Challenges in Enforcing Data Privacy in Malaysia and Opportunities for Improvement.

Today's great initiative and thanks to the town hall organizer extending an invitation to attend to discuss Data privacy Act initiated by Jabatan Perlindungan Data Peribadi Malaysia (PPDP)

My suggestions to Honorable Digital Minister Gobind Singh Deo
1. Almost 90% of personnel data are held by gov agencies not private entities .
Government Agency Exemptions Undermine Adoption, it's similar to requesting your son not to smoke but you smoke in front of him.

Both Korea and Japan improved their foreign direct investment (FDI) by strengthening their data privacy regulations, which built international trust, ensured compliance with global standards, and facilitated smoother cross-border data transfers.

Results & FDI Growth
Japan
Achieved a record FDI inflow of $31 billion in 2022, with strong investments in IT, e-commerce, and digital health.

South Korea
FDI reached $30.5 billion in 2022, particularly in semiconductors, AI, and cloud computing sectors, fueled by trust in strong data governance.

By enforcing strong data privacy laws, Korea and Japan successfully increased FDI, particularly in technology and digital services, by providing a secure, compliant, and globally trusted investment environment.

Exempting government agencies from compliance creates an uneven regulatory landscape, discouraging private sector adherence. If government agencies are required to comply, it will build investor confidence, particularly among foreign investors seeking a strong and transparent data protection framework.

2.Minimal USD 120K Penalties to global companies for data breach is a piece of cake they earn in USD Billions ,global companies need to be penalized at a higher rate.

3.Independence of Data Protection Officers (DPOs)
DPOs should operate independently, reporting directly to the CEO and Board rather than being placed under HR, Legal, or IT departments to ensure impartiality and effectiveness.

4.Autonomy of the Data Protection Authority.
The department responsible for enforcing data privacy laws must function independently to avoid conflicts of interest and regulatory capture.

5.Strong Regulatory Enforcement is Essential.
Without an efficient and proactive enforcement agency, data privacy regulations risk becoming ineffective and irrelevant with all new laws enacted .

Adalah membimbangkan untuk melihat bahawa sementara syarikat swasta diletakkan pada piawaian yang tinggi dalam perlindungan data, agensi kerajaan kadangkala bergelut untuk memenuhi jangkaan yang sama. Ketidakseimbangan ini berpunca daripada beberapa cabaran:

1.Penguatkuasaan dan Penalti: Akta Perlindungan Data Peribadi (PDPA) bertujuan untuk melindungi maklumat kita, tetapi penguatkuasaannya boleh menjadi tidak konsisten, dan penalti mungkin tidak cukup berat untuk memastikan pematuhan sepenuhnya oleh badan kerajaan.

2.Halangan Birokrasi: Kerumitan operasi kerajaan sering kali melibatkan proses birokrasi yang rumit, menjadikannya sukar untuk melaksanakan langkah-langkah perlindungan data yang diperlukan dengan cepat.

3.Kekurangan Sumber dan Kepakaran: Sesetengah agensi menghadapi kekangan dalam bajet, teknologi, atau kepakaran, yang menghalang keupayaan mereka untuk memenuhi piawaian perlindungan data dengan berkesan.

4.Persepsi Kekebalan: Terdapat persepsi bahawa entiti kerajaan kurang cenderung untuk menghadapi akibat kerana pengendalian data yang tidak betul, yang mungkin membawa kepada sikap sambil lewa.

5.Cabaran Ketelusan: Ketelusan dan akauntabiliti adalah penting, tetapi prinsip-prinsip ini tidak selalu diutamakan, menyebabkan kelewatan dalam pengakuan kesilapan atau pelanggaran.

6.Kerumitan Pelaksanaan: Menubuhkan sistem perlindungan data yang kukuh adalah cabaran yang besar, terutamanya untuk organisasi kerajaan yang besar dan rumit.

7.Kesedaran Awam:
Orang ramai mungkin tidak sepenuhnya memahami betapa pentingnya perlindungan data, yang menyebabkan kurangnya tekanan kepada kerajaan untuk memberi keutamaan kepada isu ini.

Untuk menangani cabaran-cabaran ini, kita memerlukan penguatkuasaan yang lebih tegas, garis panduan yang lebih jelas, dan lebih banyak sumber. Yang paling penting, perubahan budaya ke arah ketelusan dan akauntabiliti yang lebih besar dalam pengendalian data peribadi adalah penting.

"Prevention is better than cure"
It's frustrating to see that while private companies are expected to strictly follow data protection laws, government agencies often seem to get a free pass. There are a few reasons why this happens:

1.Weak Enforcement and Penalties:
The Personal Data Protection Act (PDPA) is supposed to protect our data, but the enforcement is spotty. The penalties for non-compliance might not be tough enough to really push government agencies to follow the rules.

2.Slow Bureaucratic Processes:
Government agencies often have to deal with a lot of red tape. This makes it hard for them to quickly adopt the necessary data protection measures.

3.Lack of Resources and Expertise:
Some agencies simply don’t have the budget, technology, or know-how to meet data protection standards.

4.Feeling Above the Law:
There’s a sense that government bodies believe they won’t face serious consequences even if they fail to protect our data.

5.Lack of Transparency and Accountability:
Unfortunately, transparency isn’t always a priority in government, which can lead to a reluctance to admit mistakes or breaches.

6.Complexity of Implementation:
Putting in place strong data protection systems isn’t easy, especially for large, complex government bodies.

7.Low Public Awareness and Pressure:
People might not be fully aware of how important data protection is, which means there’s less pressure on the government to act.

To fix this, we need better enforcement, clearer guidelines, and more resources. But most importantly, there needs to be a shift in attitude towards greater transparency and accountability when it comes to handling our personal data.

Why is the government hesitant to accept full liability for data privacy breaches within its agencies? To ensure accountability, it would be beneficial to hold the public sector equally liable and increase penalties to the global standard of 3 to 4% of total annual revenue. This measure would prompt all organizations to prioritize data privacy. If government agencies are not held accountable, the private sector may not take data privacy seriously. This is just my proffesional perspective.
