Thanks very much. Steve Harvey simdekele litafula kutsi adle simbuka meanwhile we are busy chasing our African brothers and sisters through xenophobia.
First of all let me be frank and say it that indeed our Media industry ( whole African Media, state or private owned) is funded and supported by the Western agents. And they always play the game of making us Global citizens by spreading the gospel of WHO and UN and New World Order. I take it as a reminder. Thanks.
Now, we Africans, chase people from Zimbabwe, Zambia, Mozambique etc away when they seek jobs in our countries, we even call them "Kwerekweres " but look at Steve Harvey, no one cares that his making millions in South Africa while people in the media especially TV industry are losing jobs and ways to hustle. We must start to question ourselves, do we Africans think straight or is someone thinking for us, especially those who push Facebook propaganda/politics, propaganda of self hatred. Hating another African is similar to hating yourself. Are we Indipendent in our thinking or someone thinks for us? Are we ready to continue as stooges of the whites? Are we ready to continue as doormates of the white agenda at the expense of our brothers, mothers, sisters, even our resources just to please the white supremacy?
We are failing to even protect our Mothers and Sisters from media promoted gender violence.

TUCOSWA STATEMENT ON THE COMMISSIONER OF LABOURS’ APPOINTMENT OF AN INTERIM NATIONAL EXECUTIVE COMMITTEE TO LEAD THE SWAZILAND MANUFACTURING AND ALLIED WORKERS UNION (SMAWU)
Introduction
On the 31st July, 2019, The Ministry of Labour and Social Security issued a statement containing “directives” on the administration and activities of the SMAWU, including the appointment of an Interim National leadership of the Union for a period of fourteen (14) months, pending the holding of an Elective Conference to be held on a date set by the Ministry, as being September, 2020.
The Ministry in appointing the Union Leadership, alleges that it was exercising its powers as vested on the Commissioner of Labour by section 82 of the Industrial Relations Act No. 1 (2000) as amended.
Intervention or Interference
Section 82 of the Industrial Relations Act does make provision for the Commissioner of Labour to intervene on disputes that are in existence or may arise between “trade unions themselves”. A close reading of the section 82 however does not give the Commissioner of Labour any powers to arbitrate the dispute. Section 82(3) (b) (1) provides that, “If the Commissioner of Labour intervenes in terms of this section, the Commissioner may intervene personally and attempt to resolve or prevent the dispute through Conciliation” (underlines are mine).
The section 82 in its entirety does not give the Commissioner of Labour any powers except for the “attempt to resolve or prevent the dispute through Conciliation”.
The Ministry reported in its statement that, “Conciliation attempts by the Commissioner of Labour could not bear any meaningful results ………..”
Under such circumstances the Commissioner ought to have advised the parties to refer the matter to the Conciliation Mediation and Arbitration Commission. It is not clear how the Commissioner of Labour then concluded that he had powers that are not provided for in any of our labour laws. The Commissioner of Labour misdirected himself completely. What the Ministry purports to have been an intervention process was infact an interference process.
Respect of trade union’s internal democratic processes.
The SMAWU is one of the old trade unions in the Country. It has a very sound, tried and tested constitution that provides for clear and unambiguous internal democratic practices that governs the conduct of the election of the leadership of the Union. The Ministry does not have powers to appoint a Leadership of any union. Union leaders are elected by the members in terms of their constitutions. The Commissioner of Labour cannot set a date for a union Elective Conference as that’s the prerogative of the structures of unions.
The Federation condemns in the strongest terms possible any attempts by the Government to interfere with operations of trade unions. This is a principle position. A trade union is a self-correcting movement, it corrects itself from within like the sea.
We trust the issues currently faced by SMAWU shall be corrected through the Union’s democratic processes.
Violation of International Labour Standards.
The conduct of the Ministry is in complete violation of the Fundamental ILO Conventions. The Freedom of Association and Protection of the Right to Organize Convention 87 (1948) of the International Labour Organisation frowns on interference by Public Authorities in the affairs of workers Organizations.
Article 3(1) of Convention 87 dictates that “workers’ and employers’ Organizations shall have the right to draw up their constitutions and rules, to elect their representatives in full freedom to organize their administration and activities and to formulate their programmes”. The Public Authorities in this instance, the Labour Commissioner is warned against interference in the enjoyment of such rights. Article 3 (2) provides as follows, “The Public Authorities shall refrain from any interference which would restrict this right or impede the lawful exercise there-of”.

