ONE OF THE FEW
To some prosecutors, securing convictions of accused charged with generic crimes (theft, robbery, estafa etc.) is just an ordinary part of their job.
But not when the conviction pertains to crimes which are rarely filed and prosecuted. To be more specific, I prosecuted a criminal case for violation of the Anti-Photo and Video Voyeurism Act (RA 9995). The accused was caught taking video of the victim while taking a bath.
I presented only three witnesses. I was able to prove the elements of the offense.
Here, the trial court imposed a penalty of imprisonment ranging from 4 years 6 months and one day as minimum to 6 years and 10 months as maximum plus a hefty fine of Php300k and Php100,000.00 as civil liability.
Our jurisprudence on this law is scarce. As far as I know, only one case was decided by the Court, i.e. ### v. People, G.R. No. 261049, June 26, 2023, penned by Justice Mario.Lopez, on Anti-Voyeurism.
