Jumotue Doetein, Jr. is calling on the Government of Liberia through the Ministry of Justice to be robust in fighting children right in the country. The children parliament speaker vowed that he will not sat down, he will continues to fight and advocate for the right of children in Liberia until justice is prevail.
