Rivers: Wike a colossal embarrassment to Body of Benchers – Falana

Senior Advocate of Nigeria, Femi Falana, has said Rivers State Governor, Nyesom Wike is an embarrassment to the Body of Benchers.

He said the Governor needs to be sanctioned by the Nigerian Bar Association, NBA.

Falana, SAN, in an interview with DAILY POST correspondent, said the development in Port Harcourt was very disturbing, stressing that Wike should not be allowed to continue to violate the 1999 Constitution of the Federal Republic of Nigeria (as amended).

The rights Lawyer also said the Executive Order relied upon by Governor Wike is an administrative instrument with guidelines and not a Law, adding that the Constitution supersedes the Governor’s order.

Falana added that any offender regardless of the crime committed should be charged before a Court and tried in line with the Law.

“It is unfortunate that these events are happening in Port Harcourt where the Governor of the State is Senior Lawyer and not just a lawyer, I’m even informed that he’s a member of the Body of Benchers; that is an embarrassment. A colossal embarrassment to the Nigerian Bar Association.

“Under our Law, an emergency situation under the Quarantine Act does not permit the demolition of a house by an alleged offender. Whoever has breached the Law will have to be tried and convicted by a Court of Law before a sentence can be pronounced.

“There is no provision for even the President to take the Law into his hands and then begin to mete out punishments to citizens without recourse to the constitution.

“We hope that the Governor will be properly advised to reverse his decisions, publicly apologise and restore the properties of those that have been destroyed. Everyone will have to go through a judicial process. That is what the rule of Law is all about.

“The guidelines and regulations in the Executive Order are subject to the Constitution. So, if there is a conflict in the guidelines, the directives of the Governor and the Constitution, his directives will bow to the Constitution.

“The right to property, fair hearing and liberty are constitutional rights. No Governor has the power to dismiss these rights under the pretext of enforcing the COVID-19 regulations.

“I expect the victims of his actions to take legal actions because I have seen the Executive Order of the Governor, there is no provision for demolishing properties. Only a court of Law can do that and that is after being found guilty. What is done in civilised places is for the Governor to obtain an order of interim forfeiture and then go through a trial.

“No Constitution allows a Governor to become the maker of a Law, accuser, witness, enforcer of the Law, the prosecutor and the Judge at the same time. It is primitive,” Falana said.

Meet the daughter of comic actor, Victor Osuagwu.

Up until now, not many of us knew that Nigerian comic veteran, Victor Osuagwu had such a stunning looking daughter, Angel.

Angel, a delightful young lady had recently taken to her Twitter page to share throwback photos of some of the funny characters her dad had played in movies — characters that most of us will be familiar with.

According to Angel, she stumbled on some of the photos while going through their family album and decided to share the photos on social media — in no time, the photos went viral as it left so many people nostalgic about the actor’s comical characters that made them laugh while growing up.

People took to replying the photos and telling Angel to thank her dad for making their childhood awesome with his comic movies — some called him a legend,, some said he’s underrated… all in all, a lot of people were elated to see the photos.

GOVERNMENT

Government is faceless, shows no emotions, and does not respond to sentiments. The ways and actions of Government passeth all understanding.
Its safer to avoid their actions. Because, somehow, they will execute their decisions.
My years in service tells me that once Govt had made a pronouncement, they will carry it out, without notice, if need be. Instances abound.
Was there any reason to destroy Odi in Bayelsa. But they did.
Govts don't see anything personal in their actions, decisions, and orders. If not Felas' Shrine in Lagos wouldn't have been destroyed.
Anyone, who had served in Govt, at any level, knows this to be a fact.

A PROTEGE OF MINISTER OF TRANSPORTATION IN NIGERIA REACT TO THE DEMOLITION OF A HOTEL BY GOV. WIKE.

RIVERS STATE IS NOT A BANANA REPUBLIC:

WIKE MUST CHECK THIS DESPOTIC TENDENCIES

Nothing has exposed Governor Nyesom Ezenwo Wike's despotic proclivity and lack of administrative tact like the corona virus pandemic. His primitive approach towards combating the deadly virus accentuates his flagrant disregard for rule of law, due process and human rights as it appears the pandemic has provided him a cover for unrestrained abuse of power.

Wike's actions since the outbreak of the pandemic, particularly in recent times, buttress the claims that he is utterly clueless, does not understand the full import of governance, and lacks a well-articulated strategy to combat the virus.

In recent times, we have seen Gov. Wike speak and act in ways that remind us of the era of military regimes where governance was administered by edicts/decrees. We see a Governor usurping the powers of the legislature and judiciary under the guise of expediency leaving both arms of government supine and ineffectual.

