🚨 PUBLIC ANNOUNCEMENT: BLOCKED CITY-OWNED ROADS IN CASAL’S VILLAGE 🚨
1. All road lots within Casal’s Village are public property, officially donated to the City Government of Cebu in 1980 via a Deed of Donation and formally accepted by the city.
2. The City Government maintains all the roads, drainage, and streetlights in Casal’s Village, affirming its ownership and public function.
3. The Sangguniang Panglungsod of Cebu has not enacted any ordinance authorizing Casal’s Village to close, obstruct, or control any of these public roads. (Ref: Section 21, Republic Act 7160 – Local Government Code)
4. A Technical Report by the Department of Engineering and Public Works (DEPW) confirms that these roads are fully constructed and were originally designed to connect with surrounding service roads. However, several access points have been illegally blocked with fences and barriers.
5. The Office of the Building Official (OBO) has verified that these fences and cement barriers were built without permits, in violation of the National Building Code.
6. Legal opinions from the Cebu City Legal Office conclude that these structures are “nuisance per se” — illegal obstructions that impair public use of city property.
7. Clearing Orders were officially issued by Mayor Michael Rama and Mayor Raymond Alvin Garcia, in line with City Ordinance No. 1481 and DILG Memorandum Circulars, directing the removal of the illegal obstructions.
8. The PROBE Team served 10-day notices to the responsible parties. These notices have long expired without compliance.
🚧 These unauthorized structures continue to block public access and worsen traffic conditions in surrounding areas.
