۔CDA کو ختم کر دیا گیا جسٹس محسن اختر کیانی نے تفصیلی فیصلہ جاری کرتے ہوئے وفاقی حکومت کو ہدایت دی ہے کہ سی ڈی اے کو ختم کر کے اس کے تمام انتظامی، مالیاتی اور قانونی اختیارات و اثاثے میٹروپولیٹن کارپوریشن اسلام آباد (MCI) کو منتقل کیے جائیں۔ عدالت نے قرار دیا ہے کہ سی ڈی اے کا قیام ایک عبوری انتظام تھا جس کا مقصد اب پورا ہو چکا ہے۔فیصلے میں کہا گیا ہے کہ 2015 کے نوٹیفکیشن کے تحت سی ڈی اے نے جتنی بھی رقوم افراد یا اداروں سے وصول کیں، وہ غیرقانونی تھیں اور انہیں فوری طور پر واپس کیا جائے۔ عدالت کے مطابق سی ڈی اے کو پٹرول پمپس، سی این جی اسٹیشنز، اور ہاؤسنگ سوسائٹیز پر مرکزی شاہراہوں سے براہ راست رسائی پر کوئی ٹیکس یا چارج عائد کرنے کا قانونی اختیار حاصل نہیں۔اسلام آباد کا انتظامی ڈھانچہ لوکل گورنمنٹ ایکٹ کے تحت چلایا جائے گاعدالت نے واضح کیا کہ اب اسلام آباد کی انتظامی، ریگولیٹری اور بلدیاتی ذمہ داریاں اسلام آباد لوکل گورنمنٹ ایکٹ 2015 کے تحت چلائی جائیں گی۔ فیصلے میں کہا گیا ہے کہ “سی ڈی اے آرڈیننس اب اپنی قانونی و عملی افادیت کھو چکا ہے، اور وقت آ گیا ہے کہ وفاقی حکومت سی ڈی اے کو تحلیل کرنے کے لیے سنجیدہ اقدامات کرے۔اسلام آباد ہائیکورٹ نے حکومت کو ہدایت دی ہے کہ اختیارات کی منتقلی کے بعد اسلام آباد میں شفاف اور قابلِ احتساب نظامِ حکومت یقینی بنایا جائے، تاکہ شہریوں کے حقوق کا قانون کے مطابق مکمل تحفظ ممکن ہو۔
