𝗛𝗼𝗻𝗴 𝗞𝗼𝗻𝗴 𝗔𝗱𝗼𝗽𝘁𝘀 𝗡𝗲𝘄 “𝟰𝟲𝟴 𝗥𝘂𝗹𝗲” 𝗳𝗼𝗿 𝗖𝗼𝗻𝘁𝗶𝗻𝘂𝗼𝘂𝘀 𝗘𝗺𝗽𝗹𝗼𝘆𝗺𝗲𝗻𝘁

Starting 𝟭𝟴 𝗝𝗮𝗻𝘂𝗮𝗿𝘆 𝟮𝟬𝟮𝟲, Hong Kong will implement a major update to its Employment Ordinance — replacing the long-standing “418 rule” with a more flexible framework that better supports part-time and casual workers.

What’s Changing?
Current: 18 hours/week for 4 consecutive weeks
New:
• 𝟭𝟳 𝗵𝗼𝘂𝗿𝘀/𝘄𝗲𝗲𝗸 𝗳𝗼𝗿 𝟰 𝘄𝗲𝗲𝗸𝘀 (𝟰𝟭𝟳 𝗿𝘂𝗹𝗲) or
• 𝟲𝟴 𝘁𝗼𝘁𝗮𝗹 𝗵𝗼𝘂𝗿𝘀 𝗼𝘃𝗲𝗿 𝗮𝗻𝘆 𝟰 𝗰𝗼𝗻𝘀𝗲𝗰𝘂𝘁𝗶𝘃𝗲 𝘄𝗲𝗲𝗸𝘀 (𝟰𝟲𝟴 𝗿𝘂𝗹𝗲)

Employees meeting either threshold will now be considered under a continuous contract, granting access to statutory benefits such as holiday pay, sick leave, and maternity/paternity leave.

The amendment was gazetted on 27 June 2025 and takes effect 𝟭𝟴 𝗝𝗮𝗻𝘂𝗮𝗿𝘆 𝟮𝟬𝟮𝟲.

This change reflects Hong Kong’s move to modernise employment protections and accommodate today’s evolving work patterns.

Heads up, HR teams and business owners! Beginning 𝟭 𝗝𝗮𝗻𝘂𝗮𝗿𝘆 𝟮𝟬𝟮𝟲, 𝗮𝗹𝗹 𝗲𝗺𝗽𝗹𝗼𝘆𝗺𝗲𝗻𝘁 𝗰𝗼𝗻𝘁𝗿𝗮𝗰𝘁𝘀 𝗶𝗻 𝗠𝗮𝗹𝗮𝘆𝘀𝗶𝗮 must be 𝘀𝘁𝗮𝗺𝗽𝗲𝗱 𝘂𝗻𝗱𝗲𝗿 𝘁𝗵𝗲 𝗦𝘁𝗮𝗺𝗽 𝗔𝗰𝘁 𝟭𝟵𝟰𝟵 and late stamping will incur penalties.

Here’s what you need to know:
1. RM10 stamp duty per contract
2. No stamping required for contracts signed before 1 Jan 2025
3. Grace period for 2025 contracts – stamp by 31 Dec 2025 to avoid penalties
4. Full enforcement kicks in from 2026
5. Update your onboarding & HR processes now

This change is part of LHDN’s nationwide push for greater compliance under the new Stamp Duty Self-Assessment System.

菲律宾劳工部新规!外国公民在菲就业须知❗

🇵🇭菲律宾劳工和就业部(DOLE)出台了新的外国公民就业管理规定。这些变化对外国人就业许可证(AEP)制度产生了重大影响,旨在简化雇佣流程,同时保护当地经济和劳动力。

⚠️虽然确切的实施日期尚未公布,但雇佣或计划向菲律宾派遣外国公民的公司必须为以下主要变化做好准备:

1️⃣AEP申请期限延长
申请AEP的截止日期已延长至签订雇佣合同或发出任命书后的15个自然日(过去为10天)。

2️⃣强制性职位发布
在考虑雇佣外国公民之前,公司现在必须在以下平台上刊登职位空缺广告:
- 当地报纸
- PhilJobnet网站
- 最近的公共就业服务办公室 (PESO) 或工作安置办公室 (JPO),视工作地点而定

3️⃣豁免证明
免于获得AEP的外国公民现在必须申请豁免证明。这将确保所有外籍雇员,即使是免于AEP要求的外籍雇员,都能获得适当的文件证明。

4️⃣禁止行为清单新增条目
新规现在明确禁止虚假陈述和欺诈活动,否则可能导致AEP被拒绝或撤销。公司必须确保全面遵守,以免受到处罚。

5️⃣简化高级职位招聘流程
公司无须为某些高级职位发布招聘广告,只要公司秘书对任命进行核实即可。这简化了对高级职位的招聘流程。

6️⃣聘用通知的条件效力
雇佣合同或任命只有在劳动就业部签发AEP后才生效。在成功签发AEP之前,聘用通知并非无条件。

7️⃣境外申请AEP
外国公民现在可以在境外开始AEP申请流程。不过,只有在他们持适当签证进入菲律宾后,许可证才会发放。

8️⃣强制培训本地劳动力
公司必须实施培训计划,帮助菲律宾本地员工获得外籍员工所具备的专业技能。这样做的目的是提高本地能力,鼓励知识共享,但可能会导致额外的运营规划和成本。

DOLE Philippines has introduced updated regulations under the Alien Employment Permit (AEP) system to enhance compliance and prioritise local workforce development.
