[KiniNews] The Federal Court has instructed the prosecution to rethink its position on reinstating four criminal charges against Syed Saddiq Syed Abdul Rahman.

The instruction was similarly extended to the Muar MP’s defence team, with Court of Appeal president Abu Bakar Jais, as the chair for the three-member apex court panel, reportedly saying it is an appropriate time for both parties to “go back, reflect, and reconsider” their stances.

The panel then allocated one week for the prosecution to file additional written submissions, followed by another week for the defence to review and respond before making their position known.

Meanwhile, in a separate story, the Attorney-General’s Chambers decided not to appeal against Rosmah Mansor’s acquittal of 12 money laundering charges and five charges of failing to declare her income to the Inland Revenue Board (IRB), as there is no prospect of conviction if the appeal were continued.

“Among the factors we considered was that the prosecution would not be able to prove the case beyond a reasonable doubt as required when dealing with criminal charges. This is because some of the witnesses needed to secure a conviction have passed away, and others have gone untraceable,” said the AGC.

Withdrawals by the prosecution and too many delays - these were some of the reasons why over half of the 28 corruption cases since 2018 involving 21 top politicians have fallen through.

A study by institutional reform group Projek Sama also found that the absence of a dedicated law to regulate political donations had caused some politicians, including a former minister, to be let off.

These reasons point to flaws in the prosecutorial process of the justice system which include the fact that the role of Attorney-General is fused with that of the public prosecutor.

If these flaws are not fixed, it will feed the perception that the law has two tiers - one for the wealthy and connected, and one for everyone else.

Prime Minister Anwar Ibrahim has suggested that his predecessor, Dr Mahathir Mohamad, and former attorney-general Tommy Thomas should take responsibility for Rosmah Mansor walking free in her RM7 million money laundering and tax evasion case.

This was after the Attorney-General’s Chambers (AGC) withdrew its appeal against the High Court’s acquittal of charges against the wife of former prime minister Najib Abdul Razak.

Ruling out political motivations in the latest development, Anwar noted that Rosmah was charged in 2018, but the courts later acquitted her because the case was “weak”.
