NETHERLANDS AND THE PNP AND MARCOS ADMINISTRATION
FALLED?
It is not hidden from the knowledge of many that former
President Rodrigo Rody Duterte's vision has long been sharp
when it comes to the field of politics and strategy.
And with what happened yesterday - where he immediately
wanted to be brought to the Netherlands without going
through due process - it seems clear that he has succeeded in a very
careful trap against the current administration and the Philippine National Police (PNP).
•The Violation of the Rome Statute and the "Poisonous Tree"
One of the most important aspects of International Criminal
Court (ICC) law is compliance with Article 59 (3) of the Rome
Statute, which states that anyone arrested has the right to first
go to the court of their home country for interim release or
temporary release. while organizing the surrender process.
The competent authority in this case is the Supreme Court
PH of the Philippines, and the custodial state is also the
Philippines. But what happened? Duterte was put on a plane to
the Netherlands without even going through due process.
This is a clear violation of ICC law itself. That is, any subsequent steps - from trial
to any verdict - can be considered "fruits of a poisonous tree." In other words, if the arrest
itself is flawed, all subsequent evidence can be dismissed.
Duterte's Plan: Why Did He Let It Happen?
Many are asking: Why didn't Duterte fight back? Why does he
seem to accept what happened?
The answer can be seen in the very words he uttered:
"I understand those because it's their job. This is why it has come to an end."
A statement full of meaning. This shows that he knew it was
coming and he let it happen - not because he couldn't do
anything, but because he wanted to put the PNP, the ICC, and
the Marcos administration in jeopardy.
The message is clear: The PNP and the government itself
violated due process, not him.
In this way, he not only showed the weakness of the current
administration, but also put the very case against him in
jeopardy.
How Did the Marcos Admin and PNP Fall into the Trap?
1. PNP Compliance Without Due Process - Instead of making
sure to go through a Philippine court, they immediately
surrendered Duterte to the ICC, an illegal move they are
following.
2. Administration Indolence - Instead of defending the
country's sovereignty and insisting on due process, the
government seems to have simply allowed this to happen,
showing their weakness on the world stage.
3. Adoption of Argument that the ICC is Biased - Due to the
flagrant violation of Article 59 (3), the argument that the ICC
is unfair and is only used against leaders who are not allies of the
West has grown stronger.
What Could Happen Now?
✅ UN Security Council Intervention - Countries like Russia and China
can move to suspend ICC proceedings against Duterte, using the violation
of Article 59 (3) as strong grounds.
✅ Destruction of ICC's Credibility - If the ICC presses the case against
Duterte, it may lose credibility forever, especially if it is proven that it has
become a mere political tool.
✅ Absence of Legal Base in the Case - Due to the "fruits of a poisonous tree"
doctrine, the case against Duterte may be dismissed, giving him a historic
victory even though he is already in the Netherlands
A Successful Strategy
At first glance, others may think that Duterte is a loser in this
situation.
But upon deeper analysis, it turns out that he is the real winner.
He let the PNP and the Marcos administration fall into a trap
that they themselves are blaspheming the law
