ANIM NA BUWAN BAGO ANG PAGWAWAKAS NG PANUNUNGKULAN: PAGPILI NG IPMR AT PAGSASAGAWA NG KAMPANYA SA IMPORMASYON AT EDUKASYON (IEC)
•Information Education Campaign (IEC)
- Upang matiyak na ang boses ng mga Katutubong Pilipino (IPs) ay tunay na naririnig sa gobyerno.
Buod ng IEC para sa Pagpili ng IPMR
•Ang pangunahing layunin nito ay ang pagsunod sa RA 8371 (IPRA Law)
-Upang matiyak na ang pagpili ng kinatawan ay hindi basta-basta, kundi nakaugat sa kultura at batas ng bansa.
1. Bakit ito kailangan?
Kaalaman:
•Upang malaman ng mga komunidad ang karapatan nila sa mandatory representation.
Transparensya:
•Upang maging malinis at patas ang pagpili ng bagong IPMR.
Customary Laws:
•Upang masigurado na ang tradisyonal na paraan ng pagpili ng mga lider ang masusunod.
2. Timeline:
•Ang 6 na Buwang Paghahanda
-Dapat magsimula ang IEC anim (6) na buwan bago matapos ang termino ng kasalukuyang IPMR. Ito ang karaniwang daloy:
BUWAN NA GAWAIN
Buwan 1-2 Social Preparation:
•Pagbisita sa mga komunidad at pagbibigay ng impormasyon gamit ang sariling wika.
Buwan 3-4 Consultation:
•Pagpupulong ng mga elder, lider, kababaihan, at kabataan para sa consensus.
Buwan 5 Selection Process:
•Ang mismong pagpili base sa kinagawiang batas (customary laws).
Buwan 6 Validation:
•Pagproseso ng dokumento para sa Certificate of Affirmation (COA) mula sa NCIP.
3. Mga Pangunahing Elemento ng Kampanya
Konsultasyon:
•Hindi lang ito utos mula sa itaas; dapat itong dumaan sa mga elder at tradisyonal na lider.
Capacity Building:
•Pagsasanay sa mga potensyal na lider tungkol sa kung paano gumagana ang LGU at paano gumawa ng mga polisiya/ordinansa.
Kultural na Paraan:
•Paggamit ng mga materyales na madaling intindihin (flyers o radio announcements) sa lokal na dialekto.
4. Legal na Basehan
RA 8371 (IPRA) Section 16: Ang karapatan ng mga IP na makilahok sa pagdedesisyon sa lahat ng antas ng gobyerno.
NCIP AO No. 001, s. 2009: Ang pambansang gabay para sa Mandatory Representation.
Paalala:
•Ang IPMR ay hindi isang politiko sa tradisyonal na kahulugan; sila ay tulay ng kultura sa loob ng konseho ng bayan o lalawigan. Kaya naman kritikal na ang mapipiling kinatawan ay may basbas ng kanilang komunidad at hindi ng mga lokal na politiko.

KAPANGYARIHAN NG IPMR

Walang kapangyarihan ang mga Indigenous Peoples Mandatory Representatives (IPMRs) na magtanggal o magdiskwalipika ng mga miyembro ng isang Indigenous Political Structure (IPS).

Batay sa mga alituntunin ng National Commission on Indigenous Peoples (NCIP), partikular na sa NCIP Administrative Order No. 3, Series of 2018, narito ang mahahalagang punto tungkol sa kapangyarihan ng isang Indigenous Peoples Mandatory Representative (IPMR):

1. Limitadong Kapangyarihan

Ang pangunahing tungkulin ng isang IPMR ay magsilbing boses ng mga katutubo sa local legislative councils (barangay, munisipyo, o lalawigan). Sila ay nasa ilalim ng Indigenous Political Structure (IPS) at hindi ang kabaligtaran.

2. Ang IPS ang Pinakamataas na Awtoridad

Ang IPS (na binubuo ng mga Tribal Elders at Leaders) ang siyang may kapangyarihan ayon sa kanilang Customary Laws. Sila ang nagdedesisyon kung sino ang magiging miyembro ng kanilang istruktura at kung sino ang karapat-dapat na maging kinatawan (IPMR).

3. Walang Administrative Authority sa IPS

Walang legal na basehan sa ilalim ng IPRA (Indigenous Peoples' Rights Act of 1997) na nagbibigay ng awtoridad sa isang IPMR na pakialaman ang komposisyon ng kanilang IPS. Ang IPMR ay pinili ng IPS; kaya naman, ang IPS ang may kapangyarihang magdisiplina o magtanggal sa isang IPMR sa pamamagitan ng "loss of confidence," ngunit hindi ito maaaring gawin ng IPMR laban sa mga miyembro ng IPS.

