The Supreme Court of Pakistan has settled a 71-year-old family dispute, delivering a landmark judgment that reaffirms inheritance as a vested Sharia and legal right that devolves upon all heirs—including women—immediately upon the death of a family head.
Heading a two-judge bench, Justice Shahid Bilal Hassan set aside a 2017 Lahore High Court judgment, ruling that inheritance rights cannot be defeated through social pressure, dubious revenue entries, or private arrangements.
The court declared a 1955 mutation involving an alleged verbal gift from a widow and daughters to two sons as illegal, void, and fraudulent.
The court observed that the law of inheritance serves as a divine scheme for wealth distribution and economic justice. Justice Hassan noted that the right to inherit is not a “bounty” to be granted at the pleasure of male family members, nor is it a concession dependent on custom.
The judgment stressed that once a gift is challenged, the burden of proof shifts to the beneficiaries to demonstrate its lawfulness.
Highlighting a persistent societal issue, the court remarked that women are often pressured to surrender their rights in the name of tradition or family honor. The SC directed revenue authorities to correct records and ensure the lawful separation of shares for all heirs.
سپریم کورٹ آف پاکستان نے ایک 71 سالہ خاندانی تنازعہ کو نمٹاتے ہوئے ایک تاریخی فیصلہ سنا دیا ہے جس میں وراثت کو ایک شرعی اور قانونی حق کی توثیق کی گئی ہے جو خاندان کے سربراہ کی موت کے فوراً بعد تمام ورثاء بشمول خواتین پر ہوتا ہے۔
دو رکنی بینچ کی سربراہی کرتے ہوئے جسٹس شاہد بلال حسن نے لاہور ہائی کورٹ کے 2017 کے فیصلے کو کالعدم قرار دیتے ہوئے کہا کہ وراثت کے حقوق کو سماجی دباؤ، مشکوک آمدنی کے اندراجات یا نجی انتظامات کے ذریعے ہرایا نہیں جا سکتا۔
عدالت نے 1955 میں ایک بیوہ اور بیٹیوں کی طرف سے دو بیٹوں کو مبینہ زبانی تحفہ کو غیر قانونی، باطل اور فراڈ قرار دیا۔
عدالت نے مشاہدہ کیا کہ وراثت کا قانون دولت کی تقسیم اور معاشی انصاف کے لیے ایک خدائی اسکیم کے طور پر کام کرتا ہے۔ جسٹس حسن نے نوٹ کیا کہ وراثت کا حق "فضل" نہیں ہے جو خاندان کے مرد افراد کی خوشی سے دیا جائے اور نہ ہی یہ رواج پر منحصر رعایت ہے۔
فیصلے میں زور دیا گیا کہ ایک بار تحفہ کو چیلنج کیا جاتا ہے، ثبوت کا بوجھ فائدہ اٹھانے والوں پر منتقل ہو جاتا ہے تاکہ وہ اس کی قانونی حیثیت کا مظاہرہ کریں۔
ایک مسلسل سماجی مسئلے کو اجاگر کرتے ہوئے عدالت نے ریمارکس دیے کہ خواتین پر اکثر دباؤ ڈالا جاتا ہے کہ وہ روایت یا خاندانی عزت کے نام پر اپنے حقوق سے دستبردار ہوجائیں۔ سپریم کورٹ نے ریونیو حکام کو ہدایت کی کہ وہ ریکارڈ درست کریں اور تمام ورثاء کے حصص کی قانونی علیحدگی کو یقینی بنائیں۔