TUCOSWA STATEMENT ON THE GROSS MISLEADING FRONT PAGE PICTURE OF THE TIMES OF SWAZILAND - 2
ND MAY, 2019.
The Trade Union Congress of Swaziland wish to inform the general public and the international community that the Minister of Labour and Social Security Honourable Makhosi Vilakati, MP – never addressed members of the Trade Union Congress of Swaziland as he attended the celebrations organized by the FESWATU.
The picture on the front page of the Times of Swaziland of the 2nd May, 2019 is completely devoid of the truth. The inscription under the doctored picture gives an impression that Mr. Vilakati addressed the thousands of workers seen in the picture. The inscription, says “Bhunya: Minister of Labour and Social Security Makhosi Vilakati (inset) addressing workers during workers day celebrations held at Bhunya yesterday.”
Any reasonable reader could believe that the picture of the
gesturing Minister and that of the workers shown, means the
following.
1. That the workers in red were at Bhunya; And That;
2. The Minister was addressing them.
3. And further that the pictures were captured by Sibusiso
Shange.
We wish to put the perspective of what really obtained on the
1st May, 2019.
 The picture of the workers shown in the front page of the
newspaper is a picture of members of the TUCOSWA who
were gathered in Nhlangano not Bhunya as purported or
insinuated by the newspaper.
 Minister Vilakati attended the FESWATU celebrations not
the TUCOSWA, hence he could not have addressed the
gathering in the picture.
 The caption under the picture suggests that the pictures
were taken by a journalist by the name of Sibusiso
Shange. This is not correct, we are having it in good
authority that Mr. Shange was for the duration of the 1st
of May, at Bhunya and could not have taken a picture in
Nhlangano which is 104.9km away.
The times of Swaziland is hereby called upon to correct
this distortion of facts.
The newspaper must explain why we should not believe
that their main aim was to create an impression that the
Minister addressed throngs of workers as opposed to the
reality that he in fact was a guest speaker to an empty
stadium in Bhunya.
We shall be seeking audience with the Management of
the Times of Swaziland through the assistance of the
Media Institute of Southern Africa to discuss and put to
rest this matter which we believe compromises objective
and accurate reporting ethics.

Statement (Condolencies)
The Union has with shock received the sad news of the untimely death of Swazi Observer Editor Mr Thulani "My Turn" Thwala. The death of Thwala is a huge lose to both the Journalism profession and to our social partner (Swazi Observer) to which we would like to send our heartfelt condolences to his entire family especial his wife and children whom we can't even imagine the pain they are going through at this hour. His contribution to the industry will always be remembered and honoured with pleasure his legacy shall be well kept and pressed forward.
May his soul rest in peace and family comforted. May Almighty God comfort and bless them.

The Media Workers Union of Swaziland and The Swazi Observer hav agreed on the following items:
1. Cost of living adjustment (2018) 5% ( It will be paid end of November and backdated to May 2018)
2. Medical AID contribution of R50, with a proposal that each worker enjoy the right to choose his or her own medical scheme other than the one being forcefully chose by the employer.

Furthermore, the following issues are continuing on the table, these issues are:
1. Salary Review
2. Agency Shop (as supported by Section 44 of the Industrial Relations Act as amended)
3. Amendment of the Recognition and Procedural Agreement, Article 2 (2.2) to be in accordance with Section 98 of the IRA 2000 as amended (Interpretations).
One would like to thank all members of the Union for the fighting spirit they showed. Thanks much comrades. Aluta Continua!!!

