Information about RELEASE LETTER under the new legislation
Under OUG 32/2026, there is indeed a new restriction related to changing employers for foreign workers.
The new law generally states that:
a foreign worker cannot initiate a change of employer during the first 6 months from the date the work activity started and was registered in REGES-ONLINE.
However, the law also introduced an important exception:
the worker may request a change earlier than 6 months in properly justified situations involving serious violations by the employer of the employment contract or labor relationship.
So, practically:
before 6 months → changing employer is generally restricted unless there is employer abuse/serious violations;
after 6 months → changing employer becomes easier legally, although certain categories may still need involvement from the placement agency depending on how they entered Romania.
The law itself does not literally create a “government release letter.”
What people often call a “release paper” or “NOC” is usually:
employer consent,
termination documents,
or documents required in practice by immigration/labor authorities for transfer procedures.
In cases of:
unpaid salary,
excessive working hours,
abuse,
illegal conditions,
the Labor Inspectorate (ITM) involvement may help support an earlier employer change under the “serious violation” exception.
