Supreme Court Fines School for Negligence in Student Punching Incident

MANILA, Philippines - The Supreme Court (SC) has ordered Mother Goose Special School System, Inc. in Pangasinan to pay P650,000 in damages and attorney's fees for its negligence in handling a punching incident that occurred in 2007 involving three of its grade school students.

The case stemmed from an incident during a computer class where two students repeatedly punched a classmate while the teacher was briefly out of the room. Despite the victim reporting the attack, the school administration dismissed it as mere "teasing" or "rough play" and failed to conduct a proper investigation or impose disciplinary measures.

In a decision penned by Associate Justice Mario V. Lopez, the SC's Second Division affirmed the rulings of the lower courts, emphasizing that schools have a contractual obligation to provide and maintain a safe learning environment for their students. The court found Mother Goose School negligent due to its lack of proper protocols in addressing such incidents, failure to promptly inform the victim's parents, and inaccurate handling of the investigation.

The Supreme Court clarified that while the incident could be considered bullying in a general sense, it was not governed by the Anti-Bullying Act of 2013, which was not yet in effect at the time. The liability of the school was based on culpa contractual (negligence in the performance of a pre-existing obligation).
The awarded amount of P650,000 covers moral damages, exemplary damages, and attorney's fees for the victim's parents. The SC stressed that parents who entrust their children to schools do so with the assurance that the institution will protect them from harm and address incidents promptly.
This ruling serves as a reminder to schools of their responsibility to ensure the safety and well-being of their students and to have proper mechanisms in place to address incidents of harm.