For Wike, Covid 19 offers a perfect excuse to disrespect traditional institutions, violate human rights, enforce his draconian orders and quarantine democracy. This reminds me of Marcus Tullius Cicero who once warned us to beware of the leader who sets aside constitutional rules claiming the need for expediency or security.

While lockdown is a good control measure against the spread of the virus, it loses its essence when badly enforced. One would expect that the Governor would take advantage of the lockdown to fumigate public places, ramp up testing and put up more effective measures to help combat the virus. Sadly, what we have is the pathetic situation of demolition of properties, auctioning of private vehicles, detention of persons on essential duties, overriding Federal/Presidential authorities with ignominy.

Obviously, Wike's claim of fighting an invisible enemy is deceptive and diversionary. The only fight we are seeing here in Rivers State is against Rivers people and not the virus. Lockdown should be protective and not punitive, but for Wike, it is an instrument of oppression, suppression, create further hunger and misery.

We must rise up as a people who are legitimately part of Rivers state and question where Wike derives the wide-ranging powers he is exercising arbitrarily against innocent citizens who carry out legitimate businesses in the State and pay taxes to the government. We can not continue to be victims of Wike's caprices. Governor Wike's decision to auction cars and demolish properties belonging to the same people he is constitutionally obligated to protect for merely breaking a lockdown order is unconstitutional, ultra vires and unpopular.

There is no better time than now to speak up against Wike's highhandedness before it mutates into a full blown authoritarianism or even full anarchy. He must be made to understand that Rivers state is not a conquered territory and its people are not slaves. They deserve to be treated with respect and protected by the government. The Federal Government of Nigeria also owe Rivers people full protection under our laws especially in view of the fragrant abuse of power by the Governor of Rivers State. A RIVERS STATE BORN LAWYER AND ALSO A PROTEGE OF THE MINISTER OF TRANSPORTATION IN NIGERIA REACT TO THE DEMOLITION OF HOTEL BY GOV. WIKE.

WHICH LAW EXACTLY WAS GOVERNOR WIKE ENFORCING?

Governor Ezenwo Nyesom Wike of Rivers State went to Eleme Local Government Area to demolish two Hotels on the unsubstantiated claim that the Hoteliers violated his Executive Order (Regulation) on lockdown. The Regulation was made pursuant to QUARANTINE ACT, 1926, Laws of the Federal Republic of Nigeria. The said Act expressly provides for punishment. Section 5 states thus: “Any person contravening any of the regulations made under this Act shall be liable to a fine of N200 or imprisonment for a term of six months or to both.” From where did the power of demolition emanate? Can Governor Wike by a mere Regulation, which is also inconsistent with the Regulations made by the President, override the express provision of an Act of the the National Assembly of Nigeria? What an affront?

The above is the maximum punishment prescribed by the same Act that the Governor relied upon to make his so called Regulations. The Governor constituted himself into the Prosecutor, the Judge and the Executor of the judgement. Yet, he says he is a lawyer, a Live Bencher, he has Attorney General of the State, he has very Senior Members of the Law Community as advisers. Unfortunately, this is what you get when a Governor has his friends, the spouses and children of his associates in charge of the judiciary in the State. He is very certain that nobody can get justice against him from any Court in Rivers State; no Judge dares give any judgement against him.

I must say that I have known Nyesom Wike for nearly thirty (30) years and I know his antecedents. As I said before, the Governor is bereft of any strategy or action plan on managing the pandemic in Rivers State, hence he is deliberately provoking the residents so they would react to his excesses. Once there is any slightest reaction, he would use that as subterfuge and excuse for his ineptitude and failure. Rivers State must be vigilant.

The Inspector General of Police must realize that he has a role to play in averting the foreseeable civil disobedience in the State. The IGP must rise to the occasion, by calling his men to Order. They must refrain from accompanying the Governor to execute such r**e on the Constitution of the Federal Republic of Nigeria and the Rule of Law. The Governor by his conduct is threatening the peace of the State and by implication, National Security and the Police are providing him backup. The IGP must hold any police officer who aids such blatant violation of the Constitution of Federal Republic of Nigeria accountable, that way the Governor would be put in check.

GOVERNOR WIKE ANNOUCES TEMPORARY LIFTING OF LOCKDOWN FOR RESIDENCE TO RESTOCK FOODSTUFFS AND MEDICINES

Rivers State Governor, Nyesom Ezenwo Wike has announced the temporary lifting of the total lockdown on Obio/Akpor and Port Harcourt Local Government Areas for two days only, with effect from Tuesday 12th May 2020.