4. Paggalang sa Customary Laws

Ang pagtatanggal ng sinumang miyembro ng katutubong pamayanan mula sa kanilang liderato ay dapat dumaan sa tradisyunal na proseso ng komunidad at hindi desisyon lamang ng isang indibidwal na nakaupo sa gobyerno.

MGA LEGAL NA BASIHAN

1. Ang Karapatan sa Self-Governance (Section 13)

Ayon sa Section 13 ng IPRA, kinikilala ng estado ang karapatan ng mga ICCs/IPs (Indigenous Cultural Communities/Indigenous Peoples) na pamahalaan ang kanilang sarili.

"The State recognizes the inherent right of ICCs/IPs to self-governance and self-determination and respects the integrity of their values, practices and institutions."

Dahil dito, ang Indigenous Political Structure (IPS) ang siyang kinikilalang institusyon ng pamamahala sa loob ng komunidad. Ang IPMR ay isang "extension" lamang ng komunidad sa gobyerno, hindi ang pinuno ng IPS.

2. Kahulugan ng Indigenous Political Structure (Section 3-p)

Sa batas, ang IPS ay tinutukoy bilang ang mga tradisyunal na sistema ng pamumuno. Ang mga lider dito (Elders/Leaders) ay kinikilala dahil sa kanilang kaalaman sa Customary Law, hindi dahil sa sila ay in-appoint ng isang IPMR.

Walang anumang probisyon sa IPRA na nagbibigay sa isang halal o itinalagang kinatawan (tulad ng IPMR) ng kapangyarihang baguhin ang tradisyunal na istruktura ng kanilang tribo.

3. NCIP Administrative Order No. 3, Series of 2018

Ito ang pinaka-importanteng dokumento tungkol sa mga IPMR. Ayon sa Section 23 (Accountability):

Ang IPMR ay direktang may pananagutan sa kanyang IPS at sa buong komunidad.

Ang IPS ang may kapangyarihang bawiin ang mandato ng isang IPMR (Removal or Recall) kung ito ay hindi na sumusunod sa kagustuhan ng tribo.

Baliktad ang sitwasyon:

Ang IPS ang "boss" at ang IPMR ang kinatawan. Hindi maaaring tanggalin ng kinatawan ang mga taong naglagay sa kanya sa posisyon.

Konklusyon

Ang anumang pagtatangka ng isang IPMR na magtanggal ng miyembro ng IPS ay maituturing na "Ultra Vires" o isang pagkilos na labas sa kanyang legal na kapangyarihan. Ito ay isang paglabag sa karapatan ng komunidad sa Self-Governance.

Maaaring maghain ng reklamo sa NCIP (National Commission on Indigenous Peoples) kung mayroong IPMR na umaabuso sa kanyang katungkulan at pilit na nakikialam sa internal na istruktura ng tribo.

My heart aches with overwhelming sadness as I write this letter, knowing you are no longer with us. The news of your passing has left a void in my life that words cannot express. Though I cannot be there to say goodbye in person, my thoughts and love are with you every moment.

My mind is flooded with memories of our time together. Your warmth, your laughter, your unwavering support, and your unconditional love – these are the things I will cherish forever. You were my rock, my confidante, and my guiding light. Your absence leaves an immeasurable hole in my life.

I am deeply saddened that I could not be there to see you one last time. The distance between us makes the pain even more unbearable. However, please know that my spirit is with you, and I will carry you in my heart wherever I go.

Papa, you were the most incredible father anyone could ask for. You taught me so much about life, about strength, about resilience, and about love. You were my role model, my inspiration, and my best friend. I will miss you more than words can say.

Raja Dominador Datahan Magarin is a Theocracist, Indigenous Peoples Counselor and Consultant, Law & Environmental Advocate, Public Speaker & Debater, Educator, Researcher, and Vlogger. He belongs to the Eskaya Tribal Community with its ancestral domain in Bohol Islands Province and founder of the Eskaya Sotbaganate and Rajanate in southern part of the Philippines. In the Southern Philippine parliamentary debating arena, he is regarded as the ā€œFather of Caraga Parliamentary Debatingā€ in the northeastern part of Mindanao, Philippines leading to the annual convention and conference of Caraga Regional Schools Debating Championships. He also served as the third remarkable convenor and tournament director of the 3rd Mindanao Parliamentary Debating Championship 2001, an annual debate tournament among colleges and universities in Mindanao .

As Founder, Chief Executive Officer/Director General, Chairman of the Board of Governors of the Jesus University of Divine Education Ambassadors Nexus of Intelligence and Supernatural Metaphysics (JUDEANISM) through JUDEANISM School of Passionate English Adjudicators and Keen Speakers (JUDEANISM SPEAKS); initiated, created, and accredited the foundation of duly established English speech and debating clubs and societies using parliamentary debate formats among private and public secondary schools in Northeastern Mindanao otherwise known as ā€˜Caraga Administrative Region-XIII’, Republic of the Philippines.
