1. عدالت نے کہا کہ CNIC بلاک کرنا عملداری کا درست طریقہ نہیں، کیونکہ یہ ضابطہِ دیوانی (CPC) کی دفعہ 51 کی شق (e) کے دائرے میں نہیں آتا۔
2. یہ شق عام اختیار تو دیتی ہے، مگر اسے اتنا وسیع نہیں کیا جا سکتا کہ دیوالیہ کی معمولی زندگی گزارنے کی ضروریات ہی ختم کر دی جائیں۔
3. CNIC عیش و آرام یا محض قانونی دستاویز نہیں، بلکہ آج کے دور میں معمول کی زندگی گزارنے کے لیے بنیادی ضرورت ہے۔
4. صوبہ خیبرپختونخوا میں CPC میں ایک ترمیم کر کے CNIC بلاک کرنے کی صراحتاً گنجائش پیدا کی گئی ہے، مگر یہ ترمیم سندھ میں نافذ العمل نہیں۔
5. حقیقت یہ ہے کہ پشاور ہائی کورٹ کو واضح طور پر یہ اختیار شامل کرنا پڑا، اس سے ثابت ہوتا ہے کہ عام دفعات کے تحت یہ اختیار موجود نہیں۔

فیصلہ:
سپریم کورٹ نے سندھ ہائی کورٹ کا فیصلہ کالعدم قرار دیتے ہوئے اپیل منظور کر لی اور CNIC بلاک کرنے کا حکم منسوخ کر دیا۔

بقایا کرایہ کی ادائیگی کے خلاف اپیل دائر کی تھی۔
۔ درخواست گزاروں کو زمین خالی کرنے اور بقایا کرایہ ادا کرنے کا حکم دیا گیا۔
· بنیادی وجوہات:
1. درخواست گزاروں کا لکھا ہوا معاہدہ ختم ہونے کے باوجود وہ زمین پر قابض تھے۔
2. انہوں نے 12 سال سے زائد عرصے سے کرایہ ادا نہیں کیا تھا۔
3. عدالت نے کہا کہ کرایہ دار کا کرایہ ادا نہ کرنا ناجائز ہے، اور قانون صرف ان کی مدد کرتا ہے جو اپنی ذمے داریاں پوری کریں۔
4. پشاور ہائی کورٹ اور بورڈ آف ریونیو کے متفقہ فیصلے کو درست قرار دیا گیا۔

اگر ٹرائل کورٹ میں غلط یا نامکمل ایشوز فریم ہو جائیں تو اپیلیٹ کورٹ کے پاس انہیں دوبارہ فریم (Reframe) یا ترمیم (Amend) کرنے کا اختیار موجود ہوتا ہے، کیونکہ اپیل مقدمہ کا تسلسل (Continuation of suit) ہوتی ہے۔

تاہم عدالتِ عالیہ نے قرار دیا کہ:

ایشوز میں ترمیم کی درخواست ٹرائل کے دوران دائر نہیں کی گئی؛

مقدمہ خارج ہونے کے بعد اپیل میں پہلی مرتبہ یہ اعتراض اٹھایا گیا؛

اپیلیٹ کورٹ نے عبوری (Interlocutory) نوعیت کی درخواست کو صوابدیدی اختیار استعمال کرتے ہوئے مسترد کیا؛

ایسے عبوری اور صوابدیدی احکامات کو فوری طور پر ریویژن میں چیلنج نہیں کیا جا سکتا؛

فریق اپیل کے حتمی دلائل کے وقت یہ مؤقف اٹھا سکتا ہے کہ غلط ایشوز کی وجہ سے انصاف متاثر ہوا؛

اپیلیٹ کورٹ Order XLI Rules 23 تا 25 CPC اور Order XIV Rule 5 CPC کے تحت اب بھی اختیار رکھتی ہے کہ اگر انصاف کے تقاضے ہوں تو اضافی ایشوز فریم کرے، موجودہ ایشوز میں ترمیم کرے یا مقدمہ ریمانڈ کرے۔

لہٰذا ہائی کورٹ نے ریویژن کو قبل از وقت (Premature) قرار دیتے ہوئے نمٹا دیا، لیکن یہ واضح کیا کہ اپیلیٹ کورٹ حتمی سماعت کے وقت ضرورت پڑنے پر ایشوز دوبارہ فریم کر سکتی ہے۔
