1. Preamble / تمہید (مسئلے کی جڑ)
EN: WHEREAS it is expedient to address the root cultural and social legal structural breakdown that leads to severe offenses including criminal harassment, digital blackmail, personal data extortion, physical assault, lethal violence, and acid throwing. Current laws under the PPC and PECA (2016) only act post-facto (after the crime) and fail to stop the unmonitored escalation of unregulated non-legal unions (boyfriend/girlfriend relationships) started in schools, colleges, and neighborhoods.
UR: چونکہ یہ امر وقت کی اہم ضرورت ہے کہ اس ثقافتی، سماجی اور قانونی ڈھانچے کی ٹوٹ پھوٹ کا سدِباب کیا جائے جو آگے چل کر سنگین جرائم بشمول مجرمانہ ہراساں کرنے، ڈیجیٹل بلیک میلنگ، پرسنل ڈیٹا کے ذریعے بھتہ خوری، جسمانی تشدد، اور تیزاب پھینکنے کا سبب بنتی ہے۔ پاکستان پینل کوڈ اور پیکا (PECA) کے تحت موجودہ قوانین بنیادی طور پر جرم ہونے کے بعد حرکت میں آتے ہیں، اور یہ اسکولوں، کالجوں اور گلی محلوں میں شروع ہونے والے غیر قانونی اور ناجائز سماجی رشتوں (گرل فرینڈ/بوائے فرینڈ تعلقات) کے بتدریج بڑھنے والے خطرات کو روکنے میں ناکام رہے ہیں۔
2. Absolute Gender Symmetrical Accountability / بلا تفریقِ جنس یکساں جوابدہی (برابر کا قانون)
EN: Gender equity dictates that the legal accountability, protections, and punitive measures mandated under state law must apply equally, uniformly, and symmetrically to both males and females without procedural bias. Where a female citizen engages in an unregulated non-legal relation and utilizes private multimedia, text logs, or social leverage to blackmail, extort, or maliciously damage the legal or social status of a male citizen, she shall be liable to the exact same penal parameters applicable to a male perpetrator.
UR: صنفی برابری اور انصاف کا تقاضا ہے کہ ریاستی قانون کے تحت مقرر کردہ قانونی جوابدہی، تحفظ اور سزا کے اقدامات لڑکوں اور لڑکیوں (دونوں) پر بغیر کسی تعصب کے، یکساں اور برابر لاگو ہوں۔ اگر کوئی خاتون شہری کسی غیر قانونی تعلق میں شامل ہو کر پرسنل تصاویر، ویڈیوز یا سماجی اثر و رسوخ کا استعمال کسی مرد کو بلیک میل کرنے، بھتہ لینے، یا اس کی سماجی حیثیت کو نقصان پہنچانے کے لیے کرے گی، تو وہ انہی سخت سزاؤں کی حقدار ہوگی جو کسی مرد مجرم کے لیے پیکا (PECA) اور پی پی سی (PPC) کے تحت مقرر ہیں۔
3. Mutual Investigation of Relations and Clandestine Travel / ناجائز رشتوں اور بیرونِ ملک سفر کی مشترکہ تفتیش
EN: In cases where an allegation of blackmail, harassment, or leaked personal media is brought before a court by a complainant, the investigative authority shall assess the genesis of the relationship. The court shall order an inquiry into the joint ex*****on of illicit acts, including unregulated domestic or international travel under non-legal frameworks. If both parties willingly engaged in the production of high-risk personal media or traveled illicitly outside of any legal or Mahram relationship, both shall face accountability for violating public morality rules.
UR: جب بھی بلیک میلنگ، ہراساں کرنے یا ویڈیو لیک کا کوئی دعویٰ عدالت کے سامنے لایا جائے گا، تفتیشی ادارہ تعلقات کی شروعات کی جانچ کرے گا۔ عدالت یہ انکوائری کرنے کا حکم دے گی کہ تفتیش کی جائے کہ اگر دونوں فریقین نے رضامندی سے پرسنل ہائی رسک میڈیا (تصاویر/ویڈیوز) بنائیں یا کسی قانونی یا محرم رشتے کے بغیر اکیلے ملک یا بیرونِ ملک اکٹھے گھومتے رہے، تو عوامی اخلاقیات اور ریاستی قوانین کی خلاف ورزی پر دونوں فریقین سے جواب طلبی کی جائے گی کہ وہ کس حیثیت سے ساتھ گھوم رہے تھے۔
4. Statement of Objects and Reasons / بیانِ اغراض و وجوہات (قانون کا نچوڑ)
EN: Current criminal jurisprudence waits for a tragedy—such as an acid attack or a public video leak—to happen before intervening. This Bill establishes that the root cause of these systemic horrors lies in the unchecked proliferation of unregulated, non-legal intimate networks nurtured inside educational institutions and neighborhoods outside standard familial and lawful frameworks. Therefore, this comprehensive legal architecture is proposed by Abdul Latif to secure our social infrastructure.
UR: موجودہ نظامِ انصاف المیہ (مثلاً تیزاب کا حملہ یا ویڈیو لیک) ہونے کا انتظار کرتا ہے۔ یہ بل اس اصول کو وضع کرتا ہے کہ ان ہولناک جرائم کی اصل جڑ اسکولوں، کالجوں اور محلوں میں خاندانی اور قانونی دائرہ کار سے باہر پروان چڑھنے والے ناجائز اور غیر قانونی تعلقات میں چھپی ہے۔ مزید برآں، یہ بل اس بات کو یقینی بناتا ہے کہ قوانین کا نفاذ بلا تفریقِ جنس بالکل برابر ہو، تاکہ جھوٹی شکایات کو ہتھیار کے طور پر استعمال کرنے کا راستہ روکا جا سکے اور ڈیجیٹل بلیک میلنگ کا شکار ہونے والے مردوں کو بھی مساوی انصاف ملے۔ لہٰذا یہ جامع بل عبداللطیف کی طرف سے پیش کیا جاتا ہے۔
