Inilarawan ni Michael Tiu, Jr., law expert at assistant professor ng University of the Philippines (UP) College of Law, ang mga impeachment proceedings sa kaso ni Vice President Sara Duterte bilang âoverproceduralizationâ na aniyaây nakakabahala.
Aniya, bago pumasok ang mga kasalukuyang isyu sa impeachment case ni VP Sara ay âstraightforwardâ lamang umano ang utos ng Konstitusyon sa Kongreso pagdating sa impeachment: âthe vision of the Constitution is for the House of Representatives to initiate and for the Senate to try.â
Bagaman maaaring tumungo sa Korte Suprema bilang âremedyâ sa mga ganitong kaso, hindi umano ito ang âgeneral ruleâ at dapat isagawa pa rin ng Kongreso ang mga âassigned functionsâ nito, ayon kay Tiu.
âBut reliance on a resolution by the Supreme Court is not the general rule here, you still perform your functions even if a case is pending, unless youâre prevented by the court from proceeding, and so that shouldnât be made an excuse,â paliwanag niya sa isang panayam ng âDateline Philippinesâ sa ANC News ngayong Martes, Hulyo 15.
âYou should still perform your functions and not hide behind a petition which of course can be calculated in order to delay further the proceedings,â dagdag pa ng law expert.
