Man fined K100,000 for illegal fuel transportation
The Karonga First Grade Magistrate’s Court has convicted and fined a 23-year-old man, Wilson Mwambacha, K100,000 for transporting liquid petroleum without a license.
Mwambacha was arrested on June 26 after being found in possession of 12 jerricans of liquid petroleum, each containing 20 litres, which he was transporting without a permit.
Appearing before the court on July 1, Mwambacha pleaded guilty to the charge. In mitigation, he asked for leniency, stating that he was a first-time offender and unaware that transporting fuel without a license was illegal.
However, the state prosecutor, Robert Mkandawire, pushed for a stiffer penalty, noting that such offenses are becoming increasingly common in the district.
“This is a serious offense under the law. Regardless of ignorance, the act of transporting hazardous substances without proper documentation poses risks to public safety and should be discouraged,” Mkandawire argued.
Passing judgment, First Grade Magistrate Julius Kalambo agreed with the prosecution and ordered Mwambacha to pay a K100,000 fine or serve five months in prison with hard labour in default. The court cited Section 17(d), as read with Section 42 of the Liquid Fuels and Gas (Production and Supply) Act.
Meanwhile, Karonga Police Spokesperson Margret Msiska warned the public against engaging in illegal transportation of fuel.
“People should be aware that handling or transporting fuel without authorization is a criminal offense. We are stepping up efforts to curb such practices to ensure public safety,” she said.
The confiscated fuel has since been forfeited to the Malawi government.
Mwambacha hails from Namchimbu Village, Traditional Authority Mwaulambia, in Chitipa District.
