1st Resp: My Lords we have no opposition to taking the two applications. It is our view that your Lordships decision on the first will make it unnecessary for the second.
2nd & 3rd: My Lords we have no objection to the two motions being taken together.
4th: We have no objection to the two motions being taken together.
LP: For the motion filed on the 2nd of June is asking My Lords for two prayers in the main. That application has 5 grounds on which it is brought numbered as A-E. There’s also an affidavit of 3 paragraphs in support of that application. My Lord with respect, and an accompanying written address as stipulated by the rules. That application is at your discretion my Lords. But because my Learned friends responded to the application served on us yesterday, I have a reply on points of law. I have a further written address to reply on points of Law filed on 8th of June 2023. There’s also a reply on points of law to the 1st respondent, which is also filed today my lords. I’m also making reference to the motion filed on 22nd May, 2023. It also has 2 substantive prayers. That application has 13 grounds which it is brought. That application has an affidavit of six paragraphs and paragraph 2 has A-H and 3 has A-C, but there are six substantive paragraphs. Attacked is one exhibit, exhibit A which is interrogatories and I understand that these questions deal with the crux of this matter on non-compliance. There’s also a written address attached in compliance with the rules of court. We also filed the interrogatories as a separate process and it’s before my Lords. We also filed a further written address in support of Motion filed on 22nd of May, 2023, filed on 6th of June. We urge my Lords to grant these motions in the interest of Justice.
[6/9, 10:52] MTN: We Are On A Roll Today

Faster Than A Rocket

You Snooze? You Lose

And, Fasten Your Seatbelts Cos It’s Getting CRAZY 🔥🔥

Who Dey….. ZUZU una go learn lawyer work by force
[6/9, 10:52] MTN: Ikwueto SAN:
He identifies both motions having been given the permission to do so by the court.

He notifies the court that since the respondents replies the motions, the Petitioners have a reply on point of law with written arguments made in that respect.
[6/9, 10:52] MTN: With the Petitioners moving both motions today.

2nd and 3rd Respondents:
They also do not object to the taking of both motions together.

4th Respondent:
They also have no objections to the two motions being taken together.
[6/9, 10:52] MTN: The motion on notice of May 22 have two substantive prayers and is supported by 13 grounds upon which it is brought.

This motion is also accompanied by affidavits with 6 substantive paragraphs and Exhibit A is attached to the Affidavit which is the Petitioners Interrogatories...
[6/9, 10:52] MTN: for delivery on the 1st Respondent as they deal with the cardinal issue of non-compliance against the 1st respondent.

Ikwueto SAN urged the court to consider the motion in line with the Exhibit A attached and asked that they decide it in the interest of Justice.
[6/9, 10:52] MTN: 1st Respondent:
With respect to the May 22, 2023 Motion, they filed a counter affidavit on May 25 alongside their written address on the same date.

With respect to the June 2, 2023 motion, they filed their counter affidavit on June 5, accompanied by their written address.
[6/9, 10:52] MTN: They prayed the court to dismiss the application on the basis that it was filed 26 days after the close of filings.

2nd and 3rd Respondents:
They noted that they've filed responses to the motion by the Petitioners dated 6th June.

They humbly adopt their document and urged the..
[6/9, 10:52] MTN: Court to dismiss the two applications.

The counsel told the court that they will like to reply to the reply of the Petitioners filed yesterday. (It's unheard of that a party replies to a reply)

The court reprimanded him and noted that it wasn't possible to reply a reply.

🤦🏾‍♂️🤦🏾‍♂️
[6/9, 10:52] MTN: They adopt all the arguments canvassed in the addresses and with specific reference to the latest written address.

They drew the attention of the court to the case of Eketione v. INEC (2019).
[6/9, 10:52] MTN: Just Look at What We Are Giving Them

🔥🔥🔥🔥

If We Don’t Give

How Will They Take It? 😂😂
[6/9, 10:52] MTN: 4th Respondent:
They identified also, their documents, counter affidavits and written addresses opposing the motion by the Petitioners.

They further urged the court to dismiss the motion. He noted (sarcastically) that they will not be asking for cost if the case is dismissed.
[6/9, 10:52] MTN: So right now the court is talking about adopting one of motion filed by Labour Party.

Justice Tsammani: We will definitely need to give a ruling on this.

SAN Ikwueto: My lord we want to move on with the witnesses
We have another witness to squeeze in

Justice Tsammani: Hope it’s not an ex-corper 😅😂😅

‘Remember that the 2 PDP witnesses today were ex-Corpers’
🤣🤣🤣

SAN Ikwueto looks lost.
My lord it’s not an ex-corper

APC: My lord he won’t understand, they were not here in the morning.

