Retired Supreme Court Associate Justice Adolfo Azcuna said as long as a Senator is a member of the Senate, "he has to be included in the two-thirds denominator."

Former Supreme Court Chief Justice Reynato Puno said detained senators can still perform their duties as senator-judges.

Former Supreme Court Justice Adolfo Azcuna, himself a member of the 1986 Constitutional Commission, takes a different view from former Chief Justice Hilario Davide Jr.

For Azcuna, “𝒕𝒘𝒐-𝒕𝒉𝒊𝒓𝒅𝒔 𝒐𝒇 𝒂𝒍𝒍 𝒕𝒉𝒆 𝑴𝒆𝒎𝒃𝒆𝒓𝒔 𝒐𝒇 𝒕𝒉𝒆 𝑺𝒆𝒏𝒂𝒕𝒆” means all who legally remain senators. Mere absence, detention, suspension, or inability to vote does not automatically remove a senator from the denominator. Thus, if the Senate legally remains composed of 24 members, 16 votes are required to convict.

The denominator may change when a senator actually ceases to be a member, such as through death, resignation, or removal.

Important caveat: Azcuna speaks as amicus curiae. His opinion is advisory—not a Supreme Court ruling, and not binding jurisprudence.
