The good news is that you don't need to be employed at the time of application! This means you can start the application process without already having a job.

How does it work?

You submit an application for a temporary residence and work permit – including Annex No. 1 filled out by your prospective employer. Only after obtaining the residence permit decision can you start working for that employer. 💡 Note: You don’t need a work permit during or before the application process!

📢 Refusal to Grant a Residence and Work Permit in Poland! ❌

The authority will refuse to issue a residence and work permit to a foreigner if the company that wants to employ them, or the person managing that company:
1️. Has been penalized again for illegally employing a foreigner within the past 2 years.
2️. Has been penalized for: • leading a foreigner to engage in illegal work, • demanding money for work documents, • leading another person to illegally hire a foreigner.
3️. Has been convicted of offenses related to violating workers' rights or human trafficking.
4️. Has been convicted of falsifying documents related to work permits.
5️. Has been convicted of employing foreigners without valid residence documents.
6️. Has been penalized for persistently employing foreigners without valid residence documents.

🔹 Whether a foreigner receives a residence and work permit also depends on the company that completed attachment no. 1 for the residence application!

📢 What to do if your fingerprint appointment is scheduled after your visa or residence permit expires?

💡 The fingerprinting appointment date does NOT determine the legality of your stay in Poland. This is only one step in the procedure. What’s crucial is that you submit your residence application while your visa or residence permit is still valid. This way, your stay remains legal until the process is completed.

In some offices, the residence application must be submitted in person with fingerprints taken simultaneously. IMPORTANT!!! On the day of your visit, your visa or residence permit must be valid — only the date of the actual visit counts, not the appointment booking date.

How can you ensure a legal stay? Choose one of the following options:

1️⃣ Send your application by registered mail with proof of receipt – if your stay is close to expiring, this is the best option. 2️⃣ Submit your application in person – after scheduling an appointment. Fingerprints will be taken immediately, and you may receive a stamp in your passport confirming submission of the application.

To work legally in Poland, if you're from outside the 🇪🇺 EU, EEA, or Switzerland, you need to meet a few conditions:

1️⃣ Work permit – You need to have an appropriate work permit, seasonal work permit, or a registered declaration in the PUP (this applies to citizens of 🇦🇲 Armenia, 🇧🇾 Belarus, 🇬🇪 Georgia, 🇲🇩 Moldova, 🇺🇦 Ukraine - except those covered by the law on assistance to Ukrainian citizens)​​.

2️⃣ Legal stay – You must reside legally in Poland, for example, on the basis of a visa 🛂 or residence card 🏷​​.

3️⃣ Residence basis allowing work – Not every visa 🛂 allows you to work. For example, a tourist visa (symbol "1") or temporary protection (symbol "20") do not give you this right​.

By fulfilling these conditions, you can work legally in Poland.

💼 আপনি যদি নিজের খরচ চালানোর জন্য কাজ করতে চান, কিন্তু কাজের অনুমতি না থাকে, তাহলে কী করবেন?

মনে রাখবেন: কাজের অনুমতি ছাড়া কাজ করা অবৈধ! আপনার যদি এখনও কাজের অনুমতি না থাকে, তাহলে আপনি বৈধভাবে চাকরি নিতে পারবেন না। এটি আপনাকে বহিষ্কার এবং শেঙ্গেন অঞ্চলে প্রবেশের উপর ৩ বছরের জন্য নিষেধাজ্ঞার দিকে নিয়ে যেতে পারে 🚨।

🛑 আপনাকে পরিণতির বিষয়ে সচেতন থাকতে হবে। কাজের অনুমতি ছাড়া কাজ করলে, যদি আপনি এই বাধ্যবাধকতা থেকে অব্যাহতি না পান, তাহলে ঝুঁকি রয়েছে। সীমান্ত রক্ষা বাহিনী এবং শ্রম পরিদর্শন বিভাগ আপনাকে পরীক্ষা করতে পারে। 😊 তবে আপনি সর্বদা একজন বন্ধুকে দেখতে যেতে পারেন এবং যদি সে আপনাকে অনুমতি দেয়, তাহলে নিজের জন্য কাবাব বানাতে পারেন 😊। কখনোই গ্রাহকদের সেবা করবেন না বা তাদের কাছ থেকে টাকা নেবেন না। যদি পরিদর্শন আসে, তাহলে বলুন আপনি একজন গ্রাহক।

✅ কিছু ব্যতিক্রম আছে! কিছু বিদেশি গোষ্ঠী কাজের অনুমতি ছাড়া কাজ করতে পারে। দেখুন আপনি কোনও ব্যতিক্রমের আওতায় পড়েন কি না।

📌 মনে রাখবেন:
অবৈধ কাজের ঝুঁকি নেবেন না! সর্বদা চেষ্টা করুন কাজের অনুমতি পাওয়ার কী কী অপশন আছে বা বিশেষ বিধান অনুসারে আপনি কাজ করতে পারেন কিনা তা পরীক্ষা করতে। আপনাকে আইনজীবী দরকার নেই! আমাদের পেজটি শুধু অনুসরণ করতে হবে!

