Subject: An Open Letter Of Grave Concern Regarding Recent Berea Hospital Incident And A Demand For Public Apology To The Victims And The entire Nation
Dear Mr. T’solo Tjekatjeka Thakeli
I hope this open letter finds you well.
My name is Mothopula Seala, and I represent the Mpepuoa Movement, a civil society organization advocating for human rights, education rights, gender rights, anti-corruption activism, and the elimination of gender-based violence across Lesotho, particularly within critical and essential services environments, such as the health care setting.
After our brief telephonic conversation on the 8th of August 2025 3 days after the harrowing incident, live streamed on your social platform on the 5th at the Berea Hospital, we conducted thorough investigations into the matter and wish to address you as follows
We are writing in response to the recent incident at Berea Hospital involving your visit and your subsequent interactions with hospital staff. We appreciate your passion and unwavering commitment to justice, particularly your advocacy for timely and fair access to public health services.
However, as an organization that stands for the protection of both service providers and consumers of services across the board, we feel obligated to express concern over how the situation unfolded. While patients and the public at large have every right to receiving respectful, competent care, access to information about their condition and treatment options, privacy and confidentiality, and the ability to make informed decisions about their care, patients on the other hand should be mindful of the rights of other patients and staff within the healthcare setting. It is, therefore, equally important to safeguard the dignity and rights of healthcare workers who are often overwhelmed, under-resourced, yet still expected to serve with professionalism under challenging conditions. With respect, we believe that your actions on that day were not aligned with the principles of fairness and dignity that we all advocate for.
We categorically wish to express our disdain in the manner in which you conducted this live broadcast, thereby violating the rights of the minors you claim you were helping as well as the rights of the very essential services providers which the country needs so much.
While we acknowledge the importance of highlighting and exposing sub-standard services, corruption, and all other malpractices within the healthcare and other public service spaces, we believe that your actions went beyond investigative exposure. Engaging in actions that constitute harassment, violation of privacy, and endangering minors is totally unacceptable and criminal, not just that, this could set very bad precedent to the already disorderly and unregulated media spaces in a violent cultured era.
It Is against this background that we write you this open letter to demand a public apology and to make you aware that we will be reporting criminal charges against you under the criminal procedure and evidence act of 1981.
From the evidence reviewed in your live broadcast, it is clear that:
1. You filmed hospital nurses and said minors without their consent in violation of Section 11 of the Constitution of Lesotho (Right to Privacy) and workplace protection laws.
2. You deceived a nurse, falsely claiming she was not being recorded and that you were “just pressing your phone,” while she was in fact part of a live video streamed to the public.
3. Another nurse explicitly asked you stop recording her, yet you wilfully continued filming, thereby committing a deliberate act of harassment and intimidation under the public health order of 1970 and common law principles.
4. You included identifiable children in your broadcast, in breach of the Children’s Protection Act 2011 (section 14 and 16),which safeguards minors from exposure to harm, ridicule and exploitation.
This conduct is not only ethically wrong but also legally questionable. It disregards the dignity, privacy and safety of individuals who were involuntarily subjected to your broadcast.
As Mpepuoa Weekly/Movement,we strongly condemn such actions and hereby notify you of our intention to press formal charges against you, for :
1.Harrasment and intimidation of healthcare workers in the course of their duties.
2.Unlawful exposure and endangerment of minors.
3.Violation of privacy rights.
4.Inciting violence.
5.Using hate speech.
We also hereby demand that you :
1.Immediately remove said video from all platforms where it has been posted and/or shared.
2. Issue a public verbal apology to affected parties within 24 hours of receiving this notice.
Accountability and respect for human rights must be upheld, even when addressing public service shortcomings. Your platform should not be used to incite violence, demean, harass, propergate hate speech and endanger others.