One must take this opportunity to salute all Media workers within the country Swaziland/ESwatini. Since, some of others might be aware that from May of every year it is time for negotiations on salaries and other issues to be bargained, workers from both Swazi Observer and Swazi TV might have noted that nothing has been reported to them regarding the processes as usual. At Swazi Observer a letter was submitted towards the end of May requesting Management to open up the negotiation table. Our letter had demands which were submitted to the negotiation team which were submitted in the letter. The response was that, the company was still busy sorting or cleaning itself out since it has a new MD and it was yet to conclude its budgeting processes, they said they will inform us once they are done, which till today nothing has been forthcoming. One must just state that tomorrow (Thursday 2 August 2018 by 8am at the Newsroom) all union members at Swazi Observer will be having a meeting to decide on a wayforward on the current situation and conduct of the management.

At STVA, so far we had written about two letters of demand that the table be opened up. One must mention though that this company has been playing hide and seek running away from bargaining on many pending issues including terms and conditions amongst others since last year 2017 despite having wrote to them around 8 letters without any response. This is a company that is worse on treatment of union members, union bashing and threatening of unionised employees. So leadership, has, knowing the tendency of this company concluded to take the issue further. We are currently waiting to hear what will their response be in the letter we submitted today complaining and stating our unhappiness on the continuingiddle finger showing it is doing to the union when it is time to bargain on issues.

On conclusion, the union has had enough of the tendencies employers are doing to its members, it is time to take further actions, not just any actions but aggressive and meaningful, with purpose actions.

Swazi Observer staff is hereby informed and further requested that from Thursday 02 November 2017 onwards, there would be picketing at Swazi Observer's entrance by 1pm to 2pm during lunch hour everyday. The picketing is part of one of the strategies to try and put pressure on the company to look into the demands of the workers. The demands are;
1. Implementation of 8.2% cost of living adjustment for 2017
2. Salary review implementation
3. E100.00 implementation of Medical AID for 2017
Members must also note that the National Executive Committee on the day will be in the board room continuing with the negotiations, and this is the day where it will be known whether he company give to our demands or a deadlock is reached, whereby if deadlocked, then the second step will have to follow. All members are welcomed to offer support and be part of the picketing to reshape our Media houses wages and conditions of service. AMNDLA!!

Journalists around the world will take part in a global day of action to stand up for women workers’ rights on 8th March to tackle the gender pay gap, eradicate media sexism and stop gender-based violence in newsrooms and workplaces.

Members of IFJ- affiliated unions and associations will use International Women’s Day to highlight key challenges facing women journalists in every continent.
As part of the UN’s International Women’s Day - “Women in the Changing World of Work: Planet 50-50 by 2030” – IFJ affiliates will be demanding:
Equal access to leading newsroom positions for women and men
Closing the gender pay gap in journalism
Strengthening equal treatment for all workers regardless of gender
Developing and implementing gender equality policies in the newsrooms
Securing fair gender portrayal in news content
All journalists can take part by:

For female journalists, this rise of “acceptable” misogyny – as evidenced by the recent loss of legislation against domestic violence in several countries – is colliding with rising threats to press freedom. And, as with other forms of violence, female journalists may increasingly find themselves in the crosshairs.

“In these shifting times, it is more essential than ever to speak out - saying “no rolling back on women’s rights.”

Comrades ngiyabulela, ngiyavusela, ngiyadumelisa after a long time without any update. Unions under TUCOSWA including ours MWUS, resolved that the issue of wages in the country aren't favouring and contributing to their daily needs, hence it was agreed today at a meeting held at Caritas that a petition be delivered addressing that issue amongst others. The issue of mininum wage has been filed with government since 2003 till today nothing has materialised due to that the government has always been raising excuses, however the time has arrived that we all say enough is enough, better wages and conditions must be applied as per the ILO conditions and declarations. The union would also like to urge you to remain behaved and contain yourselves in every situation that might come against your happiness, also reminding you about the huge task ahead of having to defend and protect the brand of the union and that of your employers by staying away of any wrong doings and violence during the festive season.
