Negros Power Nag-umpisa na sa Rehabilitasyon

Gin-umpisahan na sang Negros Electric and Power Corporation (Negros Power) ang pagaptigayon sang ila 5-year rehabilitation and modernization plan para sa mga pasilidad nga ila ginsubli gikan sa Central Negros Electric Cooperative (CENECO).

Ini matapos tagaan sang Energy Regulatory Commission sang Provisional Authority para sa Certificate of Public Convenience and Necessity ang Negros Power.

Nagakahulugan nga mahimo na makapadayon ang Negros Power sa pag manihar, pag mentenar kag pag operate sang electric power distribution sa Central Negros base sa iya prangkisa.

Sang nagligad nga Sabado kag Dominggo, gilayon nag nagpatigayon sang rehabilitasyon sa Reclamation kag Asdez-Gonzaga substations sa Bacolod City ang Negros Power.

Ang ini nga mga substations ang yara na sa kritikal nga kundisyon bangud sa kadugayon kag masami nga pag gamit diri. Gani kinahanglan na sang overhaul sa ila power transformers.

Suno kay Negros Power President and Chief Executive Officer Roel Castro, pito sa 12 ka mga power transformers sa franchise area ang naglapaw na sa 25 anyos nga kabuhi para sa maayos nga operasyon. Gani nagakinahanglan sang rehabilitasyon.

"We cannot waste more time. We need to implement the rehabilitation now. The aging transformers have started to show signs of deterioration, such as oil leakage, indicating a high risk of malfunctioning, like the recent incident at the Alijis substation on August 21," pahayag ni Castro.

"Ten to twelve hours of scheduled power interruptions are necessary to facilitate the rehabilitation and preventive maintenance works; thus, we need your understanding and cooperation. We empathize with the inconvenience that it will cause our consumers. However, this will prevent unscheduled, longer, and wider blackouts that none of us want to experience," paathag ni Castro.

BUSINESS: Court orders ‘Yanson 4’ to surrender titles, docs

The Cebu City Court of Appeals (CA) ordered the four Yanson siblings of Ceres Transport to surrender several titles and documents deemed by the lower court as essential evidence in a criminal case.

On July 30, 2024, the 20th Division of the Court of Appeals, amended a decision ordering Roy Yanson, Ma. Lourdes Celina Y. Lopez, Ricardo V. Yanson Jr., and Emily V. Yanson, or the "Yanson 4," to surrender certificates of title and related documents they previously admitted to be in their possession.

The Yanson 4 tried to take over Vallacar Transit Inc. (VTI) in 2019. The court's amended decision grants the petition for certiorari filed by the VTI management led by president and chief executive officer (CEO) Leo Rey V. Yanson and corporate secretary Olivia V. Yanson, the matriarch of the Yanson Group.

The CA directed the Yanson 4 to submit to the custody of the trial court various original and certified true copies of certificates of title and related documents admitted to be in their possession.

"The court a quo is directed to identify the subject documents to be surrendered as indicated in the information and as identified by the prosecutor in Criminal Case No. 20-52097, and in the private respondents' letter addressed to the register of deeds, and in their comment to the DOJ," according to the amended decision.

The amended order was directed to Yanson 4, along with Judge Ana Celester P. Bernad, presiding judge of the Regional Trial Court Branch 44 in Bacolod City, Vallacar Transit Inc. and Hernan B. Omecillo.

Judge Bernad previously denied the urgent motion to order the four Yanson siblings to surrender the documents they seized from VTI in 2019. The judge also denied the motion for reconsideration of the case.

The items include original certificates of title of the Yanson Group of Bus Companies' properties and those registered under the name of the Yanson family as well as supporting documents such as tax declarations, vicinity maps, deeds of sale, and memorandum of agreements, among others.

Court records showed that on June 9, 2020, the acting Bacolod City prosecutor accused Yanson 4 of the crime of qualified theft, which is penalized under Article 310 concerning Article 308 of the Revised Penal Code.

As charged in the prosecutor's information, the respondents, representing themselves as the new officers of VTI, took and carried away various items, including important documents to which they had access because of their fiduciary capacity in the company.