Justice Ugo: The case in the morning, they brought ex-Corpers so hope your witness is not another ex-corper
😂😂😂

Justice Tsammani: I told them that all of us are ex-Corpers
[6/9, 10:52] MTN: for those that want to read let me drop the full gbas
[6/9, 10:52] MTN: The motion argument was taking me to where I don’t know.🥵🥵🥵🥵
[6/9, 10:52] MTN: LP: Let me identify the applications filed by the petitioners. We filed a counter affidavit on the 25th of May in response to the one filed on the 22nd of May along with a written address. With respect to the most recent application, our counter was filed on the 5th of June. We also attached a written address to assist your Lordships and that was filed on the same day.
We respectfully adopt all the arguments canvassed in both addresses with specific respect to the latest written address, I wish to draw your Lordships to paragraph 4.13 where we quoted the brilliant exposition of my lord, right of the presiding Justice of this court. In the case of ….. 2019 decision of this court, I submit that as a result of this brilliant decision, my Lords should grant it. I’m respect of the second application, we want to draw to your attention one fact that the application was filed 26 days after the close of pleadings was when this was. There’s no prayer for extension of time. This application should be dismissed.
2nd & 3rd: My Lords in opposition to the 2 applications we filed our written address dated 5th June, 2023 on the same day. We humbly adopt the written address urging our noble Lords to dismiss the two applications.
I wish to make one or two points on the reply by the petitioners which was served on us yesterday. (Court rejects his attempt to reply)
(He goes on that fair hearing is not a magic wand to use to defeat what the law requires you to do).
Court: The pre-hearing was closed on the 22nd. You filed on the same day but the application doesn’t show and you agree that it wasn’t ripe for hearing?
LP: Yes
Court: You have cited fair hearing but it’s your duty to draw the attention of the court to the application, else the court can deem it as abandoned?
LP: Yes it is. We apologize my Lords
4th: we also filed a counter filed 7th of June. Deposed to by Emmanuel Okonsa along with a written address. We shall be praying your Lordships to dismiss the applications. We will not be asking for cost.
LP: I have no reply on points of Law.
Court: We reserve ruling either tomorrow or the day after.
LP: We indicated that we may call two witnesses today
Court: Is he also an ex-corper? (in reference to the earlier witness of PDP who disappeared?
(Court laughs)
LP: We still documents in front of us to tender. Was worried about Monday being a public holiday
Court: We can sit on public holidays
Lp: As the court pleases. Even though our subpoenaed witness is not in court now, we still have documents to tender.
Court: Just be courageous to make your applications
LP: My lords we wish to ask your Lordships for permission to tender just the EC40Gs
Court: We’ll we can give you sometime but we have to rise for 5 mins but sort out your documents so we don’t waste more time.
LP: As the court pleases.
(Court rises till 5pm)
[6/9, 10:52] MTN: Court Rises for 5 Mins Recess!!!
[6/9, 10:52] MTN: INEC didn’t know that people like Chinwo can sit anywhere in the world and summarize what is happening on IREV. Science will teach them a lesson in court this time.

My biggest concern in today’s hearing is that the judge also didn’t seem to understand what the witness was saying about AWS. They didn’t interrupt or say much. Even when LP lawyers objected to certain questions, it was if they didn’t know whether to overrule or sustain it. It’s common for people to behave that way when they don’t know what is being discussed, but I’m staying hopeful.

I hope the judges take time to understand the different processes discussed.

The recess is over.
[6/9, 10:52] MTN: The court is back

SAN Ikwueto is now up tendering the form EC40G for Bayelsa State quickly.
As usual, all the respondents have objected to it and stated they would give their reasons at the final address.
[6/9, 10:52] MTN: So the courtroom is currently sitting quietly while the secretary is with the Labour Party and Peter Obi’s lawyers checking documents.

There’s an error in the LGA presented and the judges are trying to sort out what schedule it was tendered on.

Justice Tsammani is not having it as he has been complaining about the documents tendered and arrangements of the schedules.

Justice Adah has also complained and they are putting all the schedules page by page to locate the missing LGA
[6/9, 10:52] MTN: As Usual, the Chorus is ‘Objection, we will give the reasons in our final address’

At this point, I think I may need to employ choirmasters and choirmistresses.

Applications are now open!
[6/9, 10:52] MTN: LP: My lord we just want to plead to continue

Justice Tsammani: So how many more witness

SAN Ikwueto: We had 1 more witness my lord but the witness is not the one we can keep to this time so we hope to have him earlier.

Justice Tsammani: So we can round up

APC: You are stressing everyone, you can just withdraw your petition
😒

LP: My lord we can continue with the forms EC40Gs my lord
Let’s just be quick because of Monday

Justice Tsammani: We are having proceedings on Saturday
It’s stated on the schedule
Even on Monday we are here

LP: Okay my lord, please let’s continue because of time.
My lord the time today as not been well utilized and there’s still time. THAT WAS THE REASON FOR THE BREAK OUR WITNESS NA BIG MAN HIM DON GO
[6/9, 10:52] MTN: Court was adjourned to tomorrow at 3pm.

What a day!

Phew!
[6/9, 10:52] MTN: Anthony Chinwo, the second witness from the LP legal team that just testified today, is the Vice President and Lead, Software Architecture and Engineering, at JP Morgan Chase, UK. So calm and composed that APC LT are rattled😹 no be road side witnesses ohhhh
