Issue: PRACTICE AND PROCEDURE – NOTICE OF APPEAL

Whether wrong description of case number/particulars of suit appealed against is a mere irregularity – Whether it affects the validity of a Notice of Appeal

Held:

The days when technicalities held sway in our justice system are long gone. Our courts are now firmly inclined towards doing substantial justice between the parties, as against technical justice.

See also: Umar v. FRN (2018) 12 S.C. (Pt. III) 104; Isah v. State (2017) 12 S.C. (Pt. VI) 22; Aigbobahi & Ors. v. Aifuwa & Ors. (2006) 2 S.C. (Pt. I) 82.

This position must continue. The focus must always be on achieving substantial justice, as this remains the only way to move society forward and entrench confidence in the judiciary.

The “fundamental defect” complained of was merely that the year of the charge before the trial court was written as “2018” instead of “2016”.

Notwithstanding this error, the Appellant fully participated in the proceedings before the court below. It filed and adopted its brief of argument, was not misled, did not complain at any stage, and suffered no miscarriage of justice.
After losing the appeal, the Appellant sought to challenge the competence of the appeal on the flimsy ground that the year of the charge was incorrectly stated.

Such a challenge falls squarely within the now ostracised category of technical arguments. It does not relate to the merits of the case and adds nothing meaningful to its resolution.

Accordingly, the Appellant’s arguments on this point are misconceived and unfounded.
