Does the 𝗔𝗟𝗧𝗘𝗥 𝗘𝗚𝗢 𝗗𝗢𝗖𝗧𝗥𝗜𝗡𝗘 not apply to the PCAB licensing process?
In summary, ang ibig sabihin po ng doctrine na yan ay 𝗮𝗻𝗴 𝗯𝗮𝗴𝗼 𝗮𝘁 𝗹𝘂𝗺𝗮𝗻𝗴 𝗰𝗼𝗿𝗽𝗼𝗿𝗮𝘁𝗶𝗼𝗻 𝗮𝘆 𝗰𝗼𝗻𝘀𝗶𝗱𝗲𝗿𝗲𝗱 𝗻𝗴 𝗯𝗮𝘁𝗮𝘀 𝗻𝗮𝘁𝗶𝗻 𝗮𝘀 𝗼𝗻𝗲 𝗮𝗻𝗱 𝘁𝗵𝗲 𝘀𝗮𝗺𝗲 𝗶𝗻 𝗰𝗲𝗿𝘁𝗮𝗶𝗻 𝗰𝗮𝘀𝗲𝘀. Example, in a situation kung saan may ginawang kalokohan ang isang corporation tapos na penalize sila, at para makatakas sa liability ay gagawa lang ng bagong corporation para makapatuloy pa rin sa transactions nila.
I am asking this question based on the answers of PCAB in the Senate Blue Ribbon Hearing on Ghost Flood Control projects yesterday, 1 September 2025.
From my point of view, if this doctrine was applied, hindi sana nakalusot yung mga already blacklisted corporations sa pagkuha ng bagong PCAB license sa mga bagong companies nila.
The reason why I am emphasizing this is because yung mga contractors na nakakuha ng bagong PCAB license ay among those named by the Senate Hearing and PBBM as having ghost and/or substandard flood control projects. Thus, kung na-monitor sana ng maayos sa licensing level pa lang, eh di naiwasan sana natin yung bigger issue ng ghost and/or substandard flood control projects.
Lastly, if this doctrine is not applicable to the PCAB licensing process, then this is most likely the best time to amend or enact a new law related to this issue. Hope our Legislators gets a chance to see this post.