💼 What to do if you need to work to support yourself but don't have a work permit?

Remember: working without a permit is illegal! If you do not yet have a work permit, you cannot legally take up employment. This could lead to deportation and a ban on entering the Schengen area for up to 3 years 🚨.

🛑 You need to be aware of the consequences. Working without a permit, if you are not exempt from the requirement, carries risks. The Border Guard and the Labor Inspectorate may check on you. 😊 But you can always visit a friend, and if they let you, make a kebab for yourself 😊. Never serve customers or take money from them. If there is an inspection, say that you are a customer.

✅ There are exceptions! Some groups of foreigners can work without a permit. Check if you qualify for an exception.

📌 Remember:
Don't risk illegal work! Always try to check what options you have to obtain a permit or if you can work without one under special regulations. You don't need a lawyer! You just need to follow our page!

🔹 কাজ করার অধিকারসহ অস্থায়ী থাকার অনুমতি

💼 Work permit vs. temporary residence permit with the right to work – what you need to know?

If you're planning to work in Poland, it's important to understand the difference between a work permit and a temporary residence permit with the right to work.

🔹 Work Permit
This document is obtained by your employer who wants to hire you. The employer submits the application to the governor, and you will receive the document allowing you to apply for a work visa or start working if you’re already in Poland. Remember, the employer is responsible for the entire process.

🔹 Temporary Residence Permit with the Right to Work
If you’re already in Poland and want to work, you can independently apply for a temporary residence permit with the right to work. This permit grants you the right to both stay and work without needing an additional permit from the employer. You, not the employer, submit the application.

যদি আপনার কাছে অস্থায়ী বসবাস ও কাজের অনুমতি (বসবাস কার্ড) থাকে এবং সিদ্ধান্তে একটি নির্দিষ্ট কোম্পানি উল্লেখ করা হয় যেখানে আপনাকে কাজ করতে হবে, তবে নিম্নলিখিত বাধ্যবাধকতাগুলি মনে রাখুন:

1️⃣ কাজ ছেড়ে দেওয়া বা বরখাস্ত হওয়া – আপনি চাকরি শেষ হওয়ার পরে ১৫ দিনের 📅 মধ্যে ভয়েভোদাকে জানাতে হবে।
2️⃣ নতুন চাকরি খুঁজতে ৩০ দিন – চাকরি শেষ হওয়ার ৩০ দিনের ⏳ মধ্যে একটি নতুন নিয়োগকর্তা খুঁজে পেতে এবং অনুমতির পরিবর্তনের জন্য আবেদন করতে হবে। গুরুত্বপূর্ণ: বসবাস কার্ডটি নতুন করে পরিবর্তন করা হবে না।
3️⃣ নতুন সংযোজন – অনুমতি পরিবর্তনের জন্য আবেদন করার সময় নতুন কোম্পানির সংযোজন নং ১ 📄 সংযুক্ত করুন। কর্মসংস্থানের তারিখগুলি সঠিকভাবে উল্লেখ করা আবশ্যক, অন্যথায় ভয়েভোদা পরিবর্তন প্রত্যাখ্যান করবে।
4️⃣ পরিণতি – যদি আপনি ১৫ দিনের মধ্যে জানাতে ব্যর্থ হন 🛑 বা পরে আবেদন করেন, ভয়েভোদা অনুমতি পরিবর্তন প্রত্যাখ্যান করবে এবং বসবাস কার্ড প্রত্যাহারের প্রক্রিয়া শুরু করবে। এই ক্ষেত্রে, আপনাকে একটি নতুন অস্থায়ী বসবাস ও কাজের অনুমতির জন্য আবেদন করতে হবে।

💡 এটি কেন গুরুত্বপূর্ণ? এই নিয়মগুলি অনুসরণ করলে বৈধতার সাথে সম্পর্কিত সমস্যা এড়াতে সহায়তা করবে!

📢 কাজের অনুমতিতে কাজের সময় বৃদ্ধি - সব ঠিক আছে যদি... ⏰💼
..বেতন 💰 অনুপাতিকভাবে বৃদ্ধি করা হয় – এটি ওভারটাইমের সমস্যার সমাধান করে, যা বিদেশিরা আগ্রহের সাথে করে। আইন সংশোধনের আগে এটি কাজের অনুমতি পরিবর্তন ছাড়া সম্ভব ছিল না।

কাজের অনুমতিতে পরিবর্তন প্রয়োজন হয় না যদি:

✅ কাজের সময় বৃদ্ধি করা হয় এবং বেতন অনুপাতিকভাবে বৃদ্ধি করা হয়; ✅ কোম্পানির অবস্থান, ঠিকানা, নাম বা আইনি ফর্ম পরিবর্তিত হয়; ✅ অন্য কোনো নিয়োগকর্তা কোম্পানি বা এর অংশ অধিগ্রহণ করে; ✅ সিভিল ল কন্ট্রাক্ট পরিবর্তিত হয়ে কাজের চুক্তিতে রূপান্তরিত হয়; ✅ কাজের শিরোনাম পরিবর্তিত হয়, কিন্তু দায়িত্বগুলো একই থাকে।
