After two days of proceedings disrupted by inclement weather during Week 7, former Office of the Vice President (OVP) special disbursing officer Gina Acosta is set to return to the witness stand last Monday, Aug. 24, as the impeachment court resumes the 17th day of Vice President Sara Duterte’s impeachment trial.

Acosta, who has been declared a hostile witness, is expected to continue direct examination from the House prosecution over the alleged handling and disbursement of the OVP’s confidential funds.

Senator-judge Erwin Tulfo on Monday raised doubts on hostile witness Gina Acosta's supposed difficulty with speaking in Filipino or English at the Senate impeachment trial of Vice President Sara Duterte.

Acosta, former Office of the Vice President special disbursing officer and currently a member of its staff, answered questions in Bisaya on Monday morning, prompting the Senate impeachment court to try to look for a translator.

Prosecution counsel Amando Virgil Ligutan tried to translate for Acosta and for the court.

But Tulfo said he had checked the transcription of the 2024 House Committee on Good Government and Public Accountability hearings where, he said, Acosta did not have a problem responding in Filipino.

Describing the seeming language barrier as "deception", Tulfo asked the court to compel Acosta to respond in Filipino.

"I know Ms. Witness you can understand Tagalog, you can speak Tagalog dahil nandito po ito ilang pahina po ito (because there are several pages of this)," he said, holding up a transcript of the 2024 House hearing.

He noted Acosta had also responded in English to questions asked in English.

"Bakit ngayon parang hirap na hirap, kailangan i-translate sa Tagalog sa Bisaya [ang] sagot …Aabutin ho tayo ng isang taon dito, Mr. President," Tulfo said.

Apart from defending Vice President Sara Duterte, Kristine Ferrer had another tough job: Going head-to-head with titan Lorna Kapunan.

Ferrer was the assigned defense lawyer to cross-examine Commission on Audit’s (COA) Xylene del Campo on Wednesday, August 12.

The Senate impeachment court got heated on Wednesday, particularly between the defense and prosecution, with private prosecutor Lorna Kapunan even claiming in jest that she is holding herself from “spanking” her counterpart counsel.

The heated exchange between both parties occurred in the defense’s cross-examination of Commission on Audit Intelligence and Confidential Funds Audit Office (COA-ICFAO) state auditor Xylene del Campo during the 15th day of Vice President Sara Duterte’s impeachment trial.

Fruit salad” ang naisip ni House prosecution counsel Lorna Kapunan habang sinusuri ang ilang acknowledgment receipts (ARs) na iniharap sa impeachment trial ni Vice President Sara Duterte dahil sa mga kakaibang pangalang nakalista sa mga dokumento.

Ayon kay Kapunan, tila sapat umano ang mga pangalang may kaugnayan sa pagkain at prutas na nakalagay sa mga dokumento para makagawa ng “fruit salad.”

“Gumawa ata ng fruit salad ito… may Kamote, may Mangga, may Keso,” biro ni Kapunan habang tinatalakay ng prosecution ang mga acknowledgment receipt.

Naging sentro ng pagtatanong ng mga prosecutor ang kredibilidad ng ilang ARs na ginamit upang suportahan ang mga pinagkagastusan ng Office of the Vice President sa confidential funds.

Vice President Sara Duterte and Palace Press Officer Undersecretary Atty. Claire Castro once again exchanged heated words, this time over demonstrating professionalism as high-ranking government officials.

In a video message on Friday, Castro claimed that it is Duterte who lacks professionalism and public accountability.

"Ang tunay na professional ay nakikita sa gawa at hindi sa salita lamang. Ang isang lider na professional ay nananatili sa bansa upang mamuno lalung-lalo na sa oras ng kalamidad, sumusunod sa batas at hindi gumagamit ng dahas, at humaharap sa mga akusasyon gamit ang malinaw na ebidensya sa halip na pag---iwas o paninira sa administrasyon, tumutulong sa pag-unlad at hindi nagiging dahilan ng pagbagsak ng pamahalaan," Castro said.

Castro was reacting to Duterte's remarks in an interview on Thursday, wherein the Palace official was urged by the Vice President to demonstrate professionalism when delivering public statements.

This came after Castro slammed the Vice President for saying that President Ferdinand "Bongbong" Marcos Jr. is supporting the International Criminal Court (ICC) and vice versa, amid the detention of her father, former president Rodrigo Duterte, for charges of crimes against humanity.

According to Castro, Sara Duterte's claims are "useless, baseless, and nonsense."

Sen. Raffy Tulfo and Sen. Pia Cayetano on Tuesday exchanged words over the incomplete memberships in the Senate committees, which he said were getting in the way of legislation.

Towards the end of the Senate session, Tulfo rose on a point of order and said that Senate Minority Leader Alan Peter Cayetano’s “inaction” on the committee memberships of the minority senators was holding hostage pending legislation.

He said that he has coordinated over the past few weeks with Senate Majority Leader Juan Miguel Zubiri regarding the election of senators to the memberships of the Committee on Public Services and the Committee on Migrant Workers.

Senate rules require committee memberships to be completed before the panels can fully conduct their work.

Tulfo said the vacancies in the Public Services and Migrant Workers committees were delaying bills assigned to the panels, including the proposed Department of Water and OFW reintegration measures.

Senator-judge Imee Marcos showed annoyance over how Roderick Wamil, former state auditor for confidential funds, responded to the question of who should be considered accountable for confidential funds.

Wamil continued his testimony on Wednesday, day 13 of the impeachment trial, on the use of confidential funds by the Office of the Vice President and Department of Education under Sara Duterte as secretary.

Saying Vice President Sara Duterte is not the payee, and there’s nothing that says the money is with her, Marcos asked whether the Special Disbursing Officer is the accountable officer.

Wamil answered that the head of the agency, alluding to Duterte, is also responsible.

Marcos argued that Joint Circular 2015-01 on the use of confidential funds says that the accountable officer is the head of the agency or the person designated.

Wamil disagreed, saying: “That is not entirely correct, You Honor, because under the Joint Circular, it shall be the responsibility of the head of the agency, first, to approve the cash advance; second, to oversee the agency-wide utilization.”

“Mag-yes or no ka lang. Kanina ka pa, inaaway mo ako lagi (Just answer yes or no. You’ve always been at it, you’re always quarreling with me),” Marcos retorted.