Governor Wike made the announcement in a State-Wide broadcast on Sunday night. He said that the total lockdown will be lifted on Tuesday 12th May, 2020 and Wednesday, 13th May, 2020.

Governor Wike said that the lockdown will be reinstated on Thursday, 14th May, 2020.

He said: "Consequently, we have given due consideration to the propositions on the way forward by well-meaning citizens of the State, and after a cautious review of the situation, decided to implement a partial relaxation of the lockdown measures, to enable residents to have some fresh air and replenish their foodstuffs and medicines.

"To this end, I hereby announce the temporary lifting of the total lockdown on Obio/Akpor and Port Harcourt Local Governments Areas for two days only, with effect from Tuesday 12th May 2020.

"All shops, supermarkets, and malls can open to the public for Tuesday and Wednesday, 12 and 13 May 2020.

" Similarly, all hospitals and banks can also open and provide full services to the public;

"While oil and gas companies are required to submit the list of their staff on essential duties to Government, note that there is no ban on the lifting of petroleum products from depots and other receptacles.

"The total lockdown on Obio/Akpor and Port Harcourt Local Government Areas will be reinstated on Thursday 14th May 2020 and remain until further notice."

Governor Wike said all other established restrictions under the Executive Orders on social distancing are still in force.



He said: "Compulsory wearing of face mask or scarfs in vehicles and public places;



· closure of all land, sea and air borders and entry routes into the State; and



· closure of all open markets, including slaughters, hotels, guest houses, cinemas, bars and restaurants; and



· ban on gathering, including public burials, weddings, and religious gathering of more than 50 persons.Once again, thank you for your cooperation and understanding.

"Please note that our enemy is invisible. stay at home, maintain social distancing, wash your hands regularly and stay safe."

He said every measure the State Government has imposed was dictated by an assessment of the state's situation, the trend of transmission and the conviction that it was the right thing to do in the circumstance.

"As a Government, we are doing our utmost best, in the face of daunting challenges, to prevent COVID-19 from taking hold in Rivers State; to stop any possible community transmission of this disease before it is too late.



"And we shall continue on this trajectory because the alternative would spell a greater disaster for our State and our people.



"More so, when these are not arbitrary measures but fully prescribed and backed by the ordinary laws of our State, especially, Executive Orders numbers: 1 to 6.



"So far, all our measures and actions are not arbitrary but fully prescribed, guided and backed by the ordinary laws of our State, especially Executive Order numbers 1 to 6, which apply equally to all persons throughout the State. As a Government, we are obliged to enforce our laws, and in the present circumstance, we have done so without fear or favour," he said.

He added: "We equally made it loud and clear that in the fight against COVI/D-19 there would be no sacred cows; no double standards, and no sentiments of any kind, whether political, ethnic, religious, status, emotional or otherwise.



"In the last few days we have pursued with vigour and secured several convictions against those who intentional violated our COVID-19 containment laws in the same way others States are doing.



"The forfeited trucks to be auctioned by the Deputy Sherriff were not confiscated arbitrarily by the State Government, but by the orders of our Courts."

Governor Wike stated that the demolition of the two hotels in Eleme was done in line with extant laws.

He said: "Similarly, we acted against the hotelier because, apart from using the facility to jeopardize the lives of our citizens in violation of the extant law, the owner audaciously unleashed thugs lead by the Eleme Local Government Youth Leader of the Peoples Democratic Party and inflicted severe injuries on our task-force members who went to enforce the law against the continued operation of the hotel.



" As we speak, nobody knows the fate of the lives of most of the victims of that brazen and deadly attack given the severity of the head injuries they sustained.



:And so, we’ve done no wrong as all our actions were taken in good faith and justified by, under and within the purview of the Executive Orders, which have neither been challenged nor set aside by any competent court of law."

The Governor said he remains focused on protecting Rivers people.

He said: "Therefore, while we welcome genuine criticisms directed towards strengthening our intervention measures; it is no use joining issues with uninformed critics and social media legal practitioners who, blinded and prodded by sheer politics, bias and hatred, have opted to demonized and paint our lawful and responsible actions in bad light.



"Granted that we may not have totally achieved our targets, but we are convinced that, so far, the lockdown and the other measures have impacted greatly in containing and preventing the onslaught of the pandemic on Rivers State.



"We therefore thank the entire people of Rivers State for the overwhelming understanding you have shown even as you continue to endure the pains of the restrictions on your wellbeing and fundamental freedoms."
