MAGTIAYONG 5 KATUIG NG BULAG MAMAHIMO NG MAGDIVORCE HUMAN NAAPRUBAHAN SA IKATULO UG ULAHING READING SA KAMARA GANINA
Giaprubahan na kaganina sa House of Representatives ang House Bill 9349 kon Absolute Divorce bill nga nakabaton og 126 nga pabor nga boto, 109 ang negative ug 20 ang abstain.
Sa nahimong probisyon sa maong sugyot balaudnon, gipanigurong ipailawom gayod sa judicial process ang divorce petition aron masiguro nga dunay saktong basehan og angay gayod nga magdivorce ang magtiayon.
Gipaniguro sab nga dunay cooling-off period sulod sa 60 ka adlaw aron nga tarungon ang managlahig bahin sa magtiayon.
Gani, sa higayon nga makasinabot ug magbalikanay ang magtiayon samtang nagpadayon ang divorce proceeding, mamahimong ibasura ang petisyon aron magsumite og joint manifestation sa korte.
Samtang sa higayon nga naipakanaog na ang divorce decree, apan nagbalikanay ang magtiayon, mawad-an matud pa og gahom ang divorce decree ug mamahimo ng maguban balik ang magtiayon nga di na kinahanglan pa nga magpakasal.
Lakip sa mamahimong basehan kon grounds sa divorce bill, ilawom sa Article 55 sa Family Code of the Philippines mao ang musunod:
• Physical violence or grossly abusive conduct directed against the petitioner, a common child, or a child of the petitioner;
• Physical violence or moral pressure to compel the petitioner to change religious or political affiliation;
• Attempt of respondent to corrupt or induce the petitioner, a common child, or a child of the petitioner, to engage in prostitution;
• Final judgment sentencing the respondent to imprisonment of more than 6 years;
• Drug addiction, habitual alcoholism, or chronic gambling;
• Homosexuality of the respondent;
• Contracting by the respondent of a subsequent bigamous marriage;
• Marital infidelity or perversion or having a child with another person other than one’s spouse during the marriage;
• Attempt by the respondent against the life of the petitioner, a common child, or a child of the petitioner; and
• Abandonment of petitioner by respondent without justifiable cause for more than one year
Mamahimo sab gamiton isip basehan kon grounds sa annulment of marriage ilawom sa Article 45 sa Family Code og 5 na katuig bulag ang magtiayon, psychological incapacity ilawom sa Article 36 sa Family Code; irreconcilable differences ug domestic o marital abuse subay sa Violence Against Women and Their Children Act of 2004.