In its amended decision, the CA dispelled the notion that the purpose for placing the subject documents under custodia legis is to ensure the provision or preservation of evidence for the benefit of the petitioner in the prosecution of Criminal Case No. 20-52098 for qualified theft (main case).

"To clarify, it is meant as an ancillary measure to secure the effective adjudication and enforcement of the rights of all the parties, once the main case has run its proper course," the CA said. "Ours was a grant of provisional relief to preserve the status quo, until such time that the merits of the main case can be heard by the trial court."

The CA said that having voluntarily admitted possession of the subject documents not just in official correspondence but also in filings related to the main case, such as their comment and several other pleadings, the Yanson 4 could not claim that the directive to surrender these documents to the court a quo for safekeeping violates their right against self-incrimination.

"Our assailed decision simply directed respondents Yanson to surrender the subject documents, as indicated in the information and admitted in their letter to the register of deeds and comment to the DOJ, to the trial court in order to place these in custodia legis. Such relief being ancillary to the main case, the parties can flesh out a list of the subject documents with the court a quo, submitting any other supporting documents as the latter may require,” it said.

“In fine, while the parties herein have presented no new and convincing documents which would justify a modification or reversal of our assailed decision, we deem it best to amend the same in order to include a corresponding directive for the court a quo," the appellate court said.

The Bacolod-based Yanson Group, whose units ply across Luzon, Visayas, and
Mindanao operates a fleet of over 4,000 buses with more than 18,000 employees
across the country.

PBBM Approves Franchise for Negros Power

President Ferdinand Marcos Jr. has approved the franchise for Negros Electric and Power Corporation (NEPC) to manage and operate the electricity distribution system in Central Negros, guaranteeing continuous and uninterrupted electricity supply across the franchise area.

The President signed Republic Act Number 12011 on July 26, 2024, just a day before it would have lapsed into law. This legislation will come into effect fifteen days after publication in the Official Gazette or a newspaper of general circulation.

The bill originated in the House of Representatives and was introduced by Negrense Representatives Stephen Paduano, Jose Francisco Benitez, Juliet Marie Ferrer, and Greg Gasataya. It was approved by the House on February 21, 2024, amended by the Senate on May 20, 2024, and further concurred by the House on May 22, 2024, before being forwarded to the Office of the President.

NEPC, also known as Negros Power, is a joint venture company between Primelectric Holdings Inc. (PHI) and Central Negros Electric Cooperative (CENECO), established to enhance power distribution and customer service for over 220 thousand active accounts in the cities of Bacolod, Bago, Talisay, Silay, and municipalities of Murcia, and Don Salvador Benedicto.

Within the agreement, PHI will acquire all power distribution assets of CENECO valued at over two billion pesos, with 70% in cash and the remaining 30% as CENECO's share in NEPC.

The National Electrification Administration (NEA) endorsed CENECO's decision while instructing priority on loan repayments, and employee retirement and separation benefits payments outlined in their Collective Bargaining Agreements.

Negros Power has confirmed the employment of over 200 CENECO employees.

Negros Power and MORE Power have augmented CENECO and jointly conducted preventive maintenance activities, and responded to trouble calls from consumers.

Negros Power also prepared their offices, materials, and equipment needed in anticipation of their upcoming operation this August to ensure a smooth transition.

Expressing gratitude to the President, legislators, consumers, and local leaders in Central Negros for their support, Negros Power President and CEO Roel Castro emphasized the company's dedication to improving electric service and fulfilling promises to consumers.

"We are grateful that our leaders and everyone are supporting this initiative to improve electric service for consumers. We now have the law, it's time to walk the talk, and we are ready to serve and fulfill our promises to the consumers of Central Negros," Castro said.

Negros Power has allocated an initial capital of Two Billion pesos for a five-year plan to rehabilitate and modernize the electric infrastructure, aiming to establish a robust distribution system.

Castro urged ongoing support and collaboration for the planned five-year rehabilitation journey to improve the system and reduce incidents of unscheduled power outages.

"We seek your continued support and cooperation as we commence the five-year journey of continuous rehabilitation to enhance the system and minimize instances of unscheduled power interruptions." he added.

Negros Power will then apply for a Certificate of Public Convenience and Necessity (CPCN) from the Energy Regulatory Commission (ERC) to commence official operations.
