RESIGNATION

Resignation is a common part of employment, but itโ€™s essential for employees to understand their rights and responsibilities under the Philippine Labor Code. This Q&A guide provides clear answers to frequently asked questions about the resignation process to help ensure a smooth transition for both employees and employers.

What is the legal basis for an employeeโ€™s resignation from a company?

The legal basis for resignation is outlined in Article 300 of the Labor Code of the Philippines. This provision allows an employee to terminate their employment without just cause by serving a written notice to their employer.

How much notice must an employee provide before resigning?

An employee is required to provide at least 30 days' written notice before their intended last day of work. This notice period gives employers sufficient time to make necessary arrangements, such as finding a replacement.

Are there exceptions to the 30-day notice requirement?

Yes, an employee may resign immediately without serving the 30-day notice under valid grounds. These include:
โ€ข Serious insult or inhuman treatment by the employer or their representatives.
โ€ข Commission of a crime or an offense against the employee or their immediate family members.
โ€ข Other similar reasons that render continued employment unreasonable.

What happens if an employee fails to provide the required notice?

If an employee does not provide the required notice period, the employer may:
โ€ข Hold the employee liable for damages caused by the insufficient notice.
โ€ข Deduct any corresponding penalties or liabilities from the employeeโ€™s final pay, as provided under the Labor Code.

Can an employer waive the 30-day notice period?

Yes, an employer may waive the 30-day notice period at their discretion. In cases of highly technical or critical positions, the employer may request a longer notice period if specified in the employment contract or company policies.

Are employees entitled to separation pay if they resign?

Generally, employees who voluntarily resign are not entitled to separation pay, unless:
โ€ข It is explicitly stated in the employment contract or collective bargaining agreement (CBA).
โ€ข It is established as part of the companyโ€™s policies.

However, separation pay may still be granted in cases of mutual agreement or as a goodwill gesture by the employer.
