Woman jailed 4 years IHL for stealing baby

The Mangochi Senior Resident Magistrate’s Court on May 11, 2026 convicted and sentenced 26-year-old Aisha Mary Wilson to four years imprisonment with hard labour for stealing her friend’s five-month-old baby girl, contrary to Section 167 of the Penal Code.

During court proceedings, the Station’s Prosecution Officer(SPO) Inspector Amos Mwase, told the court that the convict and the victim were once neighbours in Mangochi Township before the victim relocated to her home village in Katema Area. Despite the relocation, Wilson continued monitoring the victim until she gave birth in November last year.

On March 4, 2026, Wilson convinced the victim to return to Mangochi boma after promising her a job opportunity. Upon arrival, the victim stayed with the convict for several days without being introduced to any job as promised.

On March 18, 2026, the victim decided to return home, and Wilson offered to es**rt her to Katema Depot. Along the way, she asked to carry the baby, claiming she wanted to assist the mother who had luggage.

However, as they approached the depot, Wilson excused herself to answer the call of nature while carrying the baby and disappeared with the child.

Police later arrested Wilson in Chimwala Area, where she had been hiding and successfully rescued the baby.

Appearing before court, Wilson pleaded not guilty, prompting the state to parade five witnesses who proved the case beyond reasonable doubt.

In mitigation, the convict only apologised to the court and said she had nothing to mitigate.

In his submission, Prosecutor Mwase reminded the court that Wilson is currently on court bail after committing a similar offence in Makanjira in January this year. He further submitted that her actions endangered the child’s life as the baby had been separated from the mother for several days without breastfeeding and therefore prayed for a custodial sentence.

In his ruling, Senior Resident Magistrate Muhammad Chande concurred with the state and sentenced Wilson to four years imprisonment with hard labour as a deterrent to would-be offenders.

Wilson hails from Katema Village in Traditional Authority Mponda, Mangochi District.
