🚨 PUBLIC ANNOUNCEMENT: BLOCKED CITY-OWNED ROADS IN CASAL’S VILLAGE 🚨

1. All road lots within Casal’s Village are public property, officially donated to the City Government of Cebu in 1980 via a Deed of Donation and formally accepted by the city.

2. The City Government maintains all the roads, drainage, and streetlights in Casal’s Village, affirming its ownership and public function.

3. The Sangguniang Panglungsod of Cebu has not enacted any ordinance authorizing Casal’s Village to close, obstruct, or control any of these public roads. (Ref: Section 21, Republic Act 7160 – Local Government Code)

4. A Technical Report by the Department of Engineering and Public Works (DEPW) confirms that these roads are fully constructed and were originally designed to connect with surrounding service roads. However, several access points have been illegally blocked with fences and barriers.

5. The Office of the Building Official (OBO) has verified that these fences and cement barriers were built without permits, in violation of the National Building Code.

6. Legal opinions from the Cebu City Legal Office conclude that these structures are “nuisance per se” — illegal obstructions that impair public use of city property.

7. Clearing Orders were officially issued by Mayor Michael Rama and Mayor Raymond Alvin Garcia, in line with City Ordinance No. 1481 and DILG Memorandum Circulars, directing the removal of the illegal obstructions.

8. The PROBE Team served 10-day notices to the responsible parties. These notices have long expired without compliance.

🚧 These unauthorized structures continue to block public access and worsen traffic conditions in surrounding areas.

⚠️ The public is urged to remain vigilant and support the proper enforcement of laws protecting public roads and open access.

The Cebu City Government has ordered the closure of a 1,000 square meter public lot located in CASAL’S VILLAGE due to unauthorized use.

🔎 Summary of Findings:

1. The public lot has been utilized as a basketball court rental facility, and a three-storey structure is under construction without a building permit.

2. The Sangguniang Panlungsod has not granted authority for the Casals Village Homeowners Association (CVHA) to use this city-owned property.

3. CVHA has no valid business permit and has been charging rental fees for the use of the court.

4. Receipts issued for transactions are not officially registered.

5. There are no records of rental payments, real estate taxes, income taxes, or VAT remittances for the use of the lot.

6. The ongoing construction was initiated without going through the Office of the Building Official (OBO), which is required by law to ensure public safety.

7. A Show Cause Order was issued by the Business Permit and Licensing Office (BPLO) on August 20, 2024, followed by a Cease and Desist Order on December 9, 2024. Despite this, use of the lot has reportedly continued.

⚠️ Structures built without permits are considered non-compliant and may pose safety risks to the community.

The President of Casal's Village Homeowners Association, Engr. Ernesto Giduquio, has acknowledged the rates being collected for the use of the basketball court located on a city-owned lot in Casal’s Village.

It is important to note that the use of this public property has been stopped/closed due to the absence of necessary permits and official authorization from the Cebu City Government.

The area has been subject to a Cease and Desist Order issued by the Business Permit and Licensing Office (BPLO) for non-compliance with legal and regulatory requirements.

FACTS:
1. A 1,000 sqm City Owned Lot is being used by Casals Village Homeowners Association - CVHA as a basketball court rental facility and a three (3) storey structure is being built with NO BUILDING PERMIT.

2. Cebu City Sangguniang Panlungsod has not issued authority to CVHA for the use of the public lot.

3. CVHA has No Business Permit but is leasing the basketball court at a price.

4. CVHA is Issuing unregistered receipts for court rentals.

5. CVHA has not paid rent, real estate tax, income tax, property tax, vat, etc.
No BIR/Tax payments ever.

6. CVHA is building a 3storey structure on the public lot without a building permit, aimed to be leased out to the public.

7. CVHA has not gone through the proper steps of construction such as securing a building permit from OBO, this only means that the structure is deemed illegal and highly unsafe.

8. The Business Permit & Licensing Office (BPLO) has issued a Show Cause Order to CVHA last August 20, 2024 and served a cease-and-desist order to CVHA last December 09, 2024, yet, CVHA continues to impose their unlawful control of said PUBLIC LOT.

To conclude, the board members of Casals Village have continuously incurred income from a government owned lot, with No authority, No business permit and No building permit, TAX FREE!!

TODAY: JUNE 21, 2023, Cebu City Transportation Office (CCTO) executed their first clamping operations inside Casal’s Village, Mabolo, Cebu. It has been established that all roads inside the subdivision have been donated to and maintained by the City Government of Cebu. Street lights, drainage maintenance and garbage collection expenses are also shouldered by the City of Cebu.

It has been further confirmed by the Office Of The Building Official that Casal’s Village did not secure a building permit for both their guardhouses. Casal’s Village has also sealed off two public roads with cement barriers without a fencing permit, namely, New Frontier and Sindulan Streets.
