He appeals to move two motions together, that of May 22 and June 2, since the respondents have replied the motion.

I was asking my Lords for leave to move the one on 2nd of June outside time for Pre-hearing because my Learned friends have responded to the motion on the 22nd of May on the May.

1st Resp: My Lords we have no opposition to taking the two applications. It is our view that your Lordships decision on the first will make it unnecessary for the second.

LP: For the motion filed on the 2nd of June is asking My Lords for two prayers in the main. That application has 5 grounds on which it is brought numbered as A-E. There’s also an affidavit of 3 paragraphs in support of that application. My Lord with respect, and an accompanying written address as stipulated by the rules. That application is at your discretion my Lords. But because my Learned friends responded to the application served on us yesterday, I have a reply on points of law. I have a further written address to reply on points of Law filed on 8th of June 2023. There’s also a reply on points of law to the 1st respondent, which is also filed today my lords. I’m also making reference to the motion filed on 22nd May, 2023. It also has 2 substantive prayers. That application has 13 grounds which it is brought. That application has an affidavit of six paragraphs and paragraph 2 has A-H and 3 has A-C, but there are six substantive paragraphs. Attacked is one exhibit, exhibit A which is interrogatories and I understand that these questions deal with the crux of this matter on non-compliance. There’s also a written address attached in compliance with the rules of court. We also filed the interrogatories as a separate process and it’s before my Lords. We also filed a further written address in support of Motion filed on 22nd of May, 2023, filed on 6th of June. We urge my Lords to grant these motions in the interest of Justice.

We filed a counter affidavit on the 25th of May in response to the one filed on the 22nd of May along with a written address. With respect to the most recent application, our counter was filed on the 5th of June. We also attached a written address to assist your Lordships and that was filed on the same day.
We respectfully adopt all the arguments canvassed in both addresses with specific respect to the latest written address, I wish to draw your Lordships to paragraph 4.13 where we quoted the brilliant exposition of my lord, right of the presiding Justice of this court. In the case of ….. 2019 decision of this court, I submit that as a result of this brilliant decision, my Lords should grant it. I’m respect of the second application, we want to draw to your attention one fact that the application was filed 26 days after the close of pleadings was when this was. There’s no prayer for extension of time. This application should be dismissed.
2nd & 3rd: My Lords in opposition to the 2 applications we filed our written address dated 5th June, 2023 on the same day. We humbly adopt the written address urging our noble Lords to dismiss the two applications.
I wish to make one or two points on the reply by the petitioners which was served on us yesterday. (Court rejects his attempt to reply)
(He goes on that fair hearing is not a magic wand to use to defeat what the law requires you to do).
Court: The pre-hearing was closed on the 22nd. You filed on the same day but the application doesn’t show and you agree that it wasn’t ripe for hearing?
LP: Yes
Court: You have cited fair hearing but it’s your duty to draw the attention of the court to the application, else the court can deem it as abandoned?

4th: we also filed a counter filed 7th of June. Deposed to by Emmanuel Okonsa along with a written address. We shall be praying your Lordships to dismiss the applications. We will not be asking for cost.
LP: I have no reply on points of Law.
Court: We reserve ruling either tomorrow or the day after.
LP: We indicated that we may call two witnesses today
Court: Is he also an ex-corper? (in reference to the earlier witness of PDP who disappeared?

My biggest concern in today’s hearing is that the judge also didn’t seem to understand what the witness was saying about AWS. They didn’t interrupt or say much. Even when LP lawyers objected to certain questions, it was if they didn’t know whether to overrule or sustain it. It’s common for people to behave that way when they don’t know what is being discussed, but I’m staying hopeful.
I hope the judges take time to understand the different processes discussed.

There’s an error in the LGA presented and the judges are trying to sort out what schedule it was tendered on.
Justice Tsammani is not having it as he has been complaining about the documents tendered and arrangements of the schedules.
Justice Adah has also complained and they are putting all the schedules page by page to locate the missing LGA
