Prosecution not compelled to tender State House CCTV Footage

-Judge rules

Justice Alhaji Momoh Jah Stevens has ruled in the ongoing treason trail of Retired Major Alfred Palo Conteh and two others that the prosecution is not compelled to tender as evidence the footage of Close Circuit Television (CCTV) at State House.

The judge said if the Office of the Presidency wants to present the footage it is fine, but he cannot coerced them to do so, citing Section 48 (4) of the 1991 Constitution which notes among others that one cannot bring an action against the Office of the President.

The said Section reads thus: “(4) While any person holds or performs the functions of the office of President, no civil or criminal proceedings shall be instituted or continued against him in respect of anything done or omitted to be done by him either in his official or private capacity.”

It follows after the defense counsel representing Palo Conteh, Joseph F. Kamara applied for the court to proceed behind closed doors to view the CCTV footage of his client’s visit to State House.

His application was objected to by the prosecuting counsel, Adrian Fisher, on the grounds that such issues attract national security interest and that the security around the presidency shouldn’t be discussed in either public or private.

The defense counsel argued that if the prosecution could not provide the footage to the defense, then he doesn’t think if there is any treason charge against his client.

Lawyer Joseph .F Kamara submitted that the defense team was only interested in the time the first accused entered State House and nothing else.

“We don’t want to know who visit State House, our concern is when the first accused entered State House,” he submitted, adding that the prosecution wanted to have a field day under the guise of national security.

Sierra Leone: Over 73,000 People Live With HIV in Salone

Director General of the HIV Secretariat, Abdulrahman Sesay, has confirmed to newsmen that as at 2019, 73,468 persons are living with HIV in Sierra Leone.
He disclosed that out of the over 73,000 persons living with the disease in the country, over 30,000 are currently undergoing treatment.
He continued that the projected figure of 73,468 persons living with HIV in Sierra Leone will be included in the report that will be put out by UN-AIDS Global on the 1st December, 2019-World AIDS Day.
He added that HIV Secretariat has sent its projection to Geneva and that it has been verified and certified, thus noting that the secretariat was trying to convince people to accept the disease.
He noted that they are working with network of persons living with HIV and also collaborating with communities to create awareness about the disease.
He warned that any health worker that exposes the health status of a patient will be dealt with according to the law.
He called on development partners to work with the HIV Secretariat to reduce the disease in Sierra Leone.

Bench warrant for fugitive captain Kamara

The Judge Advocate, Justice Momoh Jah Stevens, presiding at the Court Martial has issued a Bench warrant for Captain Patrick Edwin Kamara, as the latter could not appear before him and the five board members.

The Judge told the court that since Captain Kamara is not the only person before the court, they won’t stall the matter, but rather try him in absentia.

Captain Kamara, who was the Commander of the Presidential Guard Force Unit under former President Ernest Bai Koroma before the allegations were made against him, is being tried together with two of his colleagues on five counts of missing arm and ammunition, an allegation they have denied.

He reportedly disappeared on the 24th May, 2019, from the military detention centre at Wilberforce Barracks in Freetown.

The State prosecutor, Lt. Colonel M.B.S Kamara, earlier applied for the court to permit him present a witness that would explain how Captain Kamara got missing at the holding centre, which the judge granted.

The witness, Lieutenant Colonel J.P.Koroma, who identified himself as the commander of three companies in the Republic of Sierra Leone Armed Forces (RSLAF) testified that they were the first Provosts Company at Wilberforce, where the accused was, as well as Makeni Provost Centre.

When quizzed by the Judge Advocate as to whether he knew why Captain Kamara was not in court, the colonel said the accused was not in court because he had escaped.

He said on the 24th May, 2019, at around 6:30am, he received a phone call from O.C Major T.H Sandy, who informed him that Captain Kamara has disappeared and that he crosschecked after he received the information.

He told the court that there was no sign of breakage in the cell or anywhere within the area captain Kamara was kept.
