Oo, pwede po kayong humingi ng suporta para sa mga anak kahit hindi po kayo kasal at hindi nakaapelido sa ama. May legal na batayan ito sa Family Code ng Pilipinas at iba pang batas.

Family Code of the Philippines

• Article 195: Ang mga magulang, kahit hindi kasal, ay may obligasyong magbigay ng suporta sa kanilang mga anak, legitimate man o illegitimate.

• Article 194: Ang suporta ay tumutukoy sa lahat ng kailangan para sa:

• Pagkain
• Tirahan
• Damit
• Medikal na pangangalaga
• Edukasyon (lalo na kung papasok na sa high school o kolehiyo)
• Transportasyon

• Article 201: Ang halaga ng suporta ay base sa kakayahan ng magulang at pangangailangan ng anak.

• Article 203: Ang obligasyon ay nagsisimula kapag may demand, judicial o extrajudicial. Hindi ito retroactive maliban kung may kasunduan o utos ng korte A.

Kahit Hindi Kasal

• Ang pagiging illegitimate ng bata (hindi kasal ang mga magulang) ay hindi hadlang sa karapatang tumanggap ng suporta. Basta’t napatunayan na siya ay anak ng ama, may obligasyon ang ama na magbigay ng suporta B.

RA 9262 – Anti-Violence Against Women and Their Children Act

• Ang hindi pagbibigay ng suporta ay maaaring ituring na economic abuse. Maaaring humingi ng Protection Order na mag-utos sa ama na magbigay ng suporta, at may kaakibat itong parusa kung hindi susunod.

RA 11861 – Expanded Solo Parents Welfare Act

• Maaaring humingi ng tulong sa DSWD para sa paghabol ng child support. May mga programa na tumutulong sa mga solo parent para maipaglaban ang karapatan ng anak sa suporta.
