High Court Strikes Out Suit Challenging Lokpobiri-Led IYC Leadership
There is celebration on within the Ijaw Youth Council, as the High Court of Rivers State has officially struck out a leadership challenge brought against the current Jonathan-led Executives of the Ijaw Youth Council Worldwide.
The High Court of Rivers State struck out Suit No. PHC/2318/CS/2023 filed by Dr. Tari Alaye Theophilus and 10 others against Sir Jonathan Lokpobiri Snr and 10 others. The suit sought to declare the claimants as the legitimate Executive Council of the Ijaw Youth Council (IYC) and to restrain the Lokpobiri-led leadership from functioning in that capacity.
However, counsel to the defendants, Ebilade Obiri, Esq., filed a preliminary objection, arguing that the court lacked jurisdiction to entertain the matter. He pointed out that the disputed IYC election took place in Bayelsa State, not Rivers State, and therefore fell outside the territorial jurisdiction of the court. He also noted that the claimants failed to state any venue for their supposed election, while the defendants provided documentary evidence that the election was held at the Gabriel Okara Cultural Centre in Yenagoa, Bayelsa State.
In addition, Mr. Obiri highlighted in his submissions that none of the four Eastern Zone officers listed among the claimants reside in Rivers State. The court, in its ruling, agreed with the argument and found that the claimants’ Statement of Claim did not establish a valid basis for the Rivers State High Court to assume jurisdiction over the dispute.
The case was accordingly struck out, and there was no order as to costs. The ruling is a major legal victory for the Jonathan Lokpobiri-led Executive, putting to rest the ongoing leadership tussle within the Ijaw Youth Council and reaffirming their legitimacy.
