LEGISLATIVE UPDATE
MAP is continuously monitoring legislation affecting our membership. To that aim, many news outlets have reported President Biden may sign the Social Security Fairness Act into law, as soon as Monday, January 6, 2025. This law would eliminate the Windfall Elimination Provision (“WEP”) and the Government Pension Offset (“GPO”).
Currently, WEP and GPO reduce a person's Social Security benefit if they also receive a pension from a job not covered by Social Security taxes (e.g. police officers, firefighters, and other local and state government employees). Because of WEP and GPO, Social Security benefits are slashed if the employee worked in both a covered and non-covered job throughout their career. The existing law was aimed to prevent individuals from receiving a "windfall" Social Security benefit if they worked in a job not covered by Social Security taxes and then qualified for a Social Security benefit based on other covered employment (e.g. secondary employment).
Upon signature of the President, the reduction of Social Security benefits would be repealed. Meaning, this would amend the Social Security Act, abolishing provisions that reduce the amount of Social Security benefits public employees can collect if they already receive government pensions. This has a tremendous impact on our members. In eliminating the reduction of Social Security benefits, while still being entitled to a public pension, many of our members will benefit from this historic transformation.
At this time, the Social Security Administration is evaluating implementation should the President affix his signature. More information can be obtained via the Social Security website at ssa.gov. According to the Social Security Administration, “If you are receiving a public pension and are now interested in filing for benefits, you may file online at ssa.gov or schedule an appointment.” We will continue to monitor the status of the bill. As always, we will notify our members should this become law.
