*ITA ENANG vs AKAN UDOFIA: COURT RULING ON JOINDER INCONSEQUENTIAL*- SAN

Foremost Constitutional Lawyer and Senior Advocate of Nigeria, Oloyede Clement SAN has described today's ruling by Justice Nwite of the Federal High Court Abuja, granting leave to Senator Ita Enang to join the case filed by Obong Akan Udofia against INEC, as a non issue and a mere academic exercise because the subject matter of the ruling is already pending before the Court of Appeal.

Speaking to newsmen in Abuja, the learned Senior Advocate stated that the ruling on Joinder was just a mere "academic exercise" as the judgement delivered by Justice A. A Okeke of the Federal High Court in Uyo had earlier nullified the Akwa Ibom APC Governorship primaries and ordered a fresh Primaries within 14 days.

He stated that the effect of such nullification is that both parties have been stripped off the candidacy and legal basis to ground any application for an order to compel INEC to publish names and particulars pending the determination of the Appeal filed by Akan Udofia.

"The matter is already before the Court of Appeal which is higher than the Federal High Court hence any interlocutory ruling by the lower court on same subject matter is a non issue and a mere academic exercise which has no consequence or effect in law" He said.

He further stated that it was only a routine practice for high Court judges to deliver rulings on interlocutory applications already pending before it but such are subject to any decisions of the Court of Appeal.

In his reaction, APC Chieftain Aloysius Edet stated that the party is not fazed by any distractions but stands solidly behind the outcome of the May 26th 2022 Governorship Primaries in Akwa Ibom State wherein Obong Akan Udofia duly emerged winner and APC flag bearer for the 2023 General Elections.
